I have a question about defense experts. Do they usually shop around until they find one that agrees with their theory or do they pick an outside independent expert and share the evidence and then hope for the best? IF one expert doesn't see it their way do they then find another? I'm assuming the state gets the reports the expert has made prior to court? That would be something required to be turned over so they know what will be presented by the other expert?

Witness detailing the gruesome arm injury again. Very detailed. Sickening even. Love it. Imo.

And it's good that the jury hears again how CR was ambushed. Imo.
Wilson is doing a great cross examination using Mr Priest's testimony to work in favor of prosecution. Good strategy imo.

Priest also agreed the splinters in Chris head he would have been pretty close to doorway when bullets hit "that shattered wood" - agrees Chris Sr was on the porch when he was shot with rifle.

Showing bullet holes in doorway had gone through Chris Sr

Bullet.jpg

Is it your opinon he was shot on the porch and then fell into the house? "He would have entered the house at some point?"

"Descriptions of Jake Wagner are consistent with what I'm seeing at the scene" Priest says reading from his report.

Evidence supports he was outside when Chris Sr was struck even with no blood spatter etc with all the wounds to him

Wilson asks shots into screen door - appears to be shut? Priest says yes it was - shots were into the trailer and door frame when door was closed.

There is a spatter pattern inside the doorway. Consistent with blood spatter Priest says. Doesn't know if it is blood stain.

Picture zoomed in on that - Priest doesn’t know if it’s spatter or cast off and blood on floor inside doorway - that’s spatter he says

The defense should have given more thought to opening that door. Imo.

So if I am understanding this the defense didn't give them the DNA evidence to say who's blood was in each spot?

Why is he so hesitant to agree with Mr. Wilson?

Interesting the the defense only briefly examined their own witness. Yet, Wilson's cross examination is taking lots more time, is more thorough and is paying off for the prosecution.

We will learn more, I expect, when defense gets to re-direct, but I think prosecution is way more prepared.

Because Mr Wilson is more knowledgeable than the witness and Mr Wilson is more prepared and Mr Wilson has the facts on his side?

Finish him Clark!

The prosecution has brought the hammer down. It is getting tense. Voices are raised. Imo.

Mr. Priest, defense expert witness, is stumbling over shoe print testimony. Mr. Wilson suggests that Priest ignored shoe print evidence.

I think Nash was hesitant to ask very much. He probably felt like he was tiptoeing around hidden land mines.

OMG, how can this be an expert witness if he doesn't even know a baby was in the bed? That is a huge part of this.. kids left alive at the crime scenes in their parents blood for HOURS and this "expert" didn't recall seeing that a baby was in the bed? Did the defense even give this man all the evidence to make an accurate analysis?

  • #114
Mr. Wilson questioning Priest about movement of baby in the bed spreading around blood evidence. Mr Wilson asks Priest if he ignored that fact there was a baby in bed moving around trying to feed. Mr. Priest says he doesn't remember there was a baby in the bed.

So does he know or believe his client is guilty? Only reason I can think of to tiptoe around actual evidence is because you can't prove your client wasn't there and you actually suspect he was there, but can't ask certain questions because that might be exposed.

Because 1) Mr Wilson is a lawyer and 2) the witness had been cross examined many times previously....He's evaluating the harm to his client's case as he considers every response: If it hurts: Keep it short.
JMO of course

So how mad do you think this witness is at the defense team? lol Geez.

This was the smear streak that’s Chris blood - the body was dragged and then stopped and drug again two shots inside

Blood1.jpg
Blood2.jpg
Blood swabs back wall were from Gary and more on floor

Now moving on to footprints - Priest says Bill Bodziak "knows a lot about shoes" when asked whether he is the best expert.

He's asked if he ignored there were 2 left shoes of different sizes. He says they didn't match up the actual shoes. Wilson - you didn't put that in your report right? Did you ignore it in your report? I didn't have these shoes so I can't say anything about it

Wilson going after him hard - did you consciously ignore or omit the shoe print evidence with two different sizes?Isn't an important clue for two different sizes? I would agree with that?

He never went to the scene of Kenneth's trailer. Wilson asking him how to create reliable recreation ... and going after him on the shooting videos

Says he did the shooting recreation outside in Colorado at his son in law's farm.

The Wolf! GW4's FB post.

Edit: Clark unlocked the slide on the Beretta and it looked like Priest wondered if he loaded it. Ohio can be scary.

editeded: The court is enthralled, going way past lunch time.

Got him to agree that in his law enforcement experience that offenders create memories of their crimes. I'm paraphrasing big time. Imo.
