GUILTY PLEA DEAL ACCEPTED - 4 Univ of Idaho Students Murdered, Bryan Kohberger Arrested, Moscow, Nov 2022 #114

I think it was a federal crime because the felon crossed state lines. I'm not a lawyer but I was involved in a federal crime.

A coworker was laid off and a year later he came to the office in the early morning and poured gasoline around the building then threw a molitove (sp?) cocktail through a window.

No one was hurt and like a typical arsonist he returned to the scene of the crime.

Because the company has an office in another state the feds took the case and threw the book at him to keep him in prison for a minimum of 40 years.

I've never understood that. It may have had something to do with the Patriot Act. Domestic terrorism, having marijuana, ammo that didn't match his gun, etc.
I agree, thanks for this example based on personal experience.

What you said here:

"Because the company has an office in another state the feds took the case and threw the book at him to keep him in prison for a minimum of 40 years"

Made a light go on in my head, as it sounded like the federal charges for crossing a state line during the commission of a crime, or thereafter to flee justice, or return to the scene of the crime, is like another layered "option with more weight for a longer prison sentence" (my paraphrasing) that can be added on and be superseding.

Which makes me wonder if the federal charges are sometimes brought in if the other charges the perp could be convicted for may not stick or may have a lesser sentence that the judge and prosecution feel is not appropriate punishment for the circumstances of the crime (felony).

Maybe in this case, they held the fugitive traveling across state lines designation "in abeyance" until the state had their opportunity to indict and prosecute, but could or would still be able to bring federal charges IF needed/IF BK hadn't been convicted and found guilty on all charges with 4 life sentences, the maximum time / his lifetime, as it were.

BUT:

IF the felon BK had gotten off/been found innocent or only found guilty of the B&E felony or lesser charges like manslaughter but not their murders at trial for some reason (you never know with a jury trial, as BT has said was one of the reasons they accepted the last minute plea deal)

AND the maximum sentences when added up for what he was found guilty of in a hypothetical jury trial were not extensive enough for the judge and prosecution to deem appropriate (there's a legal term for this I can't recall right now)

THEN maybe the federal charges "held in abeyance" could/would be brought to add on to the length of his prison term so they added up to the "right number of years" deemed satisfactory and in line with due diligence for the commission of such heinous crimes by the prosecution.

JMO... somehow this makes my day that there could be a fall-back mechanism like this for more severe charges lopped on federally when needed, just in case things didn't turn out as they did in this case at the state level, thankfully!

"abeyance

An abeyance is a temporary suspension of activity while awaiting the resolution of some other proceeding without which the activity in abeyance cannot continue."

'It’s driving him crazy.

Oh, I think that horse left that barn long ago.

But great, let him live with this harassment.

Not that the other prisoners in a maximum security prison are angelic, but let him suffer, even if it’s only 1% of the anguish he caused to his victims and their families.

I don’t know as that is a common route that people take he had used before when he wasn’t ‘fleeing’. But it sure could be what they are considering fleeing!

He maintained a PA car registration- he didn’t switch it to WA.
Students don’t have to, but many want to establish residence. A PhD program is not 2 years, some can take 3 or 5 years.

So was BK ever planning to stay in WA?
Having local plates would be easier to track if looking for a local perp in a database, but out of state plates are more noticeable to people seeing a car. But, in Moscow plates from WA would have blended in much better.

I don’t know-

IMO
I mentioned in an earlier thread that he registered to vote in WA on 7/1/22. So presumably, he intended to stay until November, at least, but to me that’s an indicator that he did intend to stay for some length of time.

Nov 18 he registered the plates of the Elantra to Washington - where he’d need 2 plates. Not PA. It had been set to expire on Nov 30. ( DMV lady was also interviewed by LE. He wore gloves while he was speaking to her)

We covered this a while back but it's not easy to keep track of info in these threads

I think both of these things were to establish residency, therefore in state tuition.

I have long suspected this. It is a bit of a way in too. He could let the dog out and be like oh hey I found your dog. He could feed the dog. He could train the dog. Yeah I would bet on it. JMOO
"The most concerning incident, the friend told police, was when she and Goncalves arrived at the home to find "the rear side door standing open and Murphy was missing."

This is daunting. If it was him, then he had previously scouted the inside of the house (so he knew the way) and also made friends with Murphy. It has always troubled me about the dog not barking, but if the dog knew him, he wouldn't have barked. Makes so much sense.

Obstruction of justice can also be a federal crime.
BK hid evidence in PA.
He took evidence from WA to PA.
He may have also cleared his tech evidence while in PA.
He also moved trash to a neighbor’s trash can. If his DNA is considered evidence, that is a crime.

BK also stalked a person across state lines- I’m reading that this is one of the charges of Luigi Mangione. Evidently that is a federal crime.
Luigi Mangione- federal crimes why?

Also if it was decided he hated women- that could be a hate crime- federal.

If it is decided he is fueling other crimes as leader of incel, and copycats begin to act??
That could be domestic terrorism, I think?

