In my opinion only, Judge Stevens is so caught up in the stress, strain and dramatics of all the court room drama and is "in a fog" I would hope the appeals court will be objective and look at the law and not end up "in the fog". But, since it is unknown why this witness has to secreted, maybe there is something rather significant that we watchers don't know or don't get.

BBM: IF -- IF the "mystery witness" is CMJA, IMO, there is nothing significant that would cause JSS to clear the courtroom ... absolutely nothing !

CMJA IS a convicted murderer ... Yes, she has a right to a fair sentencing trial but CMJA -- and JSS -- have NO right to change the Constitution to suit her [CMJA] needs !

I don't think so. I think she's bending over backwards to give the defense team less chances of appeal. By giving in to their game of secrecy, she knows the appeals court will overrule her. She's called the DT's bluff. I really don't think JSS likes Jodi, and she won't hesitate to give her LWOP if the jury votes against Death.
I trust that she understands what she's doing, even if we don't.

I am sorry, I have no sympathy for KN. Imo, he is just as bad as the defendant. And I really don't hate defense attorneys. I am very aware they are needed to see that justice is done and to make sure the defendant has a fair trial. But every now and then one will come along that makes me want to gag. KN is one of them. I have only detested 3-4 defense attorneys for the way they presented their cases in all the years I have kept up with criminal trials.

There is a correct way and an offensive way to ask questions of any witness. The questions asked of Det. Flores were totally inappropriate in the way they were phrased in KN's gutter ball filthy way. I have learned to detest this man almost as much as his client. For him to say he doesn't want to be there he sure seems to enjoy all of the sex questions and to KN it seems everything of importance is about sex, sex and more sex.

I find him totally unprofessional and quite unethical at times. KN knows that JA is lying more than anyone yet he puts her on the stand and pretends he doesn't know. He has seen the evidence ...........he knows even the last jury knew she was lying but if he openly admits he knows she lies then he can get himself in trouble with the bar. But he knows and everyone knows he knows all too well just how quickly his client will lie in a nano second. But even though he knows she is going to lie through her teeth he puts her on the stand anyway.

I have no respect for him nor JW and it isn't because they are defense attorneys but it is how they both have acted in this case throughout.

He may think it will be better for him professionally if he tried to get off of this case. I just think it is a tactic to save face for being the attorney of one of the most hated defendants ever known.

I believe he was a public defender at the time and went into private practice after becoming her attorney.

ITA, oce! One can conduct a fierce defense without crawling into the gutter with one's client. Uh, um, maybe not in this case...

I hope you're right, LinasK. The idea of JA being out in 20 years keeps me awake at night.

All we know is that he argued against a stay of the trial until the appeals court could rule bc he said the trial has already been going on for 6 years and didn't want more delays

I think we have to give the jury more credit than that, at least potentially. Our legal system has put the weight of this decision on their shoulders. The players in the case, the defense and prosecution, will do what they can to influence that decision. IMO there is much in this case that will weigh on the side of the prosecution, and I also believe that if the defense gets too ugly and outlandish, it will backfire on them, but they've got nothing else, so I think they're going for it, with their fingers crossed.

Day 6 at 1:57pm she reports that many people speculate that the secret witness might be JA, and again at 7:43pm she guesses it's JA based on her experience and her gut feeling.

You are exactly right Tuba about Nurmi wanting off this case. He was stuck with her. But since he stooped so low with Arias in that mud hole of a defense, I am glad he is on the same par with Baez. In other words, it won't help his career and most people loathe him.

I would agree most decent people are repulsed by him. If I were a sex offender, and I saw to what lengths KN went to savage a brutally murdered victim, I'd hire him.

I'm presumptuous , then. And I believe that story less by the moment.

To believe it, you'd have to believe in those several miraculous moments when some secret person accidentally stumbled upon CMJA on the stand, that secret person also managed to understand before turning and fleeing (or being escorted out) that CMJA was retelling the same story , nothing new.

Then you would have to accept that the court didn't speak to or admonish this secret person, that this person who saw by accident decided to seek out the media ...to ask what to do?

Last, you must accept that either 3 people - the 3 sources- stumbled into that same room....maybe they took turns and nobody noticed? Or nobody noticed a small crowd of media lurking near the closed doors?

Or 2 people inside closed court were asked to verify to the excluded media that the one secret stumbler- inner got it right. And the insiders agreed to do so.

Hmmmm.

So, was it Hayden or Kiefer who actually broke this story first?
