Paperwork Details Elisa Baker’s Involvement In Investigation

I don't want her to appeal after it's over on an "incompetant counsel" charge.

pffft.

Dubbs screwed up IMO. She is being pressured by EB to get her the he77 outta there. Each time LE was off on these searches, they were very closed mouth about the why of the search or the site, etc. EB has been a cooperative witness TO a DEGREE. She has fessed up just enough but not nearly all the way. LE hasn't offered her a deal or even charged her yet. Plus she's got this like huge bail that keeps her stuck in there! <<-- snarky impression of a very self involved person.

I think Dubbs tried to force LE's hand and put pressure on them and it has completely backfired!

@willow

I surely hope not. EB pushed for this but could benefit down the road. IMO this was the actions of a less seasoned defense attorney in a potential DP, Murder 1, etc etc. case.

This doesn't feel like the manuavers of a person who is skilled at moving through this sort of maelstrom. Again MOO

Nothing screams guilty better than appointing a DP certified lawyer to an obstruction charge does it?

RSBM.

Totally agree... wonder now if this was part of the plan? LD gets appointed, no one calls foul right away... days later questions are raised...

I dont know if this has been mentioned but, it could be Dubbs got ABs clothing from the house that has Zahras blood on it? That EB made sure she kept somewhere for safe keeping for the purpose of proof on his part?

That's a thought! That had not even occured to me! That would certainly be quite cunning and would definitely serve her purpose if it 'didn't go as planned'!

Interesting, because she also stated.. that "nothing went as planned".

Hmmm

She led these people, all of them, on a goose chase. She sat back laughing. They went to the landfill, came up empty. Then days later the workers at the landfill found the mattress. She led them to Dudley Shoals, nothing. Then Christie rd, nothing. The house, nothing but the new mattress. Then back yet again to all spots, that had not been secured, and there it was all of the new evidence. What better way to cause a reasonable doubt? She has manipulated this whole thing from the very beginning. She has been doing things like this to get out of trouble her whole life IMO. She has yet changed her name again too. Just the spelling of it mind you and just a first name. It wasn't a think ahead thing. She does things on the spot and in the moment. Conniving and working her way out of trouble.

It's pretty much a given that, if convicted, she will try to do so no matter what. Very few of those cases prevail on appeal however.

ITA. As I understand it death penalty cases automatically get a number of appeals anyway and it seems to be a pattern with death row clients, they change lawyers somewhere down the line and the new lawyers file for inadequate representation by the old lawyers, it very rarely works. I'm not worried, once they get her convicted she isn't going anywhere for a VERY long time.

I agree she kept something that shows AB's involvement but if it's clothing his lawyers could just argue that SHE wore them.

It's pretty tough to prove inadequate representation, from what I understand. I doubt that EB could successfully claim that. At this point, though, it's complete conjecture. We haven't even gotten to the charges pertaining to Zahra yet.

Actually, she didn't lead them on a "wild goose chase", she took them to the places where evidence was located (eventually). A "wild goose chase", imo, would have been her taking them to Hudson Elementary School, or a field behind the Walmart.

She took them to the vicinity of the location. Pointed area's out. They found nothing. Left the scene. Left it unsecured. Only to lead them back there to the exact vicinity to find it. I call that a goose chase. Not a wild goose chase.

I agree, much like a snipe hunt.

What is unclear to me is if it was indeed EB who actually took LE back to the exact location on Dudley Shoals. For some reason I am just not sure about that at all. Evidence on Christie Road - LE expanded their search area on their own motivation. I see a lot of bravado in this motion.

She took them right up to the swing gate at the Christie Rd. location. No other way in and out of that area. That's not any kind of goose chase, imo. No, she didn't get out of the car, walk down the path, lean over the gel liner and point, but I wouldn't expect her to do that if she were trying to say, "Here's where he/they dumped her". And I think that's her angle..." I know things, but I wasn't actually there."

I don't believe for one minute that LE would have had any idea where to search if EB (or AB, but he's so oblivious to all of this *snark*) hadn't lead them there.

JMO.

ETA: And I think the reason that LE didn't do a thorough search the first time, was because they simply didn't believe EB. Something happened to change their minds about her info. Most likely, whatever her attorney "retrieved".

In going back over the timeline posted on WSOC I see that:

Afternoon of Oct. 20: A team of investigators begins searching a landfill in Lenoir in connection with Zahra’s disappearance. In a news conference, Chief Adkins would say only that searchers are looking for a “piece of evidence.”

Do you think it's odd then that EB began cooperating on October 22?

If that turns out to be the case then IMO AB would be charged at this point. Also, that would be serious evidence tampering, a criminal offense if I am not mistaken.

Could that evidence even be admissible in court, since it was obtained by a defense attorney and not LE?
I'm not a lawyer.

Talk about contamination!

Does anyone remember at one of the press conferences that one of the LE was talking about a piece of evidence and stated that EB had NOT helped them find that or had NOT led them to that???? :waitasec:

I could be getting my cases mixed up but I could have sworn that happended here with Zahra's case.

I went back and reviewed several articles about the press conferences but could not find it.

Also there was a post earlier about what a manipulator EB was, I suspect AB can manipulate too. Because of his public persona I think his is more hidden but I suspect he had to manipulate if KB is as strong a person as I suspect. After all look how he's convinced her of his innocence.

I love my children but I'm not blind or in denial! I will be there for them but they will pay the consequences.
