Retrial for Sentencing of Jodi Arias - Day 5

I beg to differ; way long ago the Mormon religion (fundamentalist sects) did have a death sentence for those accused of sexual misconduct, particularly adultery. There are cases that have been written about concerning the sentence--being slashed from ear to ear and the blood having to spill upon the ground. This was the only way the sinner/violator could gain access to righteousness before God. And that was what Jodi did; in her mind, she helped Travis into heaven. That was the reason for the throat slitting and hauling him all the way back into the shower after slitting his throat in the hallway--the blood had to go down the pipes and get to the earth. She is totally capable of this mentality and the means needed to achieve it. Today's Mormonism: not acceptable, but there are some records of blood atonement from the past.
'Why did you put him in the shower after you killed him?' was one of the questions the 1st trial jurors asked JA. She began to answer (although she had no memory!), but Martinez quickly objected and the judge sustained. I so wished Martinez let her answer but he must have had a good reason and I trust his judgement.

I don't believe JA cared if Travis went to heaven or hell. I believe she put him in the shower because he was bleeding profusely and was worried about his blood seeping though floor to ceiling downstairs. What's a girl to do?

I agree. Plus once you get to know her she truly turns ugly. That ugliness inside of her seeps out no matter what she does to try and hide it. Nothing behind her eyes, just dead orbs. But I guess some people see her as attractive, or did.

MOO

Totally agree. I think for a lot of people, it's the eyes that really captivate. So she's out of the running right there. Puts me in mind of what Paul Stern said about her (the guy she borrowed cash from, the day before she left to murder Travis IIRC).

"... When you engage in conversation with Jodi and look into her eyes, it's like looking in a two-way mirror. But Jodi's looking at the reflective part of the mirror. And her eye beams never really meet your eyes..."
Agreed. It really bugs me when these talking heads compare how "attractive" she was as a blonde. Barf!!!

I've seen mentioned several times that Auntie Arias is testifying this time around. Anyone know this for sure? It would explain why she hasn't been to trial this week. Thanks.

As far as I know that is just speculation. I'm not sure what the heck she could testify to. She "found" the "stolen/lost" phone that had the sex tape call on it. Other than that, what could she offer?

Arias was a fake Mormon - a ploy to make herself more attractive to Travis. And she killed him because he rejected her. Plain and simple.

I know what you are referring to but I do not think JA would have known about blood atonement, esp. if she was just dabbling in Mormonism. I could be wrong, but I do not think the old practices/beliefs of Mormonism played a part of the way she murdered TA.

Gawd, the "shower scene" comparison has always gnawed at me and makes so much sense (JMO). they seemed to have a theme of play-acting, whether in actuality they followed through I have no clue. But if she got him to try to recreate pics from the movie scene, that would explain why she is dressed, and how she could have the knife in plain view along with the camera --- and was able to ambush him in the shower. He just doesn't look scared enough to know what was truly coming. A few stabs and he would be on the floor, perhaps crawled out to the sink, down the hall... and we know how that ended. Why the gunshot is my question (she thought he wasn't dead?)

This just makes more sense than anything else, to me. Where am I missing something that proves it can be a wrong theory?

Quoted from previous thread by Spellbound.

**warning - following will be graphic**

My theory has always been that she surprised him in the shower with stabs to the back, then to the front as he turned to her (position varies depending on how you believe she surprised him), he stumbles out of the shower to the mirror (leaving blood splatter), sees what she's done as she continued to stab him in the back. At this point he is weak and drops to his knees and tries to escape the bathroom, she follows, kinda bending over him continuing to stab him. He reaches the carpet and panic starts to set in for Jodi, this is where she decides to slash his throat and drag him back into the bathroom (pictures snapped at this time showing her dragging him back), she puts him in the shower and he's still making noises, so she decides to finish him off with the gunshot.

Sorry for all the detail, but that's how I have always seen it happen.
Not me.
This is how I picture it ...

Travis says Goodbye to Jodi.
He is going to have a shower after having sex, and believes Jodi is off to SLC to see RB and see/visit other Mormon members.
Jodi goes to her rental and comes back in the house and starts taking photos of Travis in the shower with his camera - to add to the collection of sex photos, to frame him with his Bishop/Mimi.
He sees her, she has the .25 caliber gun she "stole" from her grandparents.
She fires out of white rage - misfire.
Travis "leaps" towards her and she shoots again. This time, the small bullet goes straight down and misses his brain.
He is tough.
He stands in front of the sink, blood spattering from his sinus cavity trying to comprehend what is going on.
Jodi has culinary knife on hand and starts to stab him in the back.
He faces her - in a split second, a stab to the heart.
He is tough.
He turns around to face with his hands up, and tries to fight her off.
After 1 minute, he drops to the ground and starts to crawl towards the exit.
He makes it to the end of the tile hallway - throat slit. All in less than 2 minutes.

I can't imagine either what she could add and given her courtroom theatrics last year and the behind the scenes financial sales work she does for Jodi, I don't see that she could be considered credible. Not to mention that Juan would be able to cross examine her, and they should know by now that it never goes well for them.

And, Jodi is nothing but a dark empty thing. No true beliefs, a mockery.
Jodi weaved all her inter-personal relationships to her gain.

Once she lost a rich Mormon "good boy"; she could and not accept that.

Doubt she's still a Mormon. Can they throw her out???
I don't a court of law can argue religion. Which is stupid, because change their religion like their underwear.

Religion and law should never cohabitate, IMO.

Both sides are governed by the rules of evidence, so defense does have to show that evidence is authentic, credible, etc., otherwise it's not admissible. In the case of the phone, its origins, ownership, contents ad so forth have been verified, hence it's admissible. Now of course this still leaves room for debate by the state, such as how it was supposedly stolen and conveniently reappeared, but the point is, defense couldn't just throw any old phone with a recording on it into the mix. Or any old anything. They had to prove, for instance, that it really was Arias' phone. And they had to do so before the trial. Otherwise, trials would never get anywhere - they'd be overwhelmed by the task of showing that evidence was or wasn't genuine.
<respectfully snipped>

Just a point of clarification--the defense doesn't have to actually prove that physical evidence is authentic before it can be admitted, but they do have to have evidence that it's authentic. And JA's word is evidence enough for this purpose. E.g., "That's my phone."

How is 27 "a young girl" by any stretch of the imagination???

A young girl with graying hair...it's gonna be a hard sell.

She might testify that JA was abused by her parents. She didn't have evidence of abuse last go around, so I think this might be what she'll testify to.

Who wasn't abused by their parents?
I didnt kill the 3rd or 4th guy who abused me.
Don't buy it, Jodi.

My psychological profile is definitely childish mentality. Freedom lost? Grow up.

IMO, the onky thing Jodi had going for her was her body.
Her teeth look like dracula.
I've been a blonde all my life, not sure if Jodi's hair fakeness added to her looks.
With that being said, Travis did seem to be more attracted to brunettes.

I don't remember this, this was a juror question? :waitasec: Why would Juan not want that answered ? AZ lawyer ? Any light on this one ? TIA

Jumping in.

I believe some jurors cannot phantom how Jodi dragged Travis back to the shower stall.

I call it ADRENALINE.
