But why? How does this affect mitigation? I could understand if we were still in the first phase of this trial, but how does allowing this now remedy anything? And what even needs "remedying"?

Because there was testimony there were no or viruses on computer and nothing to rebut that, now that we know there was some. This is the judge's remedy as opposed to scrapping the whole thing. Hope's explanation makes sense. If she was going to take it off the table why would she wait to hear testimony that she has already heard before ruling? It makes sense that she's allowing the defense to rebut these things to a jury like they would have in the first trial before rejecting the motions.

I am lost on how any of this is related to the mitigating factors.

We have established that she is guilty in the last trial. This seems to be a retrial of the parts they did not like from the last trial rather then focusing on the mitigating factors. Also, to have a mitigation specialist that can not get any mitigation witnesses seems to be ineffective council to me. If said mitigation specialist can not get anyone to testify why is she even there still?

I am so lost on how we have gotten to where we are now and feel pain in my heart for Travis’s family as they watch this circus continue rather than coming to a close. All my observations and opinions.

I am at a loss too Weebles and I have seen/read about numerous death penalty trials including the sentencing phase.

I am feeling such sadness in my heart for Juan and the Alexander family. This trial has become torturous for so many and it has to be unimaginable pain for them.

I have never understood why the was an issue in the sentencing phase. Arias did not coldly murder Travis because he may have watched , which I am not even sure he did. Even she testi-lied that the photos she saw were actual physical photos. She did not testify to seeing them on his computer. So this about the computer and does not go against what she testified to since she never testified there was kiddie on Travis' computer to begin with. So I don't know how KN can say with a straight face that this helps JA when she never testified to seeing them on the computer.

And to know Juan was allowed to be called a pervert in court has to be so humiliating and infuriating for him. He has to be beyond sick of this underhanded DT, weird experts, and JA. It is like he is caught up in a nightmare that will never end.

It has been the worst case ever to keep up with and I still say JSS is one of the main contributing factors as to why this trial phase has turned into a three ring circus.

Poor Travis........he has been forgotten but I pray that the jury really knows who the real victim is here and it sure isn't the convicted murderer.

I think this trial will go down in infamy as one of the worst tried trials in history.

I have a question. All these things that are coming up, prosecutorial misconduct, evidence tampering, witnesses changing testimony etc...IF she gets the DP and WHEN she appeals, will some of her appeals be automatically denied because of the latitude the judge offered in this case? Because to me, they are re-trying this case and of course changing their whole strategy...self defense vs. mentally ill. I mean they have thrown everything out there IMO already so would the appeals courts just deny based on any of this? I hope I am making some sense. This trial sure isn't.

But wasn't that in front of another jury? I don't actually remember, but I think it was before the first jury. They could have just started with " found" if this jury didn't hear Melendez previous testimony.

And if she wanted the in, why not reject the motions but then say "the comes in"?
Why the testimony before the ruling?
