Retrial for Sentencing of Jodi Arias - 1/9-1/12 Break - Part 2

Her cell is certainly larger than the typical corporate cube (aka "veal fattening pen") a lot of people are subjected to 8 to 10 hours a day, it's larger than the ones I've inhabited in the last 10 years. But no, I wouldn't trade her for her larger pen. Freedom is priceless.

I inhabit the same thing, with the exception of having a door on my cell, LOL. Yes, freedom is priceless.

I think if I were a juror, I would ask JS how often he cleans his computer. I would ask him if anti virus software is made to keep viruses off a computer or to take it off after it's already on there.

I think I would ask him if it's unusual to find 🤬🤬🤬🤬 links on a computer.

It's hard to know how far they got into the explanations but I think most people, even me, know that viruses can be caused just by opening an e-mail. I think I would ask if 🤬🤬🤬🤬 can be on a computer for innocent reasons, as in I may have a virus and not know it and if something happens to me I don't want someone thinking I'm a sexual deviant. What would be the PROPER steps to remove a 🤬🤬🤬🤬 site caused by a virus if anti virus software makes you look guilty.

Just some questions...

The reason for Juan to say that, in my opinion, is because he knows Jodi lied. He was there when her secret testimony was given. He knows and he is aware that everyone else will now know and she will be more of a laughingstock than she already is. It's her own fault. This woman doesn't know how to tell the truth.

Yes, that's her stock in trade.

"I couldn't keep my lies straight." ~ Jodi Ann Arias

Including lying about pedophilia.

Here's the especially cruel murderess admitting that she's the one who liked to look like a "horny little schoolgirl":

If Perryville is so much better than Estrella, why is Jodi fighting so hard to delay getting there then???
I do agree with you that she ought to be in prison in Peru. The conditions are alot worse.

I don't think it's going there so much as she's trying to avoid the DP as opposed to the more liberal LWP that she's hoping for. In the back of her mind I think her and her supporters are still thinking a pardon is possible...

Do I have this right?

Hearing at 9:30 and jury at 10:00?

Anyone remember? TIA

Don't know. The Maricopa County court website is down.

"Down for System Maintenance

This website is down for system maintenance until 9:30 PM.

Please try again later."

Many times I have waited patiently, sometimes for weeks, for the testimony to begin again, only to be disappointed again. I was sure each time that the trial would start again and I was wrong.
That is why I do not feel in the least bit bad about posting my prediction for tomorrow.

Tomorrow will start with the Judge giving her decision. Nurmi will not be happy when it goes against him. He will have motions ready to go. Withdraw as council, again? Request mistrial, again? Ask for another stay while he appeals to a higher court, again? I feel fairly sure that he will then stomp his feet, again! He will say that his client cannot continue testimony and that all other pseudo witnesses cannot testify unless she can in secret and in fact, cannot testify with cameras or real names and other such nonsense.

He will motion to have all the secret testimony stricken from the record since it was not completed and cannot be completed.

In short (I know, too late for that), he is coming to court with a trunk full of shoes; wooden shoes, tennis shoes, spike heels, loafers, wing tips and the lot. Only the best brands that the taxpayers can pay for of course.

If all else fails, there will be no witness there to testify tomorrow and we will wait until Wednesday until the Data Scientist comes to testi-lie again. And for the record, I do not believe he will show then or perhaps JA will have a migraine or a mental breakdown or someone's uncle's cousin's brother-in-law's favorite x-mother-in-law may have died and they need to attend the funeral for another month or so.

Anyway, like all the times before, I will be logged in hoping to see this all inch a little further towards the end. That's my story and I am sticking to it!

If anyone is interested about conditions in Perryville order Slumber Party From Hell available on Kindle or paperback on Amazon.
Written by a lady who did six years in Estrella and Perryville (while battling breast cancer) it's a good read.
She's an older lady, convicted of a white collar crime. She was in one of the minimum security units but still the conditions are harsh. She saw fights and deaths. She also worked and helped start programs for inmates.
She also considered Perryville a big step above Sheriff Joe's Estrella Jail

Remember when she managed to tell the first jury that Travis's closet was larger than her cell.

What's the hearing about and what witness is up tomorrow?

The hearing is about prosecutorial misconduct and taking the death penalty off the table.

No one knows who the witness will be yet. But Nurmi said he'd have someone. We'll see.

Question: Is it normal for a judge to take a motion under advisement?

If so, JSS has done this twice as of late. Why can't she just make a decision on the bench? Is she not briefed on the motion before her?

Yes I do, and only someone like her would say that... she is evil with a capital E. Travis was correct when he said she only cared about herself. He was also correct when he jokingly called her a 🤬🤬🤬🤬🤬.

I believe it is quite normal for a Judge to do that. Do I think she overdoes it? YES. She appears to be somewhat weak in that area. IMO.

Does it read similar to this account?

I am curious, for example when john sue smith testified how many pages there would be if transcribed? Is 400 pages average?

400 pages would be normal if she testified for a whole day.

Taking motions under advisement is very normal and IMO is a good strategy on major issues because it avoids giving the impression that you're making "snap" decisions without really considering the arguments on the other side.

So many excuses reasons for JSS to have allowed JA to testify in secret, for the transcripts to be held for weeks despite the COA ruling and a reassuring opinion stated that (now that two higher courts have ruled or issued a stay against her) JSS won't do this again.

Yet, as we speak, we have a witness testifying as an expert anonymously, no camera allowed, and without credentials that normally qualify one as an expert.

This witness was the subject of several attempts by the state to interview which the court left unaddressed. The mention of prosecutorial misconduct was allowed to be mentioned in front of the jury via this expert, yet while mention by the state of any questionable conduct by these defense experts on the work drives wasn't precluded, the judge did tell the defense she'd rule on objections on a case by case basis. Anyone think JM is free to question this witness completely as to his background or his actual work in this case?

Respectfully Snipped and BBM:

Just jumping off you post here with a ? for AZLawyer :) TIA !

- Can the State file a Motion with the Court to have this witness reveal his true identity -- real name and any "nicknames" -- and true credentials ?

JMO but it is outrageous that this so-called expert is allowed to hide this info ... obviously, he has something to hide, IMO.

I have a feeling some of the 14 or 11 witnesses are people in Jodi's family, anyone else think so?

We now know Marc McGee is one, Daryl Brewer probably another. He was chomping at the bit to testify in the last, nonexistent mitigation phase so there are two witnesses.

Aunt Sue?

Sandy can't be one- or can she? How does that work... it's not the same rules as trial testimony, so she could, couldn't she?

Does anyone think that Matt McCarthy would be one... especially since he was apparently the one calling Sandy to tell her that her daughter needed to be institutionalized (or some such thing). Another is supposedly a friend/fellow coworker of JAA- right? Who else?

Fonseca- done.

Geffner coming back the 20th?

John Smith- Wednesday.

Who else?

(ETA People on the DT "wish" list- not necessarily wether or not they want to or are willing to testify for JAA)

Obviously they wanted Alyce to come back to testify- do you think she is one of the 14/11 they are claiming won't do it?

They are probably counting Jodi's nutty friend who backed out last time too- no?
