The Eikelenbooms and Touch DNA

I hope you guys don't mind a non-American chiming in on this, but I'm so confused by Baez wanting the E's so badly. It's not like America is some backwater without the labs and brilliant people to perform the touch DNA tests Baez wants. America, imo, doesn't need the E's to swoop in. I don't get it. Why does he want the Dutch?

That's how far they had to go to find someone who would buy their Ba Ez.

Baez claims they perfected "touch DNA"! He claims they are experts in trace recovery...He feels the American labs are geared towards the government and I guess he doesn't trust our labs will properly test or that they will lean towards the prosecution, is my take on it...JMHO

When someone doesn't trust others, it seems to me, they don't trust themselves...He understand how unethical he is (Baez) and is projecting and visiting that on others....JMHO

The defense also asked that the items be tested by its DNA expert Richard Eikelenboom of the Dutch-based Independent Forensic Services.

"Mr. Eikelenboom is world renowned and highly regarded as a pioneer in the field of touch DNA, an area that could prove useful to the defense," the motion states. "Many laboratories in the United States have not mastered this technique, thereby placing a severe restriction on its [the defense team's] ability to find an expert with this expertise."

Defense attorneys Jose Baez and Cheney Mason also argued that all 15 Florida based labs were directly affiliated with law enforcement and therefore were potentially biased against the defense, the paper reported.


"In order to conduct truly independent forensic testing many lawyers have relied on experts from areas of academia or former law enforcement to test evidence and draw away from the inherently biased approach of law enforcement only testing," the motion states.

Yep, Baez and company feel the labs in our country would be biased towards them..which is such a derrogatory statement towards our very own. Baez is truly fishing but for what?

Testing of Caylee's shorts and that laundry bag already did not yield any DNA, any DNA that were there have been weathered by the storms and lying there for 6 months...Wouldn't Baez make better use of things if he took an objective look instead of trying to claim impropriety done, a conspiracy surrounding ICA, police misconduct, etc....seems to me, he's trying too hard to prove innocence when it appears only one person is solely responsible for Caylee's demise.

I still await reciprocal discovery but with all his media tours, motions filed, we can all deduce from them which way he's heading! He's acting the fool....and a fool and his money are soon departed...JMHO

Implicit in his statement is that American scientists affiliated with LE lack morals. I wonder if he realises the implication there between the lines while he makes a grab for Dutch scientists.

WHich to me is ironic because when I think of Dutch and crime I think of JVS (IMO) getting away with murder because of daddy's connections.:waitasec:

The irony is rich indeed, after reading this thread and watching these videos, it seems like the defense wants the cake and to eat it too. They will fight against the air samples, yet use this science to try and clear ICA.

I read this and immediately heard Baez saying, "MY science is better than YOUR science, HA!"

I swear, he is so schoolyard about this it's ridiculous. I can totally see him condemning the science the SA uses while toting his own sources as renowned and best in the world, trust them!

He is going to be talking out of the sides of his mouth this whole trial.

I really hope if the E's are doing testing, that they find NOTHING. Then I can sit back and laugh at their snobby butts.

OK, so I guess I have a dumb question then...

HHJP made the comment at yesterday's hearing that he was inclined to grant the defense's motion to have the evidence tested. However, he also stated he would not allow the testing to be done outside of the country.

HHJP ruled today that the testing will be done by National Medical Services in Willow Grove, PA, NOT by the E's in Holland, as the defense was requesting. If I understood JA's objection correctly, he did not object to the defense testing the evidence. He only objected to it not being done at an accredited lab and within the U.S.

So, HOW is this a WIN (as in granting the defense's motion) for the defense? Seems to me this is a win for the prosecution, as JA got exactly what he wanted.

Am I missing something here?

The Defense wants 2 items to be tested by touch DNA experts who reside and have a Lab in a foreign county.

1) The Prosecution had no objections to the testing of these 2 items by the Defense
2) The prosecution did object to the Defense request to send the items to be tested out of the United States, to an unaccredited lab.
3) The Lab and its personnel are outside the jurisdiction of court and the court can not compel witnesses to testify.
4) The Defense and the Prosecution had agreed that National Medical Services Lab in PA was acceptable to both sides.
5) Judge Perry said he was inclined to allow testing by the Defense, and he has ...BUT he would not allow the items to be sent outside the United States and outside the jurisdiction of the court.

I think that's it in a nutshell?

The only question I have is WHO will be doing the testing the Lab in PA?

Good! I was inclined to be suspicious of this whole 'send evidence outside the country to the Dutch scientists' issue just because Mr Baez wanted it so much. It is nice to see that the SA and HHJP are keeping on top of things.

Because they are **FAMOUS** and it would be one more notch in his belt, so to speak. Jose wants to walk among and talk to the celebrities as if he were one of them.

Bet the celebrities are laughing as much as we are.

I'm glad to learn that the Eikelenblooms from the Netherlands will not be able to do the testing in the Pennsylvania lab!

Yeah, and I don't see how Americans view his statements about the labs and LE in the USA, but I heard it as him implying his fellow Americans aren't honest enough to see justice done. Open mouth, insert foot.
 
I am so glad the judge ruled against the Dutch guy doing the testing. It is going to be hilarious if the tests come back and bite JB in the ___. Would it not be great if they did find additional DNA (which I doubt they will) but if they did and it belonged to ICA or someone from the Anthony household which would prove the bag came from their home. Ouch, JB would need a big bandaid for that booboo.
 
WHO WILL BE TESTING????? That's the big question and.....my best guestimate is:




The STAFF of the PA laboratory! YEP, that's the gang that EARNED the accreditation that is so highly valued and by golly, that's the gang who will be traveling down to Fla (at Jac rates, of course!) to testify as needed. Now, I'm BETTING professional courtesy will be offered to the Dutch to observe (we do it frequently with defense pathology experts). Don't forget there are liability issues with strangers "playing" in your laboratory so one must abide by all the legal ramifications of NORMAL life, not just ANTHONY-BAEZ life!

So we are going to try and connect someone to this case based on touch DNA just like JBR huh????? Didnt they determine that the touch DNA in that case was probably the underwearinspector or something as innocent as that?

So with testing Caylee's shorts and the bag.....theres the inspectors who inspected it. Probably someone had to touch the items while being manufactured, boxed, shipped, unpackaged at the store, put on display shelves, touched by.......millions of shoppers while on the shelves.......touched by cash register employee, box-boy, washing machine repairman man who had to move the canvas bag off the washing machine when he repaired it. oh wait......touch DNA......as simple as it sounds. Someone who had access to touch the item. Caylee's shorts, who knows......how many places had she been? What they won't find......touch DNA from ZFG............
 
Post Script: don't forget that this is a procedure requested by the defense, the results go to the defense FIRST and can be ignored if the defense team can not utilize them to their advantage. This discovery may never see the light of day!

It will be very interesting and enlightening to see which Defense experts make the final cut and get added to the Defense Witness List by the deadline of November 30, 2010. Wonder if the E's from Netherland (or Colorado) will be on the Defense witness list after the DNA testing is done on the laundry bag and Caylee's shorts, by the PA Lab?

If we don't ever see these results in discovery or at trial, won't that pretty much tell us that the results were not in KC's favor?

I guess my original question from the beginning of this conversation a few pages back still remains.....

HOW is this a win for the defense with HHJP granting the motion? As I see it, the judge pretty much denied everything within the motion that the defense was requesting EXCEPT the ability to test the 2 pieces of evidence, which the State never objected to in the first place. The defense doesn't get to send it to Holland, and they don't get to have the E's do the testing. How is that granting the defense motion?
