Just really depends on how much evidence there is to support charges and conviction.

I totally agree, but I wonder if they thought the jury wouldn't convict without the victim testifying.

Most likely. I'm guessing she was terrified to come forward. Now, she should feel better about it.

It’s much easier for witnesses to testify when the alleged perpetrator is in custody, imo.

And yet, a fresh flood of terror.

Absolutely, now, unfortunately, she will have to relive her ordeal all over again.

Cases like this break my heart. Regardless of the outcome (and I’m afraid this will end terribly), two caring, concerned parents will find out information about their ambitious, educated child that will cause them more pain than I can imagine. I hope they have a good support system around them. I would love to give them both a hug and hope they find the strength to bear this burden.

And process how much closer to DEATH she had previously been.

Nightmare.

If this monster surrendered rather than fighting it out or trying to flee, he might talk.
Ofcourse we don't know the circumstances of the arrest. Could be either surrender or be shot on the spot.

I can’t find a record of the prior kidnapping /strangulation charges. I take this to mean that the charges were dropped prior to any court proceedings, such as arraignment. There would be no record if no court proceedings took place. This suggests, imo, that the alleged prior victim was unavailable to the ADA assigned to the case. Moo.
The DA’s Office went over this in the pressor this morning.

The case was withdrawn because the witness did not appear in court. She reviewed the case again and decided to refile the charges of kidnapping and strangulation - commenting there is enough evidence to move it forward.

Because they have the prior offense on video. Sending strength to the prior victim. MOO

3 weeks ago someone attempted to sell the car on Facebook Marketplace. I believe it is the suspect in one of the photos. I am not sure if sharing the link is allowed. This post was reported and apparently helped authorities locate the vehicle.

How closed down is the school? Thinking of the case where the body was found in an old building heating system or something way after the fact. I worry about hidden areas.

Then again he doesn’t seem that careful.

I don’t get this. The first appearance in court would be the arraignment. The accuser would not have to appear for that proceeding. If a formal arraignment had occurred, there would be a record. The whole idea that the alleged victim failed to appear in court sounds like bad reporting, imo. More likely, charges were dropped because the witness could not be found by the ADA.

I feel your anger. Truly. But it’s almost impossible to prosecute a case when the alleged victim does not cooperate.

An obvious move on the part of the defense would be to demand a jury trial. Well, what jury would convict without a witness?

Hence, the charges are dropped.

I don’t like it, but it happens all of the time.

Moo.
The constitutional right to confront your accuser in court shuts some victims down completely, they are terrified to see their attacker again. I completely understand that.

Looks pretty closed down, but not fenced off. ADA H.H. Lewis Middle School
