IIRC, the jury has to be unanimous on the DP. If not, JSS sentences her to LWP or LWOP. IMO, JSS will sentence her to LWOP. I truly don't believe the jury will come back with a unanimous verdict for the DP. IMO Fonseca successfully pointed out that TA was not the best of boyfriends and diminished CMJA. She did say He did not deserve to be murdered. After the questions from the jury yesterday, I truly don't see them coming back with the DP. JMV

While I don't agree that she was successful in either, the questions seem to point to that (and it's just not a good reason to kill, anyway) I do agree that I think it will be a hung jury and JSS WILL give her LWOP. There is zero doubt in my mind. Judges don't give chances of parole to murderers. They just don't.

And no, judge Stephens can't just ignore a death recognition if it's given.

yea, I think the main thing for something like that is they want formal signature of receipt of delivery. So that you can't ever say you never received it.

I received a subpoena once. I answered the door and the guy addressed me by name (though he did not know me). I acknowledged I was me and he handed me the papers and said, "You have been served." Then he turned and left. He never asked for formal identification or a signature.

ETA: Now, if FedEx had delivered it, he would have come halfway up the stairs, thrown the envelope against the door and hightailed it back to his van before I even got the door open. :laughing:

I can't believe all the money spent on this evil witch. I will bet the jury will be hung and she'll get her way. I think she truly believes she will get out one day. I can't believe what she did to Travis and she's still "murdering him" with her lies in court. She is worse than Charles Manson if you ask me. Manson was an evil mastermind who ordered killings. Jodi is an evil mastermind who didn't order them, she went ahead and did the killing herself and I truly believe she bought that gun after the murder to kill others but thankfully she never got the opportunity.

Sadly, I agree. I just hope she doesn't opt for LWP. She seem's like a softy to me. For all we know JSS might believe some of the defense's BS and feel that poor CKJA was abused by TA. I hope I'm wrong.

I've been subpoenaed (part of the job, sigh). I've never had to sign anything - the subpoena just got handed to me and "you've been served" so to speak. ;-)

I wonder why a juror question was something along of the lines of Dr. F not having all the information she needed to testify?
It seems as though at least one of the jurors believed in what she was saying, and not impressed by Juan; or is it because she could not directly answer Juan's questions... IDK, just seemed like an odd question.

I took that question as a positive for the prosecution. Sort of like saying "So the defense only gave what they wanted you to see?"

I missed it. Did Juan really drive home the fact that Dr. F said that she did NOT believe that TA was a pedo?

There was also something else that I was hoping he would get to and I don't remember what it was, so help me out....Was there anything that you wanted Juan to present to the Dr that he didn't?

I would agree, based on the juror questions that were presented to her, that she was successful in making her points to at least some of the jurors. I also agree that I don't see the jury agreeing on the DP; I wouldn't rule out this judge going with LWP, though. Stranger things have happened.

I know what you mean. Everytime someone says "Dr. F", all I can think of it the Mr F Jingle from my favorite show "Arrested Development", which is irritating because it really cutsie's up any reference to the Dr which annoys me. I can't stop the jingle from happening in my head ever time I read the reference to "Dr. F". If you are unfamiliar, here is the 2 second clip.

I like Monica, I really do. But I disagree with her. She says that if the witnesses "refuse" to comply with a subpoena, the defense motion will be stronger? No, if a witness refuses to comply with a subpoena you get a sheriff's deputy to go and pick up the witness. There is no "refusing."

Ooooooo boy, now I’m getting worried, if Gitana, and AZL are having second thoughts about this judge, then that’s not good :/ Is there any way this judge cannot accept what this jury decides, if they were to decide on the DP could this judge change it to LWOP?

I just can't anymore. I mean, what was her rationale for letting JA testify in secret? Did that make sense in her own mind? If so, then her mind and mine are very different and I am not qualified to speculate on the inner workings of her mind.

1) Overly cautious about issues on appeal, so bending over backwards for the defense.

2) Tunnel vision in this trial with respect to the law. ie. losing perspective about the precedents her rulings regarding the Constitution would have set.

3) Rationalizing (2) by believing the Constitution will be preserved by the release of all testimony post sentencing.

4) Accustomed to getting respect, but unpracticed at imposing it, combined with (1).

I've wondered the same thing, Rose. She can't blame Juan for the COA ruling, if I remember correctly Michael Kiefer called the attorney the day everyone was booted from the courtroom.

There has been a change in JSS from the previous trial and as a former prosecutor and (until now) a respected judge, I have to wonder why? I've also noted a change in her appearance, she looks very tired IMO. I hope it is simply the demands of her job and nothing more, such as a medical condition.

This trial is taking its toll on everyone involved, I'm looking forward to this jury sentencing CMJA and sending her off to prison so that all that have been involved in this fiasco of a trial can resume their lives and find peace knowing that justice has been served.

Something tells me that JSS is against the DP, at least in this case. Maybe she was hoping that the DP would be dropped, and is now PO'd that she's having to go through all this. After the first round, she as the rest of us, knew what a circus it was going to be.
Question for one of our attorneys, is this something that a judge could / would possibly discuss with the prosecutor's office, i.e., voicing their opinion to some degree and encouraging them to take the DP off the table ? TIA :)

I think she said something like she did not see her signature on it, so she did not know if she said it. Obviously she knew she was giving him a hard time. Wonder what the jury thinks of her stupidity.

Anyone so obviously obtuse and uncooperative has something to hide.

It does still sound like juror 3 was the older woman who took a lot of notes. "Book writer." For some reason, it's one of those things that was in my head and couldn't remember why but it was. That juror 3 was the note taking, older woman. Perhaps it is Beth Karas that is mistaken?

If that was true, then what's stopping her from complying with one of Nurmi 186 motions to have the death penalty dismissed? Why wouldn't she have done that a long time ago?

I just disagree. I think she thinks the death penalty is just is this case and she is doing her damnedest to make sure it sticks.
