To review Mr. Smith? WTH? Is she saying JM decided not to "review" Mr. Smith ? And so, tough luck? And what does Melendez testimony have to do with it?

That may be what she ruled but that doesn't answer my question really.

I'm talking about procedure. His testimony should have been allowed within the confines of the hearings. After his testimony, she should have ruled on the motions that made the hearings necessary. After that ruling, IMO then and only then should she have allowed him to testify before the jury. An attorney can correct me if I'm wrong. I'm basing my opinion on the many court cases I have watched and on common sense.

This is all kinds of upside-down bizarro world.

Let's hope--I mean even the blind can see this shell game of DT witness "availability" is orchestrated. You would think that JSS would have figured out that these DT witnesses seem to always be available when they are giving testimony for the Defense but never available for the prosecution to question them. I say JSS should, prior to these alleged experts getting on the stand, ensure their availability for cross examination. JMO

In our dreams. It would require a real judge, not this pod person. I think she exemplifies the Peter Principle at this point; once a case really challenges her, all her weaknesses come to the fore.
