That sex phonecall recording was much longer than 3 min. (She may have recorded this onto a mini digital recorder and then uploaded it to the phone somehow.) She said in a journal entry that she had a recording on her lost/stolen phone that was later found in the aunt's car 2 years later, which she hadn't figured out how to replay for Travis. Wasn't the helio phone the one loaned to her from Gus Searcy? In that same journal entry she said her new phone arrived - was that a new one or the one from Gus?

Wonder if there was ever a digital voice recorder ever found - or did that also belong to Gus? Who knows . . . maybe it belonged to his secret passenger whom he refused to identify.

Is the clerk's office closed for 2 weeks over the holidays? What is stopping local news reporters from demanding copies of the transcripts of the secret witness testimony? Do we have to wait until JSS publically announces she has released them? (or could they be released but no one asked for them?)

Maybe someone on WS who is following a reporter or two on Twitter could tweet them and ask if they would go request a copy of the unsealed transcript. Since the CoA has ordered this unsealed, and since AZlawyer believes it could be available for the asking, why not put a bug in some reporter's ear? If nothing else, we might find out if anyone in the media has requested and been denied this. I don't see how it could legally be denied if requested, so my guess is no one has requested it.

They are requesting it. I know that both Beth Karas and William Pitt have mentioned that they continue to ask for the transcript and are not being given it. The first thing the media attorneys did once the CoA opinion was issued was file a motion to get the court to unseal that transcript right away. Why is it not available? I have no idea!!!

I`m trying very hard not to be in a state of blame right now, but if it weren't for Travis borrowing all of my money, I`d be in San Diego tonight. I spent $40 on two super Saturday tickets to see Jeff Olson (ph) and visit with my friends that I miss very much, but I've been squeezed dry and then some because of him.

I drained my checking account to put money into his and then was hit with tons of fees, fees that he isn't going to pay, $96 worth. And he has the nerve to tell me to balance my checkbook. Nay, he didn`t just tell me that, he screamed it at me, and then proceeded to say that he wants to get a gun and put it to his head and pull the trigger.

I was crying because it distresses me to see him like that and because I know all too well and first-hand what it is like to be where he is1. So it was with great compassion that I calmly, sweetly, to my best ability, soothingly told him that everything was going to be all right, that, like always, this, too, shall pass, that I promise everything will be worth it in the end.

I wanted to soothe away his worries. He was under more stress than I had ever seen him. He was really despairing today. I lended him another $80. I went to the bank for him to deposit it into his account since he said he doesn't want to step foot in that bank again today. By the time we had parted, things seemed a little better.

True, I could just marry Travis, but as wonderful a guy as he is, I just don`t think we are quite right for each other. I'm a little too sensitive. Although I prefer to think of it as Christ-like. And he is a little too rough around the edges although it is nearly impossible to imagine my life without him right now, he is amazing and he can cheer me up in a snap by singing me songs and holding me close. I like it when we cuddle. That`s the very best. On my bad days he brings me up, but I fear I rely on him too much for that sometimes. He is way too stressed in his own issues. He invariably suggests that we both distress by, well, being naughty. And although it is a temporary relief I think it is causing more problems. Besides, if it is something that I can`t tell my bishop then I probably shouldn't be doing it.

Well, today was interesting to say the least. Highs and lows. Travis was obscenely mean to me, but then he was extremely sweet and apologetic. It`s easy to forgive him when I remember who he is, who I am, and who we all really are, which is divine offspring, children of God.

He`s so hard to say no to. We totally made out afterward. But he was so sweet and kind and attentive the entire rest of the night. It was a long drive back from Las Vegas. Travis was being extremely impatient, but eventually he got over it. So I raced home, freshened up, and headed over there with tootsy pops. He makes me want to be so naughty. And naughty we were. We went all the way again. It was different this time. He was different. He was tender and sweet and loving. He said he had been planning and hoping for this. He said he wanted to savor the moment and make it last as long as possible. He asked me if I felt guilty and I said yes. Then he told me he wanted this because he wanted us to always have something special. Perhaps it was like closure for both of us.


