Afternoon break.
Judge Deering now talking about a snippet of "this Boondock Saints thing" that had played. Now, Deering said he wants to know where we're going with this line of questioning. Canepa talks about Jake saying he dyed his hair to look like Norman Reedus
Canepa says the dad joins in and looks a lot like Billy with the "duster and gadgets." Last part of movie, dad has convo with with his best friend he was going to kill. It's about a scorpion and a frog
The dad told the friend that he shouldn't have trusted him. Scorpion will sting you. Canepa says the jury can make the inference. Jake admits to watching it and showing it to Jake.
Judge Deering says "for those of us who get our entertainment from elsewhere what is this frog story?" or something to that effect. Canepa says it's a fable. Deering is worried jury might be confused if they haven't seen the movie
I watched the Boondock Saints movie when it first came up in the case in 2018 or 2019. Not my taste at all. I could barely finish it.
Now Andy Wilson brings up "Natural Born Killers" and how when that came out there were some killings. He's citing case law.
John P. Parker: we object to this. No 9 mm used. This whole fable of the scorpion and the frog - there's no evidence of a conversation between Billy and Chris that would even come close. This seems "desperate." It's speculation
Andy Wilson "we think it's relevant." Talks about Boondock Saints involving two vigilante brothers in similar clothing, etc.
Nash chimes in about inference stacking. Says this shouldn't make it to the jury. Wilson says it's not inference stacking.
Parker: Are we going to bring in a movie in every criminal prosecution?
Deering: My thought has to with the snippet that was played and it being played in close proximity to the murders
Canepa says she sent this to the defense as supplemental discovery. Deering "You sent the movies?" Canepa, "no, I figured they could get it off the inter webs."
