Retrial for Sentencing of Jodi Arias - Day 5

I asked Jen her honest opinion of how the day for the state went yesterday. Her response:

@TrialDiariesJ: @MeeBee23 No. We all thought it was good day. That sex tape didn't help defense. We'll see how they present their case
 
Just catching up this morning. Something that might help those who feel a little 'deflated' after yesterday. Remember, we are just barely into this phase. JM has at least a couple months (probably more) left to make sure the jury understands what the real facts surrounding this murder were. He will give the jury a clear picture, both of JA and of her crime. And just as they showed the last jury the defense will, in spite of their efforts, only be able to tell the unsubstantiated tales of a self professed liar whose need to destroy her victim is as alive today as it was in 2008. I believe that.

That said, I also believe that convincing a jury to sentence a female with no priors to DP is a tough sell. Whether that happens or not, I do think JM will make sure they have the information they need to consider.

My expert source last night (the prosecutor who successfully won two DP convictions/sentences for the men who killed my sister who worked along side Martinez for years ;) ) simply said when I asked why his presentation was so short, and I quote:

"Oh he's saving it all for the rebuttal" with a knowing nod. She wasn't surprised at all.
 
I only read RBMD's but I'm not sure I follow her logic in saying death is off the table. How can it be? They haven't even begun mitigation? They were just getting caught up? I just don't get it.

I think on read on WS that the judge prob won't take the DP off the table, because that is what the Alexanders are pushing for. Could that be possible? sorry no link.

I don't think they will take Death off the table because they don't have to. They don't need to bargain anything at this stage.

Only one who can take it off table is Juan. The judge could if she finds the defense motions have merit...but who are we kidding? I was responding to the blog posted in which the writer already thinks it's all over and Jodi will not get the death penalty now because of the day of questioning yesterday. I think that's just slightly premature and quite the overreaction. The defense hasn't even presented yet and as KCL just pointed out, Juan still has so much ground to cover.

They are predicting this case will go on for months (sigh) and that's all because it will be drug on in mitigation phase. I'm not sure I can stomach it and am glad I'll be out of the country for much of that. It's gonna be Heinous upon Heinous with a side of Your Heinous this time...worse than before. Nurmi didn't get that makeover to dull himself down. Blech.
 
I don't understand how JA can file an appeal saying she didn't get a fair trial because of publicity :confused: The publicity came from her. I had never even heard of her until I watched her on 48 hours Mystery. Then again on Inside Edition LONG before this trial even started. Not to mention all her interviews post verdict. :gaah:

She has drug this trial on and on for one reason only. This is the first time in her pathetic life that she's EVER had friends/supporters or money! Before this trial, she was an absolute nobody. A waitress going from job to job and man to man. Changing religions like a chameleon to accommodate her man of the month. No one even looked at her art!

My biggest fear is if she gets LWOP (which, I unfortunately believe she will) she will be able to continue her art, and still have supporters. She's acclimated very well in jail. I fear prison will be the same for her.

I want to DP MAINLY because she will be isolated in her cell for 23 hours a day. I don't care how long they wait to actually give her death. The longer the better! She will go stir crazy with no one to manipulate!

I agree (except I think there is a better chance this time that she will get the DP). The prosecutor is only getting started and since the defense is changing their strategy from the last trial, he is letting them put all their cards out there so that he can tailor his rebuttal case to that. The rebuttal case is when the prosecutor is going to come out guns blazing and when the Juan we are all used to will re-appear. I think perhaps (and this is just pure speculation) the prosecutor understands that his style may come off as aggressive and abrasive to some people on the jury (not me though) and he's saving the aggressiveness for when he is dealing with defense witnesses who will no doubt try to foist their BS upon the court.

