Because there was testimony there were no or viruses on computer and nothing to rebut that, now that we know there was some. This is the judge's remedy as opposed to scrapping the whole thing. Hope's explanation makes sense. If she was going to take it off the table why would she wait to hear testimony that she has already heard before ruling? It makes sense that she's allowing the defense to rebut these things to a jury like they would have in the first trial before rejecting the motions.

I suspect it's a matter of finding images on his computer vs finding links on his computer.

Initially it seems they were looking for pictures and no one has ever found any. Sue claims to have found one link, which could have an innocent explanation if he ever gets cross-examined.

But wasn't that in front of another jury? I don't actually remember, but I think it was before the first jury. They could have just started with " found" if this jury didn't hear Melendez previous testimony.

And if she wanted the in, why not reject the motions but then say "the comes in"?

It was before the first jury, precisely. And the defense has never gotten a chance to rebut it until now so she judge is being fair and letting them do it now.

For sure it's all semantics and Juan hasn't made that super clear yet. But it sounds like Flores kind of started to just now by saying there was no on actual computer. Hopefully Juan is on the same page.

Yeah sounds like. She's letting all the pertinent testimony in before ruling. It actually makes sense.

Respectively, it doesn't make any sense to me because the whole premise of the issue (any form of prosecurial misconduct) is really an appeal against the original verdict and I wish it would have been classified as such a long time ago. IMO, we are way out in left field with all of this nonsense.
