breathing free has a price... enter legally and abide by the laws. lying on visas, terrorist gang-membership and ignoring deportation laws.... isn't optional. the usa isn't the only country with laws, policies and procedures for non-citizen entry/continued residence. us taxpayers cannot afford overwhelming debt incurred by those who do not abide by laws, and are allowed to drain the us fiscal budget with free programs... no matter how poor, tired, and huddle they may be. it's bewildering to me why anyone expects the us or any other country to accept such behavior.

abrego-garcia entered the us illegally in 2011. he didn't file for asylum from 2011 to 2019. he ignored his deportation order... issued by an immigration judge in 2019 and lost his appeal... which was all due process. i don't know why immigration didn't deport him in 2019, and i don't know why he didn't leave on his own to a country that would welcome him.

An immigration judge believed Garcia so I'm not sure why others question the judge's understanding, authority, and subsequent order. This is why a judge ruled that Garcia could remain in the US:

If the travelers had never had this experience before when returning from Canada, how would they know that a “secondary inspection” was an established protocol? Especially when no explanation was given and they were put in a cell with no coat or shoes and deprived of a phone call.

I would suggest that the citizen has much less reason to lie than the government in this case.

this is the usa, not england. the year is currently 2025, not 1215. and, at this time, and according to our us constitution we have branches of government... some have more power than others.

Fox NewsJessica Tarlov swiftly questioned co-host Greg Gutfeld on Tuesday for downplaying President Donald Trump wrongfully deporting a Maryland man to a brutal prison in El Salvador.

“Into a prison camp? Not just out into the wild.”

“That’s not true. Stop,” Tarlov replied as Pirro claimed the man was “never able to rebut” proof he was a “gang” member.

Tarlov went on to note that the claim was based on “double hearsay testimony” from a Maryland officer during Abrego Garcia’s immigration proceedings only for the officer to be subsequently suspended for giving out confidential information on a case to a sex worker.

 
Meanwhile, here in Oregon…


Portland State University graduate student Abdul Almutairi learned Thursday he was one of 23 international students in Oregon targeted by the Trump administration for deportation.

Even though the student in his 30s was just months away from earning his doctoral degree in physics at PSU, he dashed to his apartment, packed what he could carry and headed for Seattle, where he boarded a plane back home to Kuwait.

The Department of Homeland Security gave no reason for terminating Almutairi’s visa, according to his graduate school supervisor, physics professor Erik Sanchez. But his student did absolutely nothing wrong, he said.

Sanchez said Almutairi was able to get support from PSU officials and an immigration attorney after learning of his visa revocation last week. Still, he felt he had no choice but to leave the country immediately. If he were detained, he had no way of knowing where he would end up — or for how long.

Chaotic surveillance footage from inside a federal courthouse showed the moment two ICE agents knocked down an elderly man with a cane as they attempted to arrest a Venezuelan migrant.

They arrested Mr Colmenarez in a public area, after planning to arrest him in a public elevator.

"Civil immigration enforcement actions in or near courthouses should, to the extent practicable, continue to take place in non-public areas of the courthouse, be conducted in collaboration with court security staff, and use the court building’s non-public entrances and exits."
 
The video on this article is pretty disturbing, ICE agents using a sledgehammer to break the window of the car of Guatemalan immigrants (neither of whom have any criminal records and the woman is here on asylum) as they just sit there calmly saying they want to wait for their attorney to arrive before speaking to them. It’s very jarring to see the actions of the ICE agents compared to the calmness of the people in their car.

one... my original post included an official government doc. two... another poster replied to that post with a link... which didn't appear to be an official government document but i didn't argue, i simply accepted that link as basis for their opinion. three... i did reply to his/her post which including a link - that i never claimed to be an official government document. if you came to that impression... it was wise to do the research. however, i'm not sure you did the research on the other poster's link, but obviously that doesn't matter because it is only my post/link that you call out. the bottom line is that the other poster and i were agreeing to disagree with links that matched... neither contained official government documents. we were not rude nor disrespectful with our differing opinions... at least not from my perspective.

Your deep dive is commendable, but it doesn't change the legal principle in question - as old as the Magna Carta (1215). Specifically, clause 42.


per the link below - i'm unsure if official as i am in no way proficient on the magna carta clauses - i believe you mean clause 39

here is clause 39

clause 42 states something different... again, per same link

it's possible the original latin language in which the magna carta was written might make clauses and their numbering different but i'm not proficient in latin, either.