So we know the day the tootsie pops were involved and that they went all the way for the second time. IIRC Jodi tells Travis in the sex phone call that he made her feel like a Goddess the day he had rose petals and candles down the hall to his bathroom and around the tub. I think that is the "first" all the way sex. Jodi said that is didn't count according to Travis because it was underwater.

Wouldn't you be talking about sex acts more recent than four months ago? Jodi always seems to be in control and a saint while Travis is an short tempered and mean to her.

If you can read all of this on day it is so laughable. Nobody pats them self on the back as much as Jodi and her kind words of wisdom and gentle ways.

I do not understand why any motion has to be filed to unseal the transcript. The CoA ordered it unsealed! How is a lower court able to get away with noncompliance with a higher court order?

And why is that lower court now scheduling oral arguments on the issue? As if both sides should get to have their say: one side will argue for it being released and the other side for keeping it sealed. Neither argument is necessary, IMO, since the court of appeals has already said it must be unsealed.

What is going on out there that courts can just make up their own rules?

I sure would love to see her bank account? This lending and depositing would be making sense. I am sure JM has it.

May 22 is a few days before the texts from May 25/26 texts. Maybe she "found" the phone and tried to blackmail him with it, which is the reason he was angry at her.

I hope JM catches that. He may bring this up with the good Dr. Spill Water with his side show Dr. Giggles

Jodi obviously has been making HER OWN rules, and they seem to be working for her. She should have been in Perryville last year.

Years from now, no one will look at this case and think "Poor Jodi. Wow that girl might have gotten screwed over." I think it's a sure bet the Innocence Project won't touch Jodi with a ten foot pole. She will be a chapter in college psych texts or law books in advising your clients to plead insanity. She will be an example on warning signs in your children's bad relationships. She won't be a stunning beauty, nor a brainy vixen. Just a mentally ill woman who murdered a young man in his prime. And no one will be asking how is Jodi. It will be how did we not see Jodi, how can we prevent Jodi, how could we have stopped Jodi. How could we have helped Travis. Travis will live forever in a sense. He will be young and handsome. But Jodi Arias will be a footnote, fading in a prison cell. The challenge now is to remember Travis Alexander once he gets justice and pray, hope the world forgets Jodi Arias. Hope that she becomes just a lesson to learn.

True--but only because the court is letting the killer make her own rules. The fact that this ever happened is almost unbelievable but it continuing even after a higher court said don't do it is just...IDK what to think anymore. If this is appealed to the SC and the SC also rules the transcipt must be unsealed, what then? Will this court still fail to comply? Why are there no sanctions for refusal to comply with a court order? It is as if those orders are meaningless. Most likely JSS believes this trial will be done and the verdict in the can by the time SC orders documents unsealed, but in the meantime I do not understand how a court gets away with noncompliance with a higher court's order.

However, she should not be allowed to use insanity as a defense. She waited too long, crying self defense and pedophilia.

As we thought, the recording was deliberate...and with purpose, IMO. Was it ever explained in Court as to how it was accomplished? If it's used as "evidence", you would think that it should have been explained by the evil one herself, no? Just hearing how she went to the trouble of doing this would have highlighted her wicked intentions, IMO. If it had been zeroed in on during trial, JM could have used the trial testimony to eradicate any doubt about the ruthlessness of the defendant during the retrial.

No, Jodi is not mentally ill. At best she is a sociopath...at worst a psychopath. I would love for JM to put up his own little chart and tick off all the characteristics she has for either/or, but I doubt he would fearing the jurors may misinterpret the traits as a form of "mental illness".

Obviously a person who goes around stabbing people and then blaming the victim is not playing with a full deck but I am concerned with people like this being seen as mentally ill. Some of them are, but not all, and they should not all be lumped together, IMO.

In Arias' case, her DT would love the jurors to think she is mentally ill--that a person would have to be so in order to do what she has done. Why? Because we do not execute the mentally ill.

Another misconception is that the mentally ill are insane. They are not necessarily. If I may split hairs here--insanity is not even a medical term, it is a legal term. Insanity is used in courts of law to determine whether a person is competent to stand trial but more importantly knows the difference between right and wrong (or knew at the time they committed their crime).

