Sorry Otto about my post ... JTF can you give the link for the statement Pat made about the shirt so I have it. I never remember seeing that one!!

Otto, what do you mean by defense tipping their hand to properly prosecute? That would the pros. counted on a hung jury 1st time so they could get another chance?

A gamble?

Shelly Schaad's testimony reminds me so much of the witness in the Cooper trial. Sorry, I can't recall her name, but she testified that the first time she met Nancy Cooper was the night before Nancy's murder, and Nancy was talking with her about the terrible state of her marriage, all her problems, etc. And that witness testified to 'looking across the street at the Cooper house and she and her husband were leaving the neighbors house where the party had been that night.' She said to her husband that 'she very much feared for Nancy Cooper', & 'that she felt something awful was going to happen to her.' That too was the night before the murder. I'm a believer in ESP. to a certain extent. I think many of us get 'feelings' we can't explain, but are so strong.

That was Donna Lopez in the Cooper case.

I am curious how that cream color henley pullover ended up in JY's storage place. That's the pullover he was wearing when he walked into MF's house that Friday. Testimony was that most of the items in that storage place were ones that belonged to Michelle. Yet that very pullover was put in storage. :waitasec:

Read #s 10. & 16. on this fellow's list regarding the Eastburn Murders ... dresser draws???
draws??? Oh dear.

http://www.investigativepsych.com/eastburnmurders.html

I think it's all fine and well to find all sorts of prints and DNA that hasn't been matched to anyone, but there should be some connection between various prints that are connected with the murder, even if they are not connected with a specific person. DNA on the jewelry box should match the DNA from the unidentified hair and cigarette butts found by Godwin if it is supposed to mean anything.

Regarding the cigs and hair on wedding photo in bed .... could the cigs belong to invesigators and hair too!!

OK, Day 3, Part 3 at approx 1:10:20 (The info you posted is actually at the 1:17:30 mark) she says she had an eery feeling that night and asked MY if she ever gets scared alone by herself. MY says JLY has been hearing noises around the house but if someone intends to break in and kill you, that's what they'll do.

That's it for me, if someone has the link & timestamp where SS says she felt like she was being watched, your turn.

My bad on the 1:17:30.

What you found at 1:10:20 doesn't say it either. That's actually Michelle saying Jason said he was hearing noises, not Shelly or even Michelle saying it.

I went back to find one of the posts from yesterday and it was
We also can't forget how scared SS was that nite, that she felt someone was watching them, so much so, that she asked MY to walk her outside to her car.

so I assumed it was something that was said around the questions about Michelle walking her to her car.

In regards to Postal worker, CB, I will be interested to see how this is handled this time. I recall last time her testimony was damaging to PT. Up to the point that when she was pressed to answer could she be confused and what she saw could have possibly happened the prior Friday. She admitted that she did not think so but it was a possibility. She then stated more than once that the only way she could be certain about the particular Friday was if it was a different News and Observer delivery person because the Friday morning she is relating her recollections about there was a different News and Observer delivery man. During PT rebuttal they called Travis Branch. He's delivered News and Observer for 15 years. After checking his work records he WAS working Friday Nov. 3rd.

Ouch!

I would expect investigators to be ruled out ... also for the prints on the fax and medicine cap.

My sister has a big house and alot of windows. For example in her bedroom she has 4 windows and in her bathroom she has a big bay window w/ 2 side windows, in her living room/den they have 4 windows, in the kitchen they have a bay window w/ side windows and then their formal dining room has 2 windows and the kitchen and formal dining room are all one big room together. They live off the road a good way and when I would go over and babysit for my neice and nephew I always felt like someone could be watching you considering all of the windows they have in their house simply because I was not use to living that far off the road and having that many windows in a house. Maybe this is what SS was feeling. I would ask my sister did she ever get scared and of course she would say "you can not live in fear"

Hi! I saw where that was commented on by a poster here and I remember thinking, "Hmmm... pretty sure it was JASON that felt like they were being watched, not SS."

But of course I could have missed the lines where she said she also felt like they were being watched, just that she asked MY if she ever got scared being there alone.

I was too lazy to go back and re-listen, but I guess I will anyway.

I sure hate having to chase down everything I hear as being mis-stated but I want to be sure I am being as accurate as possible, even if others don't care if they are. I will let you know if I find SS said she felt they were being watched.

You don't need to track it down - I thought maybe someone else might remember it..

I'm listening to Spivey being questioned after they played JY's testimony (Day 13, pt 4). Holey Moley it's as dull and drawn out as can possibly be with the combo of HC + Spivey. At one point Spivey is reading off every single phone call JY made during and after his anniv. dinner instead of just highlighting a few and giving a total number. The list reading went for like 5 min. I fast-forwarded testimony.

They're trying to highlight lies and it's all lost in the flotsam of what they are reading back. It's like listening to one long run on sentence.

Those durn dresser draws. :floorlaugh:

What kind of person is it that takes on these cases of brutal murderers? Timothy Hennis being another. Brutally kills a young mother and two small children. He should have gotten the DP carried out years ago.

In yesterday's thread it was posted that Shelly Schaad said that last night she was with Michelle that "she felt someone was watching them".

I watched the day 3, part 3 video of her testimony (http://www.wral.com/specialreports/m.../#/vid10704274) - at around the 17:30 mark the questions start about when/how she left Michelle's house.

Q: And did Michelle walk you out to your car?

A: Yes, because I felt so uneasy that night I said 'Michelle, do you mind just walking me out?' and she did. She walked me, we left through the front door, and she walked me to my car and I said goodbye and I left.

Did Shelly talk about 'feeling they were being watched' at some other point?

Yep, she sure did........

On cross with Klinkosum......timestamped: 36:55 minutes

"She felt like the 2 of them were being watched while they were watching television.."

Day 3, Part 4 video.

Did anyone rule them out for the errant hair and butts? I haven't seen anything that says that happened.

Did Godwin/defense have samples to do that with?

I think it is all speculation b/c the defense team did not use Godwin at the first trial, other than as opening statement fodder.

Maybe they did not have the samples to do that sort of test, and that's why they didn't use the testimony, if they could have otherwise.

Do you know that yesterday Klinkosum had to stand up in court and announce that the state had not officially rested their case on record?

To which Ms. Holt stood up and said the state rests.

Come on, really?

I remembered hearing that, too (because it made me wonder if she'd thought that in retrospect, or whether she had really felt it at the time).

Thanks for the link, Cammy! :)

Moonflower!!!! :woohoo:

You are so welcome,
I only have a few minutes,
I have to post my 50 reasons why there is reasonable doubt in this case.

Did you remember in the first trial Shelly also said she was so scared she had Michelle walk her out to her car, she then called her husband and talked to him all the way home?"

Sounds like she was pretty spooked over something!!

I don't know if that came in this trial, and no, I am not looking it up, lol.

I'm just assuming that crime scene officers would be printed to rule out the possibility that an unknown print belongs to them ... that seems like common sense to me. As for DNA being on file for all the officers, maybe not. Still, the DNA on the butts should match the DNA on the jewelry box if they are both associated with the murder.

Godwin passed some evidence to the CBI and it was analyzed. The defense requested that Godwin be allowed to testify ... that was denied but there was room to revisit that decision. I don't remember the specifics.