Someone would have to want to pursue it…
If he decides he would like to file an appeal- maybe then this card could be played?
It would have to be both a federal crime and also warrant the death penalty. Hmm

A lot of cases seem to fade away in the public eye while paperwork part is still happening. They almost never are closed this smoothly and quickly.
Why would we think BK is ready to become insignificant? That and germs are his worst fears.

We will know if he keeps AT on retainer, or gets another attorney.

IMO

Does he have the choice of whether to keep AT as his attorney? I believe she's state-appointed, isn't she? I don't know how that works, but it would be interesting to see.
JMO.

And now they should move him as soon as he gets settled into a routine,
switch up his schedule every two weeks,
give him the wrong food!
And the final straw- a big roommate that sheds body hair!
Yes! 🤣

Going into two fingered zoom picture mode.....I think I see, what I believe is superficial wounds to BK's inner part of his thumb, on the very gaunt looking 'thumbs up' selfie, mere hours after the slaughter....comforting, in a small way knowing that Xana gave it her 'all'

Here is Part 2 of my summary of the recent Courtroom Confidential episode, in which host Josh Ritter once again talks to Kevin Fixler. This part starts with viewer questions that were not addressed fully in Part 1:

Q & A
  • 59:51 Fixler, as an advocate for and representative of the public, plans to try to interview the murderer, who is now able to receive mail from the public. AT had restricted this mail before sentencing, but now that he is in prison, the murderer is able to receive letters, including “fan mail.”
  • 1:02:15 Fixler is shocked that some crime scene photos have already been released. The Idaho Statesman does not plan to request or publish such photos. (More than 14,000 crime scene and autopsy photos exist, of which about 200 have been released to media organizations and “teens” published online.)
  • 1:03:59 Kevin hasn’t interviewed Steve Goncalves about his displeasure with the plea agreement. He did interview former Chief Fry, who doesn’t judge Goncalves, despite his criticism of the local police.
  • 1:05:40 Kevin asked to interview AT, but she and the rest of the defense team declined to give any interviews.
  • 1:06:41 Kevin has received a legal education by covering this case. The sentencing hearing was emotional, even though he was in an overflow room. He shared tears with Chief Fry, and said Bill Thompson barely held it together in court.
  • 1:09:41 Kevin will not attend Crime Con, even though Josh invited him to sit at his booth
More Idaho 4 discussion and updates:
  • 1:10:22 The special investigation into the leaks is ongoing, with Bill Thompson and former Chief Fry eager to discover the cuprit(s). The public won’t know anything about the investigation since it is under seal—unless someone is charged and prosecuted.
  • 1:12:01 Josh sets up the portion of the security cam footage from 1112 King Road (recently shared by the Idaho Statesman) that he will show and discuss with Kevin.
IMG_3780.webp
For reference (screenshot from the video): The top of the map is north. Red marks the location of the murders at 1122 King Rd, and blue (added by me) marks the location of the security camera at 1112 King Rd. Entry into and exit from the neighborhood is via King Rd at Taylor Ave. 1122 and 1112 King Rd are actually on Queen Rd, which is why the DD driver was confused. Finally, the road wraps fully around the apartment complex to the east (right) of the murder house, but Linda Ln does not connect to it.
  • 1:15:10 Josh shows the security camera footage starting in real time at 4:17:24 am the morning of the murders, just when we can hear voice(s), a thud, and the start of barking. The segment continues at 15x speed, then returns to real time when the murderer speeds away, ending at 4:20:55 when his car turns right on King Rd, nearly losing control.
  • 1:16:02 Kevin says the murderer then turned left (on Taylor Ave) and sped away behind neighborhood (on Walenta Dr). He reminds us that the murders occurred in a 13-minute window starting at 4:07 am and concludes by saying, based on the timeline, that he can hear Xana screaming and make out her distinct words during the segment shown by Josh.
  • 1:17:45 Josh replays the same video segment, but stops later (at 4:21:15 am) so we can see the murderer proceeding down Walenta Dr after exiting the neighborhood vi Taylor Ave.
  • 1:19:20 Josh remarks how loud the footage is, even though the camera is 50 ft from Xana’s room.
  • 1:20:54 Kevin says there is no video footage of the Elantra in the neighborhood of 1122 King Rd when the murderer returns to Moscow between 9:12 am and 9:21 am but LE knows the murderer was nearby due to his cell phone pings.
  • 1:23:53 Josh asks Kevin whether an adult dancer actually gave the murderer a private lap dance back in PA between 2018 and 2019, as discussed in Supp 160 of the Moscow Police Department records. Kevin says LE doesn’t believe the lap dance recipient was the murderer. This is an example of the many tips that led nowhere. LE dealt with a “mountain of non-evidence” during their investigation of the murders.

I wonder if any of the parents will be a guest speaker, or speakers, at Crime Con this year. Last year, Ethan's mother was a surprise guest speaker at Crime Con. And Dr. Katherine Ramsland was a scheduled speaker at the conference. Crime Con did not announce the surprise guest speaker in advance of 'the event last year. No one knew in advance that Ethan's mother would be there and be one of the speakers.

Yes, Ethan's mom will be there again this year....with Othram:

The powerhouse of Othram is solving cases on a daily, if not hourly, basis, including the horrific 2022 murders of four college students in Idaho. Joining Othram's Chief Development officer Kristen Mittelman is Stacy Chapin, in her first public appearance since the sentencing of the man who murdered her son Ethan and his three friends.

In one of the most emotional sessions of the weekend, Kristen and Stacy will recount how they met at CrimeCon 2023 in Orlando—and how a promise made that day was kept. Together, they’ll reveal how Othram assisted in the investigation, and how Stacy is now using her voice to advocate for broader access to this technology for all families.

Are you saying he put WA plates on his car?

I had thought he was driving a car with PA plates when he was pulled over by the campus cop and also twice on his way back to PA.

Is that not the case?

about the dog not barking
Actually, barking is mentioned by both the neighbour and the roommates
(the question is, at what part of the attack did it begin):

__ told me the following: He woke up a couple of times Saturday night. He looked at the clock, saw it was 04:17 hours, and said after about 5 minutes of waking up he heard a dog barking, outside, from the direction of 1122 King Rd. __ said he was going in and out of sleep and after an hour, around 05:00 hours, he still heard the dog barking otside from the direction of 1122 King Rd. __ said his bedroom is on the far north east side of ___ Walenta and is closest to the backyard of 1122 King Rd. __ said there is a motion light outside of his window and said if it turned on he would have noticed it. __ told me he has lived in this residence since January and has not heard the dog barking outside before in the middle of the night.
Source: supplement 14.

D said she woke up at around 04:00 hours on 11/13/2022 [---] and could hear Murphy barking.
[---]
D said she hear Murphy barking a lot around 04:00 hours 11/13/2022 when Kaylee went upstairs. D said she heard Murphy go outside barking as well.

Source: supplement 42.

At around 04:00 or 04:20 hours, B heard what she thought was a firework and saw a spark on the ground from under her door. B then heard Murphy barking.
Source: supplement 89

B told me prior to hearing the firecracker she thought she heard Murphy bark, she also heard what she thought was the beer pong table moving and cups falling. The beer pong table was located in the living room which is above B bedroom.
Source: supplement 90

B stated Murphy would primarily sleep in Kaylee's room and if Kaylee was not home he would be left in the room.
Source: supplement 90

So Murphy did bark at some point. And was probably sleeping in Kaylees room and totally used to all kinds of people walking up and down the stairs. Until something alerted him. (I had forgotten he is half-poodle and that broke my heart, these are super gentle and super loyal dogs).

And what was the flash, the fireworks? I had an idea that maybe if BK was surprised by Xana when coming downstairs, could he have accidentally dropped something like a flashlight as he charged after her for an attack? Or where was Xana's phone (a danger to BK) durirng the initial confrontation? But then I realized it was the wrong floor, the floor BK never entered? Did Xana turn on the light for a second? Or did B imagine this light, as her brain tried to make sense of the noise and she just opened her eyes?

Also. WHY did BK leave his home and drive towards the house at the moment he did? If KG was indeed the main target, how did BK know that she was at 1122 at all?

at approximately 2:53 a.m. on November 13th, a white sedan, which is consistent with the description of the White Elantra known as Suspect Vehicle 1, was observed traveling southeast on Nevada Street in Pullman, WA towards SR 270. SR 270 connects Pullman, Washington to Moscow, Idaho. (supplement 136 - he is already on his way with all the gear)
B said at approximately 02:00 hours on 11/13/2022, Madison and Kaylee came home from a night out. (supplement 3)
D said she believed Maddie and Kaylee arrived home at around 01:30 or 02:00 hours on 11/13/2022. (supplement 42)
G stated at 01:45 hours on 11-13-22 he was contacted by Kaylee again and asked if he could pick her and some friends up at the Grub Truck. G arrived at the Grub Truck at around 01:49 hours. G took Kaylee and Maddie home, he stated it was a 3 to 4 minute drive from the Grub Truck to 1122 King Road.
[---] G texted Kaylee he was there and she stated they would be there in a second and said they were at order 75 and theirs was 78. Kaylee and Maddie came to the vehicle a short time later. (supplement 113)

So Kaylee and Maddie arrive home at approximately 2:00 - 2:15.
BK leaves towards 1122 at approximately half an hour later.

I wonder what his father thought when he packed up all his clothes and most belongings for what should have been a 2-3 week Christmas break. My kid is in college, though not a PhD student, but I’d be alarmed if he brought everything home and I expected him to have to take it all back shortly.

As a massive dog lover 😍 im seeing conflicting info on Murphy's whereabouts when LE enters the house....was he found on the bed, as one report goes, or I've seen pics of Murphy huddled under a desk tucked behind a computer chair 😢 ...hope the AI picture freaks stay out this, and glad to hear Murphhhh is in good hands moving forward
