That was some post you just made! Of course, I had to go right to two innocents to read about John. What an amazing gift you have given him! What an amazing thing he has done for himself. I pray. I pray a lot. And on August 12th, 6pm Arizona time, I will pray for John's audition. For some reason, I feel confident in my heart that John will be blessed beyond measure. Actually, the chorus will be blessed to have him. I have always heard that if you do what you love, success will follow. if he can do what he loves, maybe a happier life will follow as well. For me, it's so important to be with people who share my interests and it makes me excited to wake up each day knowing there is something I can do that I feel good about. You really struck gold inspiring John this way. And there is something unexplainable about how good exercise makes you feel. I experienced that many years ago. You just feel like you can take on the world. (I can't do it right now for myself because of a back condition but the day is coming.). You are a brilliant writer, mixing insight, wisdom, and humor.

None of us Websleuthers feel bad that you have taken your life back. I know the Alexander's feel your love and ours as well. We tease here and joke but we are aware just how serious all of this is. The killer needs to be locked away. That will come, at some point. Just how much more damage she will try to do to the family remains a mystery, but try she will! We all should pray for their strength and future. And I do for you as well, as I know it must be painful every day.

An idea has come to my mind about a killers sentence. Any killer. Especially this one. You have rightfully pointed out all the resources that CMJA will have available for appeals if she were to receive a death sentence. And how it would drag on....and on. Life in prison is too good when you consider her heinous crime and that she would be able to make friends with other prisoners and perform her Christmas carols and draw her art. Ugh. Sadly this is what happens. They adjust and life isn't so bad.

A third option came to me. I wish the courts could consider it. How about a death row sentence without death and without ANY chance for appeal? I mean literally, locking her up in a cell 24/7 with NO outside contact, no artwork, no mail from the outside, no phone calls. Of course she would go mad. it sounds cruel. But when a person savagely murders someone with premeditation we don't want them in society. Nor do we want to pay for their appeals. Nor do we want to hear how the crazies outside are lining up to be married to them, etc. Fairly close to an eye for an eye, I think. Oh and bread and water for their meals. Let life, or death, take its course. I truly believe also that she was advised to take this route so she can stall. Hopefully, JSS will nix that.

Wow, I just remembered something. I wonder if she wants to represent herself in part to get a crack at Deanna Reid and Det. Flores, because in her opinion, Nurmi failed to impeach them. The woman is into revenge to an insane extent.
 
Sill in the hands of Judge Stephens, according to MSM quoted a few posts back. Either a delay in the feed, or video AFTER the verdict. I think we'll see some motions before the court real quick from MSM for a delayed feed.

BBM I think JSS is just being very careful on how she is dealing with this very difficult case, with a very difficult defendant- she's crossing her T's and making sure she dot's all I's, so there won't be an appeal of any sort later on after the sentencing phase. Hard job, IMO and I wouldn't want it.
Hey I wouldn't want the job either but it is her choice to be a judge and as good as she is, she allowed the killer to go on and on and on with her freaking testimony. Then she allowed those side bars, those ex parte hearings. She shut court down due to a headache. On and on like I said. A freak show.
 
Folks, I don't think Jodi wants a mistrial. A mistrial will mean LWOP -- sentencing will go to the judge and no way is JSS giving her parole. The judge could have taken the DP off the table in the latest go round back in June, or whenever it was, but she didn't.

Jodi wants parole. That's why there has never been a plea bargain, and why there never will be. She wants this trial to go forward so those jurors will give her 25 with a chance at parole.

I agree with some parts but disagree with some other parts.

I do agree that Jodi wants to somehow get parole or even better. I think Jodi wants to somehow get the whole original verdict overturned at some point. I think Jodi is going to try to twist this sentencing re-trial into discussions or statements about her innocence.

How she approaches this will be interesting and I predict there will be LOTS of objections from Juan because Jodi will incorrectly state things that should be no part of the sentencing phase. I think she will attempt to sneak in statements about her innocence.

Another thing she may do if things start going real bad for her is that she may totally go bizerk on purpose. I wonder if she has a backup plan to cause chaos in the courtroom. She may incorrectly think that if she causes a mistrial that somehow that will help her get the original verdict overturned as well. Even if later on appeals.

