Paperwork Details Elisa Baker’s Involvement In Investigation

I think it is because not only does EB seem to have two attorney's at the moment, she also has a private investigator.(Before ever being charged.) This team seems to have said they have the right to find and collect evidence. Therefore any evidence they find and collect, would be for their benefit. This is complete and total speculation on my part here, but the way some things have played so far it is almost as though they want the jury (If charges are made and goes to trial.) to view the LE and prosecutors as dependent on them for evidence. (Like they couldn't find a needle in a haystack with a map.) And the DA does not take kindly to this. JMO

EB already has a court appointed attorney, Scott Riley. I have never understood why she had two. She has never been charged with any murder yet.

This is the DA's response to Dubb's and her "evidence retreival" mission IMO. You wanna play fast and loose with evidence in a criminal investigation for which your client hasn't even been charged? Well we can fix that missy.

ALL MOO

I agree, tlcox. It looks like her questionable retrieval of the evidence has put her entire appointment under scrutiny.

But EB talked to her attorney and told them where to find whatever it was BEFORE she started talking to LE, so I think the problem is they (EB'S attorney) knew they should not have touched whatever it was and did so anyway and now the DA is pi$$ed.

I believe what we're seeing is shaping up to be a battle of the experts concerning cause of death of Zahra.

Just reading the tea leaves a bit I can imagine some pathologist examining any remains for blast or carcinoma cells, any blood cells\counts recovered etc. Blood chemistry and fluids are going to play a big part of the trials. So it goes, your pathologist VS my pathologist. IMO

I say ship em off to the military's Delta force for interrogation. :D

I'm speculating this. More of a wonder really. If EB's attorney's found, bagged and collected the evidence, then turned it over to LE. Would that not be considered defendants evidence and not states? Anyone know?

  • #366
I think they retrieved the evidence so as to taint the chain of custody. This, as far as I know, is a huge no-no in the world of forensics and investigative work. They should have known better. The evidence was not handed to them by EB, they went and retrieved it per her instructions. Totally different ball of wax and I think there will be some repercussions for the attorney that participated in that. JMO

NO - not really. MHO would be that it would eventually get thrown out for being contaminated - not followed proper chain of command type deal.

Would really like to know what this piece of evidence was.

I think from the reaction of the DA, whatever the evidence was is BIG.

ITA. And I can't help thinking this now potentially tainted piece of evidence is something that would have incriminated her too - and now can't be used against either of them.

Bet she'll do it for nothing if push comes to shove.

SNIPPED:

...and the Capital Defender's Office says she hasn't submitted a bill.

Still, Dubs could work for free or work out an arrangement with Elisa Baker.

What's in it for Dubs? EB has no money to speak of, and I can't imagine her family shelling out big bucks for a high-powered attorney.

Perhaps her internet connections will set up a defense fund for her.

Press. Press. Press. Notoriety.

If it was a piece of evidence that was found in the yard, AB was in the yard with a lot of people before LE did their big search. So I think there may be more than this contaminated evidence. jmo

Can I claim I am distressed by this entire case ? Sorry Luv :D

Oh yes, Dear...you most certainly can claim that. And any court would grant you mercy. :)

If I were AB's defence team and he does get charged, I'd use it against EB's defence team and say they planted that evidence. I agree with what everyone is saying in that no one's lawyers should be touching anything. Leaves way to much room for reasonable doubt to start creeping in.

Sal posted this up in the stickies, Thanks Sal!

The prosecutor in the Zahra Baker case will meet with the N.C. Attorney General's office today to determine if a defense attorney for Elisa Baker was inappropriately appointed at taxpayer expense.

That could get reallyyyyyyyyyyyyyyyy interesting.

Thanks Teh :D I must admit I was pretty well curious as to why EB was appointed a DP certified lawyer when the only charge relating to Zahra's disappearance is Obstruction. Didn't make sense to me at the time but it certainly has fueled much speculation.

I wonder what made it so clear to Hurley that EB was a prime suspect. I haven't heard the police even mention the word suspect or person of interest for that matter, yet. Perhaps Hurley should make it clear to lawyers appointed that collecting evidence relating to an active investigation and hanging on to it for a day or two isn't exactly a good way to conduct themselves. If indeed EB is the prime suspect, I definitely want her to have good representation. What I do not want is for her to have unfair and prejudicial representation. Nothing screams guilty better than appointing a DP certified lawyer to an obstruction charge does it?

One would think her lawyers would not contaminate evidence pointing to AB at the risk of getting it thrown out by his lawyers. But you never know I guess. jmo

As I see it EB is a manipulator no matter what she does. She was even doing it while "supposedly" cooperating with LE. As she has said.....it's not like she can't defend herself.
