She has already been found guilty of aggravating factors, i.e., cruelty. I don't think it can be debated anymore, can it? Mitigating factors only. Like...she's young, she's oh so intelligent, an artist, a super-duper vocalist (she may even be allowed to break out into a chorus of "oh holy night" during her closing argument), has nice hair, loves animals, got hit with a wooden spoon, and so on.

Am I missing anything?

Cruelty evidence IMO will be limited to whatever the jury needs to understand what the other jury already found, so they know how much to "weigh" the cruelty in the balance against the mitigating factors.

Adding to your factors...[alleged] victim of physical, sexual and emotional abuse by Travis, mental issues making it harder for her to act normal and not stab people, no risk to anyone in the jail because tiny and female and sweeter than anything, a potential leader in the domestic violence victim community who might save many lives through her advocacy and charitable efforts... I'll see if I can think of any more.

Yes, but doesn't the degree of cruelty or depravity contribute to her ultimate sentence? IE Death or Life? Isn't that the whole point of this phase? The first jury couldn't agree on the final sentence. That's why we are, unfortunately, here. Of course, she was convicted of first degree premeditated murder, that's a given.

Degree of cruelty/aggravating factors contributed to the DP not being taken off the table when the defense motioned for that. The jury agreed the factors were there. They just, in the end, could not agree on whether the aggravators that the state had proven were greater than the mitigators the defense asserted.

AZLawyer, good to see you in this thread! The part I bolded in your response above actually made me laugh, but I do think they're going to dwell on her mental state--BPD as diagnosed by DeMarte? Didn't the defense grab ahold of that before the end of the first trial?

It's not for us to speak to what the Alexander family wants, or what Travis would have wanted them to do. Can't even speculate. He was their brother. Either way Stabby will have a miserable, wretched life in Perryville. To me, she is a danger to society, she would kill again, IMO.

I don't know for sure either but I can speculate that they want the death penalty...if they didn't I do not think things would have continued this far.

AZlawyer, I don't see any mitigating factors you listed that would fly, unless it was a lone juror, which is all she needs. Be ause they are all, as you say, alleged. Have you thought of ANY mitigating witnesses she could call...I mean, of the ones we have all discussed before? That is the rub for me. I can't think of one. Every time the Hughes or D Reid are mentioned, I just laugh. Her goal would be to make them look bad. They were Travis's friends. Of course they hate her. But I still can't think of any way it could help her. And by this time, think of how much Juan Martinez may have come up with that could contradict her.

This is exactly the kind of thing I've been wondering about. I think Jodi is really anxious to get certain people on the stand but is incapable of thinking far enough ahead to wonder what Juan is going to do during cross examination.

I think JA wants any opportunity available to her to torture people who were close to Travis. I hope the judge evaluates the relevance of testimony and keeps a tight leash on counsel for the defense regarding same.

I am lost,the next hearing is the 22nd,so is Numi in or out? If he is out we won't see a trial till sping! She is in jail, let her have her games,my heart goes to the family
She needs to be in Prison. Not slumbering on a bunk in a county jail!

I think you could get 12 jurors to agree to LWOP easier than the Death Penalty. That would assure that JSS would not give LWP. This would be a much better choice in my opinion. This may not be ideal but it would be better than what she might receive. Also it would save the poor taxpayers from AZ a lot of money.
None of the options will bring TA back. I just believe sometimes less is more in the end for all involved.

She wants more time. She's doing everything possible to delay going to prison. More time also means more opportunity to beg for appeal money via social media. It's almost unbelievable.

Yeah i do remember that one now, but only because of the tragic murder of Mrs. Horowitz. That was so sad. I wonder what happened to Susan Polk. I guess she is in prison?

The last I heard, she was in the same prison as Betty Broderick. There was some joking about putting the two of them in a cell together to see how (even more) bonkers they could make each other. :)