As far as letting the judge decide her fate, if it goes to the judge, I don't think anyone can predict the judge's decision and I would not be surprised if this judge does grant her a chance of parole after 25 years. When I watched the original trial, there were many times I felt the judge was being way too nice, so it would not surprise me one bit if the judge did grant her a more favorable verdict. I of course hope that does not happen. I hope the jury actually decides this and it is not left in the judges hands.

One thing we can all probably agree on. Jodi will attempt to turn it into a circus with her being the ringleader.
 
I don't think that's possible for her in Arizona. I remember that JM said that he wanted death for her,( but right now, she only has 2 possibilities: death or LWOP) but she still might get LWP IF the laws are changed in the future:

"Sentence of death or life imprisonment; aggravating and mitigating circumstances; definition

A. If the state has filed a notice of intent to seek the death penalty and the defendant is:

1. Convicted of first degree murder pursuant to section 13-1105, subsection A, paragraph 1 or 3 and was at least eighteen years of age at the time of the commission of the offense, the defendant shall be sentenced to death or imprisonment in the custody of the state department of corrections for natural life as determined and in accordance with the procedures provided in section 13-752. A defendant who is sentenced to natural life is not eligible for commutation, parole, work furlough, work release or release from confinement on any basis....

How many think JSS will stick to the no delay? I hope she does, But,history with this judge says nope..

I think she might this time. Maybe I'm overly optimistic.

OT - but it IS the sidebar... :shush: But just finished a 2-week visit with my brother from Latvia! But he didn't spend that much time here with us... I picked him up at the airport on 7/21, then that Thursday he went to the Bay Area to visit with our sister and family, than drove north to visit high school buddies, then back here the following Thursday; left the next day to visit with more friends in So. California; and was back here Sunday night; just took him to the airport this morning for his flight back home!

Hope all is well with everyone - and it's really nice to see some "oldies" posting here again! :gathering:

I picked him up at the airport on 7/21, then that Thursday he went to the Bay Area to visit with our sister and family, than drove north to visit high school buddies, then back here the following Thursday; left the next day to visit with more friends in So. So glad you had some time with your brother, Niner- even if it wasn't that much. At least you got to see him and that's a blessing, IMO.
Guess he had lots of people to see in such a short time.

How are you feeling?

It should get pretty busy here in the coming weeks until the trial starts again- everyone is coming out of the woodwork to see what's going on (and it was
a "bombshell tonight" moment when we found out for sure that missy:jail: was going to represent herself again).

I predict she won't be able to hold her own with JM and will cry for more help. Nurmi/Wilmott will be helping her, but she's no lawyer, even if she does think she is.
Odds are she will need to have them as her lawyers again- just like the last time and I don't think JSS will let her have anymore time to find new lawyers.

This trial has been dragging on long enough and may reach Bryan Hulsey's coming to trial soon. What was the length? 7-8 years for Hulsey to have a verdict?
No more stalling for her.

Trial Diary Jen reported that when this initial subject came up in court, Nurmi indicated that it was an expert witness.

I have speculated that it was ALV, but given the number of expert witnesses they hired, but did not use, who knows?

What exactly will be covered during this "mini" trial? How far can she go? How long will it last?

Yes, definitely! Juan can not beat her up even if this is his style. A woman could do it though. I'm not saying Juan can't be Juan because he's wonderful just as he is. BUT, there are times when Juan needs to tread carefully so as not to evoke any sympathy for Arias. Arias well be playing her cards big time and she knows how to present the little girl. She only needs to sway one juror and her life is saved.Also, Arias has battled Juan before and they need to keep her unsettled. Arias shows her true colors when she's battling someone. She doesn't LIKE women...harder for her to manipulate. Not Juan but potential male jurors.

Death Penalty cases have to be tread lightly on. With all the shenanigans CMJA has pulled BEFORE her trial ever got to court, Judge Stephens has to be on top of her game, make sure all the "t"s and "i"s are crossed and dotted, and every motion, hearing, objection, etc, is thoroughly backed by the law and/or court precedence.
Throw in un-sequestered jurors and it truly is a daunting task.
It is a slow process, but I accept and applaud it. Arizona has had it set up this way for decades and, for the most part, the system in place works. Could it be better? Quite possibly, but it is what it is. The only real complaint I have is the numerous appeals convicted murderers have that can circumvent the penalty that a jury of their peers has come to an agreement on. Many of these loop holes need to be re-evaluated. I'm specifically thinking of Katiecoollady's sister: justice was circumvented. JMO.
