It was stated that if Massipa gave him anything more than 5 years that he would have to do a minimum of 5 years to be eligible for parole.

So I think that Massipa deliberately made sure that he didn't get more than 5 years.

She was definitely paid off imo.

With a possibility that his family had something on her as well. Maybe she covered up a crime or someone's involvement before. Maybe uncle p found out and forced her to go light on op. Idk.

Family source says Oscar Pistorius's parole is being DELIBERATELY delayed because authorities are worried pictures of him enjoying freedom will be 'unpopular'

A family source told MailOnline: 'It seems the authorities are under some sort of instructions to play for time, right up until the appeal.
'He was supposed to have some weeks at least to recover a bit, consult with his lawyers and prepare himself for the appeal.
'It seems as if the government doesn't want pictures being shown of him having any freedom in case this is unpopular.
'They are under a lot of pressure to keep him locked up until they absolutely have to let him out.
'The way this case is being handled seems unfair. :tears: There are rules and there are "Oscar" rules.
'Whatever you think about him, or what he did, it is dangerous that the government are interfering in the justice system.'

Crocodile tears by me.

Well that's an interesting one FG

A stronger statement from them - compared to the ones during the trial of we “have very faith in justice” etc.
Some serious allegations there.

so in pistorius double -speak does this mean….
- we know we have no chance to get this delay overturned and our attorneys have advised we can’t do anything
- we told our PR spokesperson not to make the statement as we need to look as if OP is broke
- It’s Arnold speaking but I won’t put my name to this and go official because I am making some serious allegations.
-PS no comment on the fact he needs extra psychotherapy

Imagine behind the scenes - doesn’t take a vivid imagination!
Oscar urging attorneys to file that emergency order to Court to challenge this (we talked about on WS a while ago.)
Webber attorneys saying “ we don’t advise you to take action as it’s unlikely to be successful now”
Arnold saying “who would foot the bill”
Carl -still confused.
Aimee - 'Uncle, stick that bit in about "There are rules and there are "Oscar" rules.", I read it on a OP fan site last week, apparently it's from the New testament"

This link is from LAST time he got the knock back for release last time- old post

http://www.news24.com/SouthAfrica/Os...wyers-20150819

"There was no word from Oscar Pistorius's lawyers on Wednesday night on whether they would pursue legal action following the decision by Justice Minister Michael Masutha...

His attorney Brian Webber could not immediately be reached for comment. However, Pistorius's family said they would consider their options.

"We accept the decision made by the minister of justice and are considering our options," family spokesperson Anneliese Burgess told News24 earlier."

PS That line in the family statement :"time to recover a bit...prepare for the Appeal". But OP isn't needed for the Appeal, doesn't need to appear and there is nothing he can add to the Appeal, everything is already submitted, unless he is now a whizz on case law and helped prepare the Heads himself.
Pistorius double-speak.

MEDIA STATEMENT
PISTORIUS FAMILY

06 October 2015

We have now been officially informed of the decision by the Parole Review Board to refer this matter back to the Parole Board.

We had put our trust in the Correctional Services system, but are very disconcerted by the constant delays in obtaining clarity on this matter.

We are concerned not only about the legality of the Parole Board's decision, but also about the fairness towards Oscar - and the many others - whose constitutional rights are being affected by the ongoing confusion around the timing of parole decisions.
When the Minister made his initial announcement, he was very clear that the petition by the Women's League had no legal substance, and that this was simply a procedural matter based on the Minister’s interpretation of the Correctional Services Act.

Time has now cured this procedural issue, and we cannot understand why the Review Board failed to reconsider the matter as it is empowered to do, and why the matter is now to be referred back to the Parole Board that has no reason to make a different decision from the one that was made in the first place.

With regards to the recommendation by the PRB that Oscar receive psychotherapy, we would like to emphasise that Oscar has been receiving regular and ongoing psychotherapy from not only his own psychologist, but also from prison psychologists and a social worker whose reports formed part of the parole decision process.

The failure to give proper - and consistent - effect to the Correctional Services Act flies in the face of administrative justice.

This experience leaves us with the uncomfortable conclusion that the public, political and media hype that was allowed to develop around Oscar’s trial has undermined his right to be treated like any other prisoner - as per the prescripts of the Correctional Services Act.

The review board also ordered Pistorius to undergo psychotherapy and recommended he should be put under firearm restrictions if granted parole.

Pistorius' family said he was already receiving "regular and ongoing psychotherapy" from psychologists and a social worker, whose reports were considered in the original decision to release him.

Pistorius may now still be behind bars on November 3, when prosecutors appeal to South Africa's supreme court for a murder conviction and a harsher sentence.

"The PRB (parole review board) also directed that the offender be subjected to psychotherapy in order to address criminogenic factors of the crime he committed," the review board said in a statement.

In an interview with local television channel eNCA on Tuesday, Mr Masutha insisted Pistorius had been treated fairly despite his intervention.

"As long as the law prescribes a matter should be dealt with in a particular way, fairness in justice simply means upholding the rule of law and in this instance, that's what the law required and that's the way the matter had to be dealt with," he said.

I am unsure how true this report is. To me, after reading, it seems it is a possibility not a fact but I will post it anyway and you can decide.

Pistorius lawyers to pursue legal action over parole

JOHANNESBURG - The lawyers of convicted paralympian, Oscar Pistorius, will pursue legal action in the matter related to his parole.

The lawyers will argue that the delays to his parole matter have been unconstitutional.

Well the family had better hurry and get that emergency order in to Pretoria High Court to be heard.

IB, I was just reading that whilst you were typing .
It links to the old K.Phelps article from August before the Minister stepped in on his release.

I see that Brenda Wardle on Twitter has been arguing that the Board is incorrect in referring it back. I have no idea if that is true.
Can I really suppose that all those legal people on the panel would leave any legal opening for OP's attorneys to successfully challenge this? It doesn't make sense. The Minister in August was at great pains to point out that he had ensured he was legally entitled to refer the decision to them. So is it likely that they in turn mess up?

  • #777
If the family are so concerned that OP is not being treated like 'other' prisoners, maybe they could suggest he gives back his new mattress and serves his time in the normal wing.
