In U.S. law, a motion in limine (Latin: [ɪn ˈliːmɪˌne]; "at the start", literally, "on the threshold") is a motion, discussed outside the presence of the jury, to request that certain testimony be excluded. The motion is decided by a judge in both civil and criminal proceedings. It is frequently used at pre-trial hearings or during trial, and it can be used at both the state and federal levels.
- Why keep tangible evidence away from the Jury? You have to present all the evidence in front of the Jury. (I assume this includes photos of tangible evidence)
- I get that Angela and her attorneys don't want crime scene photos of the victim's shown, but some will need to be shown to the Jury, and will be shown, in my opinion.
- But I'm not getting the request to keep some of the tangible evidence away from the Jury.
The reasons for the motions are wide and varied, but probably the most frequent use of the motion in limine in a criminal trial is to shield the jury from information concerning the defendant that could possibly be unfairly prejudicial to the defendant if heard at trial.[1] Other reasons arise under the Federal Rules of Civil Procedure for failure to comply with discovery.[2][3][4]
JMO, they want those graphic photos out so the jury doesn't see how brutal the murders were. Especially when they see those 2 infants covered in their own parents blood. That will go a long way in gaining distain for the defendants and sympathy for the victims. It shows a level of brutality and callousness that jury's can't relate too and dehumanizes the defendant. I'd want as much of the crime scene pic and autopsy photos out as possible if I were the defendants. She also wants juvenile records unsealed in witnesses I believe, so they have a shot at discrediting them
