-The missing shirt (and for those who say there is no missing shirt, let's see the DT produce it at trial - this is probably the most crucial piece of CE LE has against JY) Posted by me

This I have a problem with as being crucial CE. The police impounded his vehicle and contents under warrant as soon as he returned to Raleigh. It was not in his car. However, he was at his mother home, and he might have left it there. He was not arrested until 3 years later, and was not questioned by police. Who knows were is is now, or whether is was worn at all during the murder...... Posted by Shadow722

I brought this over from last night.

Pat Young told LE that JY did not remove anything from his vehicle while he was at her home on Friday afternoon, and she told LE that he was wearing his business suit with his jacket slung over his shoulder when he got out of his vehicle.

JY did not leave the shirt at his mother's house, it wasn't in the vehicle when LE impounded it shortly after arriving in Raleigh, and JY wasn't wearing it when he arrived in Raleigh. This means that the shirt JY was seen wearing at midnight at the HI is missing, and that makes it crucial CE to me. Just where did that shirt go?

Well, that COULD be possible that they would disregard because of the time lapse, but then you have that little email from him, just before MY was brutally murdered. I think that will bring it right back into the present tense of the time of the murder.

To be quite frank, IMHO, I think there was definitely something going on in JY's head during this time. MY pregnant, new job pressures, one quicky in his own home, one old fllame contacted, one visit to one of MY's sorority sisters in Florida, all within a frenzied time frame, just weeks before MY is murdered!

Good grief! You put it all that way, I think I found my hook!

JMHO
of course!

I love the way you tied that together. Quick, call Becky so she can add that into her closing!! :great:

How exactly does one dispose of a bloody shoe print? Cut away that section of carpet? I'm not trying to be snarky, I honestly don't follow you.

Take the pillow the print was on.

It's tough to say, b/c apparently the HVAC was out side I think she had mentioned that it got pretty chilly for her at night. Plus she was 5 months pregnant, so that might have affected her habits.

The heat pump was broken, but the system should still have been heating with the aux heat coils which most heatpump based hvac systems in NC have.

We could speculate all day how the size 10 shoe print got there but there's no evidence to support a theory one way or the other. There is evidence that JY owned shoes with the same print as the size 12. JY admitted to owning the shoes after the investigator found the HP receipt.

I had briefly forgotten about the email - the "I could kill you" part

I don't see anyone saying that who hasn't thought about doing the deed or thinking that was an option at least once - fairly seriously...

I would more easily discount it if he had a habit of saying it when he was mad - but we've only seen it once, and it was close to the murder.

I know that sounds odd - but that email had sooooo much latent aggression I found it chilling -and maybe flavored with a little foreshadowing. I know I am projecting - but I simply can't imagine emailing someone with a "I could kill you" - I CAN imagine a I HATE YOU - but it went way further than that...

If JLY had a good explanation as to the whereabouts of that shirt, such as it had been left at PY's house or given to charity, he would have mentioned it at the last trial. Instead, his attorneys produced a photo of him wearing a similar but not identical (IMO) shirt. By doing that, they have eliminated any chance to say the shirt was conveniently left in Brevard, lost at the HI, etc.

Here is the link to JTF's post showing the photo presented by the defense last time vs. the hotel security camera. If anyone knows how copy that photo to this thread, I'd appreciate it. I'm not terribly skilled when it comes to that sort of thing.

Exactly. And that print doesn't rule him out, it shows he was there. If he had help, he isn't talking, but I don't believe he did.

I admit I missed part of her testimony today. Was he also drunk when he broke her windshield?

I guess I'm lucky. I've been with people when they had too much to drink and NOT one of them has lifted a hand to me.

guess I just knew the right people.

She didn't mention a thing about him drinking when he put his fist through her windshield.
She didn't mention a thing about him drinking when he put his fist in the wall when she confronted him with the letter from Carol Anne Sowerby.

I also do not think he was still drunk when he assaulted her to get the ring back. She testified they had already gotten back to the hotel room and this assault happened after he woke up from napping once they got back to the room. He might have still had some alcohol in his system but how much of a part that played in his behavior we really don't know but I don't believe it can be the sole cause of it given his other non-inebriated violence towards her.

IMO

There is no evidence JY was wearing either of the shoes that made the bloody prints.

Only if you allow the coils to come on and not sure it can keep up with the entire house since it's supplemental / auxiliary.

As resistance heat - it's majorly expensive.

This guy is pretty enthusiastic about prints, eh?

Am I the only one that makes it seem she's trying not to say negative things about him?

I'm running late watching the videos, but I imagine there is a fear on the part of many of the people testifying that if he is found not guilty or there is another hung jury that he would come after them. I am wondering if this may be a fear of hers, in light of a previous hung jury.

Slayer is not a good man.

It seems to me, he doesn't need to be drunk to be violent.

Dual system.
The upstairs unit was not working...period

True but there is evidence that he did own a pair of shoes that would have made one of these sets of prints. Shoes, that apparently, were not very common shoes. To me, that is more than a mild coincidence. One more in the list of many, many coincidences.

The house was extremely cold that night. So cold in fact, that her good friend who came to visit that evening never took off her winter coat.

Didn't Shelly testify that the house was pretty cold and that she never removed her coat or jacket the entire time she was there on Thursday evening?
