If this evidence was so clearly prosecutorial misconduct why would he be asking for an alternative to just dismiss the intent to seek the DP? That would still land her LWOP. LWOP in a case of clear prosecutorial misconduct? Doesn't make sense. I suspect the evidence isn't as strong as they want it to seem.

I thought the exact same thing steve. If they were so confident in this they wouldn't present an alternative. This would be grounds for getting the charges dismissed, no doubt about it. If he felt that good about it they would leave it there.

Also, Nurmi has been known to want things made public when they benefit him. This little snippet benefits him, tremendously. Wanna bet he keeps the actual motion and hearing under seal?

Thanks for the warm welcome. I had been considering writing somewhere on a sidebar, as the 10th anniversary approaches, and the DP seems to be soon (he is at the last of appeals, and it is in Texas...) I just hope that soon, this will be done for the family. The waiting is worse than water boarding, and these DT tactics are beyond belief.

The dates of the alleged access of porn websites listed here are suspicious. They are all 5/28 and after. 5/28 was after Jodi made the decision to murder Travis. And, again, she was messing with his computer that day. So Travis just decided to start wathving porn on May 28th? Something stinks.

So the question is:

Did LE purposefully alter evidence? I think it's highly unlikely but we'll see what happens and what Juan's rebuttal to this is.

From an AZ Superior Court's ruling on a motion to dismiss because of prosecutorial and police misconduct:

"The State's misconduct must have so infected the (entire trial process) as to deny the defendant due process..."

Even if it happened (not) and can be proven (not), no way does it represent a denial of JACK's due process rights. The only thing infecting her trial was the filth coming out of her own mouth and that of her DT.

Absolutely, it's a stall tactic, IMO. Nurmi's been fussing over the computer for forever. This is an orchestrated leak which fits with stalling and tainting victim and PT in increments. The onslaught is like a thousand tiny little pricks. That's not 'aiming for the fence'- like usual it's throwing it out there and seeing what sticks. The DT really is no better than their client, morally and ethically speaking.

OK, a little thought I have been thinking, why not just put all said inmates in all states on all LWOP/DP cases on an island with just food and water and let them have at it.... It would be the best solution for all concerned, and they can see who is the strongest to survive.... and of course, they can never leave the island alive.... JMO....I know, never happen, but what IF...

LOL! No, please no. They would breed nonstop (you are talking about female & male inmates, aren't you?), and the population on the island would explode. Then their manipulative and con artist mindset would somehow find a way to escape the island, and they would take over the world. Then...................