Arias is eligible to spend her life in prison. She is also eligible for the death penalty. She is eligible for these sentences because she is not mentally ill and she did not qualify for an insanity plea because she is not insane now and was not insane when she premeditated and then carried out a heinous murder.

I believe Arias to be mentally disordered, which is not the same as mentally ill. Many people in society have mental disorders. Most function reasonably well and within society's laws and do not harm other people. Sometimes a mentally disordered person will harm others but often the deed has nothing at all to do with their disorder. There are all sorts of reasons for this occurring but everyone wanting to blame a disorder is not the way to go because it does not hold people accountable for their actions and it tends to label others who suffer from that disorder as potentially dangerous when in reality most of them are not.

Arias is evil. She may also be mentally disordered. But that is a very broad term and one that in a number of specified sets of circumstances could be applied to a large number of citizens.

IMO.

Here's the user manual for the Helio Ocean phone, on page 34 (left side) under Basic Operation: During A Call is Recording, it says you can record up to 3 minutes:

Under USB Connection (page 30 left side) it talks about saving music and video files to the phone, I suppose if she recorded the call on something else she could upload it to her phone and maybe escape the 3 minute recording limit on calls.

I never believed that call was all made on 5/10/08 because we have a text with the same date (plus or minus a couple hours) where Travis tells her she can get "Steve" to tie her to a tree, and in the phone call they're discussing that as a fantasy they'd like to come true. No way those two things happened within hours of each other.



In the January 24th entry Jodi starts off about how broke she is at the first of the entry and then the middle and If I can't tell my bishop, I shouldn't be doing it, then to their coming back from Las Vegas Travis being an jerk and then having a hot and heavy make out session (how juvenile) and her rushing home to freshen up and grab those tootsie pops to go back to Travis's and they went all the way. That's a whole lot for one day isn't it?

I think Jodi had help from Gus. He's into all that. He didn't like Travis and he wanted Jodi. He gave Jodi the Helio phone because she'd dunked her other one in hot chocolate.

Jodi left in April. I wonder when Sandy came to take her back? If it was the April 10th could of been Travis's remarking about ruining everything of his, was the BMW.

May 10 Sat Jodi's Blog Jodi posts "Journal Entry" - and on May 10 Sat Text (T to J) "Why don't you have him come and f*** you in the woods, I can only imagine you are so worried about me reading. You are paranoid because you have no respect for people privacy and you dare insult me of all people. Someone you should through your actions you hate more than love by denying me a human right of privacy countless times. You have a lot of freaking nerve. We are all not like you in that aspect". This had to later in the day/morning of sex phone call. There is talk about the tied to a tree that is referenced the at phone call.



on May 22 she's going on and on (me thinks she doth complain too much) about the stolen Helio and she hopes it won't be found, - Travis stressing out about why she wouldn't tell him what she had planned on the 24th if he came up there, which he didn't, and then the emails and texts on the 26. Travis found her on his Facebook, that told her that she'd been caught.

I meant that in the future she will be a part of debates, doubts, and theories of her being mentally ill because if one does the things she did....they can't be playing with a full deck, right? Obviously that wasn't the first defense they went with, so highly bothers her. It's also a recurring theme in the communication between her and her boyfriends. "So and so called me crazy. Why?" Because you did x, y, and z.

I'm sure that many of Arias' journal entries were fabricated post-murder. And the ones before were written in order to manipulate Travis---she made sure that Travis 'accidentally' read them. The thing with Arias is that she is always playing a part for an audience. Even when left to herself she is like an actress on the stage. Even if she were to write something and burn it right then and there it would be full of lies. She can go from writing in a Biblical style to New-Age to Colloquial in two minutes flat depending on her intended targets and ever-fluctuating moods. There is not an authentic bone in her body. As jane the dood said in a previous post Juan should tell the jury that Arias' journals, letters and direct testimony are mere fiction...they are as much use as a chocolate teapot.

I so totally agree (is that ISTA?) ... "chocolate teapot" :happydance:
