Nurmi was arguing it is possible Travis had child on his computer -> If he did, Jodi wasn't lying ->but mean Martinez called her a liar during the previous trial -> That's part of the reason the previous jury convicted her -> therefore her conviction should be overturned.
Anyway there's no child on the computer, so Nurmi failed to edify Jodi/de-edify Martinez once again.

BBM - This would hold about a drop of water, if this was the only issue she lied about during her interminable time on the stand in the guilt phase. However, since she lied about pretty much everything, the prosecutor calling her a liar is apt. :moo:

The real beauty of this game, is DeMarte HAS matured since phase one. Willmott has, if anything regressed. 'Tude never shook DeMarte the first time and it certainly won't this time.

No wonder they are trying so hard to keep her off the stand.

I never understand why they wouldn't want her on the stand. She's the one who diagnosed JA with BPD. I guess the potential negatives from having her testify outweigh the good.

Just read on Beth Karas' site about what will happen if JA does not get back on the stand.

• JSS would not have to strike her testimony because of the different rules in this penalty phase of the trial
• Juan Martinez would not be able to cross examine her, yet the jury will be allowed to consider her testibaloney
• Juan Martizez could still use her testimony from the first trial, possibly by playing clips of the FTR court video for the jury
• The defense could use video surrebuttal (I cannot imagine that would help them, but who knows!)

I just read the 13th Juror summary about trial day 23 and the June 1, 2008 date stood out to me. As I recall that is the date Jodi claimed to have cut her finger on the margarita glass at work. In regards to the computer searches & June 1, 2008 that is being discussed in court recently, I am confused. The 13th Juror implies that jurors will want to know who was on the computer on this day. Does anyone remember anything of significance with this June 1, 2008 date?

IIRC, per Sue's testimony June 1, 2008 was the day a site was accessed on the computer.

I was wondering why Juan was questioning Flores about who had access to Travis's computer on June 1. He asked if Jodi had access, and Flores stated that she did. Then the defense got back up and asked if Jodi was in Yreka on June 1. Why did Juan ask in the first place since he knew Jodi had been in Yreka? Is he going to bring some expert in rebuttal that is going to testify that Jodi had some way to put something on Travis's computer even when she was in Yreka? What day was he testifying about the person not being on the Internet but was moving files to "My Pictures?"

I honestly don't think KN has a leg to stand on when it comes to the witnesses not testifying. There are options out there legally so that they can testify. Just because he refuses to accept any of those options which are available wont be a matter for appeal imo.

In fact didn't KN say in the motion that the witnesses wont answer the DTs phone calls? If that is so, then he is just being a mind reader when he says they are too fearful to testify. If they don't want to talk to the DT then they very well could want no part of this case, period. Not because they are too afraid to testify but because they don't want to get up there and beg for JAs life to be spared now that they have seen the entire first trial and what the evidence exposed.

JSS knows KN can subpoena them and all he has to do is exercise it just like other defense lawyers do. If he doesn't then that is on him and not JSS. She and Juan both gave him several options to choose from.

I expect he might try to slow-walk it now to try to fight that. "Okay we're working on the first couple of subpoenas but it will take us a week or so to prepare them." Or maybe he just won't issue any subpoenas, figuring they can appeal it with this:
- "Ms Arias was unable to present a defense because no witnesses would agree to appear voluntarily, so you need to toss it...
- in the alternative she was unable to present a defense because her counsel refused to issue subpoenas for those people, so you have to toss it due to ineffective counsel."

I guess they can breathe easy, since, as we know, she doesn't kill spiders. She might bore them to death, though. Then again she might have another one of her totally "out of character" moments and hack them to pieces. Or pull their legs off one by one. "Out of character" for me is giving someone a dirty look that they can actually see (I do it behind people's backs almost constantly), eating candy for dinner, wearing something in public that I know has a stain on it (honestly sometimes I just really can't be bothered). You don't get to stab someone almost 30 times, nearly decapitate them, and shoot them in the head, then say you just don't know what came over you and you wish you'd handled the situation differently. Is this the "hindsight's 20/20" defense? (Like Jodi's eyesight?)

Back to the (hopefully venomous) spiders... I bet Jodi would freak them out so badly that they'd scream for a guard to come in and do the ol' squish-n-flush. I doubt anyone would complain.

It makes sense, as long as Juan gets to rebut it. He can destroy her while JW and KN are powerless to stop him from picking and choosing what to play back, because he can go anywhere on cross. By the time he is done, JA will be looking for a do-over because it couldn't be any worse.

Jodi told Det. Flores that on June 4th Travis and him watching photo's (?) on his laptop a the first of the paragraph, then she says it wouldn't work it just clicked in the last part. Jodi went into the windows /vista and how you put your photos in my pictures crap.


In reading the transcripts of Jodi's interrogation - have you noticed how many time Det. Flores sighs after she gets through rambling on?

Yes, we had sex a couple of times. Once was in his bed and once was again downstairs in his office. He was looking at some pictures that I had brought for him, but he has a virus on his computer, so when he clicked the Start menu on Windows XP or Windows 2000 or whatever, you have like My Pictures, My Music, My Computer. You can usually click on My Computer and then go into the disc drive and open that. He clicked the Windows and it come up and none of that My Pictures, My Music, none of that would come up, so he had some kind of virus he was dealing with. His screensaver was a bunch of little bugs eating up the screen. It was just weird, and he said that is from the virus, too. I said, “That’s a cute screensaver,” and he said, “Yeah, it’s my stupid virus.” For some reason, that was frustrating for both of us, because we couldn’t look at the pictures, and they were from a lot of our church history trips which are on my other external drive which I haven’t been able to access for a long time, since after Christmas, because it just quit, and I just haven’t had the money to spend to get all that stuff back.

I actually identify with this though, when she talks it seems to me the real "I'm not sorry, he deserved it" comes through with allllll her explanations and rationalizations

Along with a wopping, whiny dose of "You can't blame me for murdering him when he was the reason I was so upset! Why are you punishing me for his bad behavior?"

There's this guy I knew who once said to me, with great sincerity and self-righteousness, and sounding very much like the aggrieved party, "You can't blame me for yelling at you when you're the reason I'm angry!"

Um, yes, actually, I can. That was one of our very last conversations. And not because I killed him. I guess you could say I took the easy way out and just ended the relationship. Far less complicated than murder; no muss, no fuss, no gas cans.

That seems absurd when they are using her diagnosis in this part of the trial.
