Yeah, I also see AC continually shake her head. She doesn’t want this, cites a “four hour delay” each time someone may opt out and they need a hearing.

Mentions seeking a Clarifying Order from Court of Appeals, Judge says they very well may get that. AC seems to want to limit their finding to Jake and Angela only, not every future witness.

Ridiculous. Lawyer saying he will do that. He has a buddy who will cover for him if he's busy.

Just as I predicted last night.

This is a defense attempt to slow down the trial and distract the jury from Jake's testimony.

Billy and GW4 will be set free to work on Fred Wagners farm.
I din't think it distracts from JW's testimony to have a camera on, IMO

JW's lawyers saying being on camera was not what he agreed to, blah blah, blah. 12C trumps the Court of Appeals order, sited case was juvenile court ruling blah, blah, blah...JW doesn't want to be broadcast,going to go ask JW and see what he feels about his 12C rights. Bringing up inmates saftey rights, will he be safe, testifying against family and will he be safe going back into prison for all his natural born life because his testimony will be on the net blah, blah, blah

I din't think it distracts from JW's tes3 to have a camera on, IMO

Talking about the coming and going, interruptions for hearings, etc. They're not allowed to take their notes home with them. If the trial gets shut down for a few days or a week so they can hold a hearing for Jake, yeah, that kind of interruption is harmful. Are jurors allowed to go back to work? Stay at home?

How do you manage a trial, with a jury, when you constantly have to stop and hold a hearing every time the news media's attorney objects to something? When you have one of these hearings, the trial has to stop and the jurors have to be dismissed for the day while they set up the hearing.

We just heard that - the Scioto paper's attorney will decide whether the Judge is doing this right.

What happens if this has to go to the Ohio Supreme Court for clarification? Does this default into a mistrial?
It would be interesting to hear what the lawyers say.

Andy Wilson is now making this point. If you change the rules in the middle of Jake's testimony, it leaves it open to be questioned later. Andy says keep the rules the same for the rest of Jake's testimony. Security issues with cooperating witnesses is a problem. He's going to call DRC over this, threat to individuals who come into court to testify on behalf of the state. He's going to call DeWine's office, too, JMO.

Wants to have DRC testify about the potential additional peril if JW testifies....loophole...judge is questioning about this.

Prosecutor doesnt want to change it for THIS witness because it may hurt, change or affect his testimony...looks like judge is grabbing onto that to keep the overall integrity of his testimony.

Wilson is also talking how JW's safety will be risky to him, and make him a target

Press attorney said one thing that is an issue is the media access to the room. If someone opts out of being recorded, it is hard for media to get inside the room because the court locks room 15 minutes before. So, that affects our ability to get inside to write the courtroom.

Judge points out that has not be strictly enforced. Judge said he just wanted to keep distractions to a minimum.

Judge said he has allowed people to leave the room whenever but reentry is restricted.

Judge: the difficulty of not having any rules at all, is if we allow one to do it, we have to allow all to do it, and then we have too much activity.

Judge doesn't have a problem allowing the press to come inside the courtroom a little later if needed.

Side note: Jake Wagner just arrived to the courthouse. Jury is supposed to be here by 10:00.

Press attorney telling judge there's great interest in this trial, and there's great interest in certain witness testimony. The press wouldn't object to every witness who opts out of being recorded. It would object to witnesses like a co-defendant like Jake and Angela Wagner.

Judge said he feels like he needs to follow the court of appeals decision which says if the media objects to any opt outs, the court should hold a hearing on it.

Defense: It would be an unnecessary burden on a witness to have to explain why they object to being recording. The reasons why could be irrelevant.

Judge: I have to assume the court of appeals feels there's a hearing requirement in there somewhere, and that's their interpretation of it, and that trumps my interpretation.

Jake Wagner's council now telling judge they have had no contact with Jake since Monday when he began testifying. However, we have no reason to think he's changed his mind about objecting to being recorded.

Jake's council said before a hearing on his opt out, they'd like to talk to him first to make sure he still does not want to be recorded. He said Jake likely feels his safety in prison could be jeopardized since he's testifying against family.

In the media room, we are discussing the fact that for years, we've publicized his plea deal agreement to cooperate with the state. We've post his photos every day he arrives to court, we post his quotes all day long. If people care, they know... regardless of if we record.

Of course, we have no say... but just a little insider info for you.

To me it's not even been touched upon about possible mistrial, which is probably why jydge's lawyer called for a recess when judge finally asked HW's lawyers what they thought, its all been about JW's 12C rights and his safety within the prison system in the future if he's made ti testify on camera...oh the perils if being a convicted murderer.

JW's lawyer sighting Supreme Court about 12C-2, says it should be honored until JW finishes his testimony...precedent is a juvenile court ruling, filming a juvenile...court needs to consider tge fairness of proceeding in general and any harm to JW if rules are changed midstream

Now Scioto media attorney is claiming Jake's rights are being violated by the judge, as well as news media, as well as GW4,etc. Jury now thinking "this is a bad judge who is violating everybody's rights. I'm voting for acquittal." JMO.
This is a master class in how to derail a murder trial and set the killers free.
