......we are talking about someone who reacted in a moment of rage......this person could quite easily be Mr Nice Guy in any other situation .........

Makes one wonder why Roux fought tooth and nail against it.

I think it all got a bit out of control there tbh. I think the defense were just trying to buttress OP's defense and had no intention at all of suggesting that OP had a serious mental health problem. However, I'm surprised they didn't see this coming once they read Vorster's report.

The report is available online.

...........fine, but i asked you....what do you think.....do you think he could have skimmed through using his charm ......it all dépends on what they were looking for, if it was sudden rage that's not going to show up with someone who has prepared themseves prior to the examination ......

That's not what your posts have said.

.......wrong again......i never said he was mentally ill, i said he was borderline i also said he was a calculater..........he put on his charm and sailed through.........but you still haven't awsered my question ..

Have you read the bit in the judgement yourself then in context?

No, to be honest I haven`t. Kind of gave up on it once the verdict was announced and have become `re-interested` with his release and then the appeal looming.

No. The reports contain results from the numerous tests he took. The results are not couched in lovely touchy feely 'what a charming man' terms. I expect they have been trained to look past charm and also to spot liars and malingerers given how frequently they would meet them in their line of work.

I understand what you are saying but in addition do you think that's the reason why his "SupportforOscar" fans still love him- his looks etc ?

Yes, I think so, they (the female supporters) aren't blind and can not be objective, I'm afraid.

How very honest :) It might be preferable to read it so you can judge it for yourself.

We're not talking about mental illness, we're talking about his character which you have disparaged and I have pointed out that there is evidence that your views are wrong.

BIB - I've just said what I think about that. Perhaps read my posts...?

..........not what was quoted in court but the full report ?

Yes you can read them online - I'm not sure every part is available but from memory around 60 pages are or were at least.

It is worth bearing in mind too that he was allowed to do it on an outpatient basis when normally the testing is done with the patient in residence. And his aunt is a clinical psychologist or similar who could have helped coach him. Was`nt the reason for this change in normal testing procedures because Masipa didn`t want to punish him twice? So IMO the results of the testing could have been compromised by the special circumstances allowed for OP. And please Trotterly et al don`t tell me that the state didn`t object to this. I know they didn`t, but many professionals said it was not the best way to preform this type of testing.

Hey thank you - I had forgotten the non-res element. Yes definitely would alter the result with no overnight monitoring and a real element of control given to the patient.
I do remember considering the Aunt Micky (?) factor though and looking up the tests online and whether you could "beat" the test. Plenty of online tutorials on that, I recall.

TBH I could not find out enough at the time, to see how they compare with US testing ( I know squat about UK standards in forensic psych), I know the US have multiple rigorous tests to cross check for malingering and faking for those claiming NGRI. Do they in SA?

In conclusion, yes he got preferential treatment with that one too and the results would have been affected for sure. Am I bothered really? No. I don't know why I should be- but I am happy to be told why I should. He was going onto a hospital wing anyway due to disability.

He didn't successfully fake insanity and thus somehow mitigate a 35 year sentence. He got some extra sympathetic treatment for his after-the-homicide PTSD/depression for which I have ZERO sympathy as he was not a victim he was the perpetrator. ( Would it concern me that a criminal blah blah suffered from insomnia, night terrors, whatever - no it wouldn't- I'd want to know what the family of the victim was suffering from)

The psychologists are also only human beings. :) They knew him as a hero/athlet who made headlines over years and developed, so to speak in front of their (African) eyes from an unknown 17 year old boy to an adult winner and playboy type in tailor-made suits etc. I think, mostly nobody is able to be only professional and impartial then, even male psychologists are not. IMO

And think of the Family Pistorius Imperium, that is also known to everybody and certainly are their single members too. Maybe it played a role in thinking of a young man with own abilities and money plus this important clan of successful people.

Fair enough. Even Jeffrey Dahmer had his female fans and he was a homosexual serial killer and of course Charles Manson got married!:scared:
