Nobody will believe mom went and son stayed home... they just won't.

Defense best bet is to say they dropped him off on the way because he didn't want to go thru with it.
Still conspired regardless of who actually went to kill.

Then say shoeprint is BW's wearing the wrong size that only makes it look like GW's.

If I heard correctly. The state basically says it doesn't matter if Jake lied because they all lied, even George.

Judge just got seated.

They're debating about playing the interview. Which if it happens, may not be until morning now.

State doesn't want to play Jake's interview? AC argues defense cannot play co-conspirator's statements.

Interview will be addressed tomorrow. Defense will continue cross-exam with Sheiderer and that will be all for today.

Judge will allow defense to ask how the recorded interview helped guide their case. Then wait until tomorrow to actually play it.

Total BS is they are not allowed to play tape of LE interview of killers.

Gotta say I am liking AC more each day. She puts forth a good vigorous argument before the judge, I think.

State is reminding the courts that this is a conspiracy case. Will argue more on this in the morning.

I think I understand the argument.

They would not be allowed to play the recorded interview of George and because this is a conspiracy charge, the state is saying that Jake being a conspirator is the same as if he were George so the defense should not be allowed to play his recorded interview.

I can agree with this. They want to say that Jake lied. But the prosecution says that they all 4 lied and said nearly the same identical thing when interviewed at the border. So it isn't legally sound to play Jake's interview and that the appropriate time would be to question Jake about the content of this recorded interview when he is on the stand (it was said when and if he takes the stand)

Looks like they are hiding something.
The state doesn't want favoritism of guilt because the defendants are all equally guilty under their conspiracy. I have to agree. One defendant should not be made to look less guilty than another. Imo.

I don't think it's hiding anything. They legally can't play George's and he's on trial. He lied in his as well so allowing them to play Jake's where he lies is insinuating that Jake is the only one that lied basically and since there is a conspiracy charge, they should think of Jake's interview as if it was George's and it can't legally be played. Something like this.

Am I understand this right, JW's audio interview at MT border crossing may be considered hearsay...until and when JW testifies?

I believe AC was citing case law that in a conspiracy case, a co-conspirator's statement cannot be played.

yes, I think the only purpose is for the defense to make an attempt to make GW4 less guilty. Imo.

She knows the slick operators they're up against. She knows the power that's been pulling so many strings in order to set these killers free.