One last thought. If we the general public had such a visceral reaction to Nurmi's questioning yesterday via only reading tweets, I can imagine there are a number of jurors who feel exactly the same way. :moo:

I thought Nurmi made a big mistake yesterday by putting JA nude picture up during the sex tape. He didn't need to do that, he kept it up way to long and this only made her look like a cheap 🤬🤬🤬🤬🤬. He was the one yesterday abusing JA. Also, since JA reported the tape stolen and it was "found" only goes to show her lies again. I don't think it really made any difference if JM had the tape tested, the fact that it ended up in the defense hands first and no one knows why or how...and that it was taped by JA a few weeks before the murder (which a juror asked) goes to show how evil she is. JM is best when cross examining so I am not worried.
 
I do think she will rec've the DP. Just a 'woman's intuition' thing...
Juan has the last word w/his rebuttal. and I think he will put it all out there, like only he can! jmo

ETA. i just saw Hez's post. Seems we're thinking along the same lines...

Pffttt to that one blogger and to the trial chatterer who needs to drive up his twitter numbers. Pfftt and kafooey.

JM is as good as it gets, she is as guilty and as cold as they come, and Nurmi can't get his mind out of the gutter.

Juries, in AZ, sure enough do have a track.record of giving women murderers without priors the DP. No reason to believe this jury can't get it right.

That's why I want the DP. I don't want her in general population feeling like a celebrity with other inmate groupies looking up to her. I know she won't be sitting in her cell thinking of her crime (other than re-living how she believes Travis got what he deserved) and I know she won't ever feel remorse for killing Travis, but I don't want her to have anything to smile about. I don't want her thinking her very existence is contributing to anyone or anything. You know, all the programs she can start and people she can help......

Jodie is sadly mistaken if she thinks she can just bop into prison and change/start programs or change anything at all. Jails and prisons are run on a schedule, programs are implemented by either DOC or prison officials with DOC approval, and the powers that be will not care what her name is or what she wants to do.

CMJA is in for a big shock when she finally gets to prison whether she gets the Death Penalty or LWOP, IMO. Prison officials do not care who you think you are or what you want to do. You will adhere to the rules and regulations or you will be punished.

I am so looking forward to her arrival at the prison!!!

That's right. Jail is a picnic compared to what she will experience in prison, wherever she lands.
 
I want the Alexanders to sue her and get all the money she makes from the sick minded individuals in this world that support murderers. Sue her!
 
It is very hard for me to critique what Travis should have said in a conversation he thought was private. I don't think it had one thing to do with him liking 12 year olds or even knowing what they sound like. He simply said this because JA in her nauseating little girl voice was acting and sounding like she was a 12 year old.

IMO

It's also possible that Arias liked to play the young innocent and Travis was simply playing along, again, because it's what she liked. Regardless, it's no more than sex talk, that's all.

This is how I picture it ...

Travis says Goodbye to Jodi.
He is going to have a shower after having sex, and believes Jodi is off to SLC to see RB and see/visit other Mormon members.
Jodi goes to her rental and comes back in the house and starts taking photos of Travis in the shower with his camera - to add to the collection of sex photos, to frame him with his Bishop/Mimi.
He sees her, she has the .25 caliber gun she "stole" from her grandparents.
She fires out of white rage - misfire.
Travis "leaps" towards her and she shoots again. This time, the small bullet goes straight down and misses his brain.
He is tough.
He stands in front of the sink, blood spattering from his sinus cavity trying to comprehend what is going on.
Jodi has culinary knife on hand and starts to stab him in the back.
He faces her - in a split second, a stab to the heart.
He is tough.
He turns around to face with his hands up, and tries to fight her off.
After 1 minute, he drops to the ground and starts to crawl towards the exit.
He makes it to the end of the tile hallway - throat slit. All in less than 2 minutes.
BBM. Can't be simply because of the bullet casing lying on top of the pool of congealed blood. The gunshot would have disabled him and had to pierce his brain. It did pierce the Dura Mater.
 
Just a point of clarification--the defense doesn't have to actually prove that physical evidence is authentic before it can be admitted, but they do have to have evidence that it's authentic. And JA's word is evidence enough for this purpose. E.g., "That's my phone."



A young girl with graying hair...it's gonna be a hard sell.

Maybe when I turn 60, I'll consider 27 a young girl.
