Retrial for Sentencing of Jodi Arias - Day 6 - Part 3

So, it appears that the "secret' witness testimony will be available post verdict (according to the State vs JA FB page)...but, IMO, until it's not.

Would it make people feel better if there were another Casey Anthony outcome (that jury was sequestered) or an OJ Simpson outcome (that jury was also sequestered)? Would everyone be willing to help fund the cost back to AZ for taking people out of their lives for 2+ months to sequester them?

ETA: The argument is not so much about the jury as it is the allegedly scared 'witness' who doesn't want the media or public to have any access to their testimony. Sequestering a jury does nothing for that argument.
I was responding to a post the questioned a recent poll and the jury's ability to be influenced by media coverage. I am aware that sequestering a jury would be expensive. My local court has had to sequester jurys before. My dad has had to deliver their lunch etc. I do understand costs. I also understand that this judge can't control her courtroom, let alone the idiots whi might do stupid things in the hope of a mistrial.

This retrial has gotten too exhausting and ridiculous. I feel the secret witness is the killer. Easier to lie if no one that know the truth is present -- maybe her Mom.

God bless the Alexander family.

I have to agree with you 100% on this one. They are beyond ripped apart by this and there is no way that they would jeopardize the trial.

We still don't know if the reported identity of the secret witness is correct. If it is correct, it is entirely possible that Arias leaked this to Troy Hayden, since he is still on her call list.

Im putting my money on JA or defense leaking it to the reporter "K" who seems to have a batphone line open directly to JA and the defense. From there, it went to other reporters and now onto us.

And I agree if its found out it was the defense doing, then JA "privilege" about having private trial should be revoked because they obviously dont care about wanting it to be kept secret or even what they are testifying about.

Jodi would have nothing to lose, but the judge would have nothing to lose by saying no either. Literally zero percent chance of a successful appeal on that issue.

There is a phone in chambers.

AZL, I need your help please.

In this phase would Arias be on the stand testifying as a witness or would she do like last time and stand in front of the jury?

TIA

I'd love to hear an actual judge's opinion of this judge. I thinks she allows too much nonsense in her courtroom. She doesn't seem to have good control. I hope I'm wrong, but I fear if she doesn't get the DP this judge will give her LWP. Arias should never be allowed to be free again.

Newbie here. I think the secret witness is JA. You can call me a looney after reading this. Since the lost phone & the 12 year old scenio came up (Juan did not examine the lost phone) is it possible that CMJA secretly recorded her & TA having a tryst & her acting like a young girl(she really seems to be into that) She wants to show this on the stand stating it was his idea. Maybe that was what he got so upset with her hence "you have betrayed me". Maybe this could be why everyone was kicked out. I read if a testimony was an embarrassment the judge could that. Don't know if that is law. My mind is going all directions why the trial could me closed. Okay, you can call me cray cray now

It's interesting to me how killers and especially violent killers have some of the most ardent fans, determined to break them out of prison, as if they aren't a danger to society.

The door bumper said she/he saw Arias testifying. Of course, that could be just a broad general observation covering both Arias on the stand or Arias standing & allocuting. If she was allocuting, it is out of the order in which witnesses are called but then the VIS were early too.

No way, not even a single percent, did any of the Alexanders leak who is on the stand. I don't believe that to be in any way a possibility. They are never, ever, ever going to risk a mistrial by leaking information. The have been waiting for over 6 years for justice for Travis. There is no way they would risk making it an even longer wait. Whoever leaked it, I would stake everything I own that it wasn't an Alexander.

I am not saying it was the Alexanders who leaked it to the media. I was entertaining the possibility it could have been a supporter. We tend to blame the DT as it has been Kiefer reporting things that were deemed sealed. The content of the testimony was not revealed, only the "witness".

You know how some people pretend to be your friend when they really aren't? Unfortunately, there are some people like that surrounding a member of the Alexander family. Just sayin.

ETA: You would be shocked at some of the behind the scene stuff that has gone on.

Welcome, Turtlesmom.

:welcome:

Hi! RadarLuv. Nurmi used to work for the public defenders council & when he did, he was assigned this case. So was Washington. Some time in, he left the defenders & went into private practice. He had trouble launching that because of this case and its requirements but try as he might, he could not get released from the Arias defense. At one time, he might have escaped (who knows?) but Arias implored the court to retain him as her chief counsel, in writing. Do you think she may be a bit fickle, having read her latter day screeds against him?

You are exactly right Tuba about Nurmi wanting off this case. He was stuck with her. But since he stooped so low with Arias in that mud hole of a defense, I am glad he is on the same par with Baez. In other words, it won't help his career and most people loathe him.

Well if one of her supporters leaked this, and if she did, probably at the direction of Arias...then JSS should wakeup, and know she has been made out to be the fool in all of this.

If they can trace who put this out before the media even found out then heads should roll.

Of course Arias will deny, deny, deny, but if she had contact with the leaker at some point in time then JSS should open up the courtroom for everyone to come in and see the testi-liar testify.

If she is trying to get a mistrial, I don't think this will work. Even if it is known she is the one on the stand ........no one but the jury has heard her testimony or her long drawn out PR presentation like last time.

IMO

Not to mention...if DT requests a mistrial all JSS has to do is say NO. In fact, JSS should try that with the defense.

I agree it is better to not sequester but either way this could never be another Casey Anthony outcome. That killer walks free; this killer will not.

I also believe this happened. If nothing else, some journalist willing to get in trouble for the cause. I find it a little bit presumptuous that anyone could say this could not have happened. The other 2 sources could have been standing near the courtroom door just awaiting someone to make this exact "mistake".

I'm presumptuous , then. And I believe that story less by the moment.

To believe it, you'd have to believe in those several miraculous moments when some secret person accidentally stumbled upon CMJA on the stand, that secret person also managed to understand before turning and fleeing (or being escorted out) that CMJA was retelling the same story , nothing new.

Then you would have to accept that the court didn't speak to or admonish this secret person, that this person who saw by accident decided to seek out the media ...to ask what to do?

Last, you must accept that either 3 people - the 3 sources- stumbled into that same room....maybe they took turns and nobody noticed? Or nobody noticed a small crowd of media lurking near the closed doors?

Or 2 people inside closed court were asked to verify to the excluded media that the one secret stumbler- inner got it right. And the insiders agreed to do so.

Hmmmm.

Yes Hope. Things like this make you go hmmmm. We will have to wait to see unfortunately. But call me skeptical.
