Now Judge Stephens says she will further hold off on dismissing DP until defense computer expert "John Smith" finished his testimony as well

Just be glad that you don't have to hear JW high pitched voice.
Also I would like to see that stun belt in action. If the Judge has a decision I would like to hear it.

Judge just said that she has NOT ruled on the motion to dismiss. She will take into account Flores's testimony before ruling. The defense now asks the judge to consider also the rest of John Smith's testimony which will conclude Wednesday. JM objects that anything JS will say on Wednesday will be rebuttal--direct will not be opened.

Lambchop had better have some warning notes about not trashing the judge lined, because I think a bunch of them are getting ready to fly!!

I am lost on how any of this is related to the mitigating factors.

We have established that she is guilty in the last trial. This seems to be a retrial of the parts they did not like from the last trial rather then focusing on the mitigating factors. Also, to have a mitigation specialist that can not get any mitigation witnesses seems to be ineffective council to me. If said mitigation specialist can not get anyone to testify why is she even there still?

I am so lost on how we have gotten to where we are now and feel pain in my heart for Travis’s family as they watch this circus continue rather than coming to a close. All my observations and opinions.

It does not. This judge has lost control and the DT is attempting to run this trial off a cliff. moo

well let's look at the bright side shall we? Maybe if she holds off on ruling on this DP motion, it will keep Nurmi from being able to file another one until he has her ruling on this one. Maybe?

Juan is absolutely right. Redirect is supposed to be limited to the scope of cross, and Juan's cross was very brief.

So Beth Karas was wrong?

Beth never said definitively that it was denied. Beth was late and had computer issues. She specifically says that since a witness is up, must have been denied. Was a guess on her part. Not fact
