If the jury is DP certified, does that mean they all have agreed they could give DP?
Yes. It's in the voirdire.

With LWOP she gets to be more social in the system. With the DP, she's more isolated but gets to be a star outside the system.
I know a few things about this process as my sister's killers were sentenced to Death in AZ in 1990 and our family has been dragged through the appellate process for 23 years. The DP is NOT the preferred sentence in terms of impact on victims families. There is a momentary satisfaction knowing the worst of the worst got the worst of the worst sentence but that is short lived.
One of my sister's killers got off Death Row a couple of years ago because of a mental retardation claim. Jodi will also probably get this argued for her too with educated attorneys doing so with a straight face. It dragged our family through another mini trial and so much retraumatizing I can't even enumerate it here. Not to mention MILLIONS of taxpayer dollars.
Once on death row Jodi will receive some of the best legal assistance there is. Also at tax payer expense. She will have websites set up for her in Canada which request donations and correspondence. She will likely be married shortly after she's on DR. This is the furthest sentence from a "lock the door and throw away the key" there is. In fact, Jodi will have a far better chance of being RELEASED from prison on Death Row than if she gets LWOP. Simply because more people are fighting for her for much longer there.
Don't get me wrong, I'm not opposed to the DP for it's sake. I have no reason to see my sister's killers executed but I don't oppose it. I just know what that sentence does to families. So I have ambivalence about it.
I'll get off my soapbox now. I'll be ok with either sentence but my suspicion is she will in fact get the DP.

Wow. I don't know. I think if I were Mr. MM I'd be worried that the first question from the jury would be...."Do you have an alibi for June 4, 2008?" jmo
I am so sorry to hear of your sister's death, and your long and painful experience. I cannot imagine the emotional pain and exhaustion, as a result of all of this.
It's downright sad the twists and turns out judicial process has taken.
With JA she will no doubt have books and a movie made. It's absurd. And yes, unbelievably , marriage proposals will come.
It is him, I am certain. Right age, location. He is in foodservice and has Jodi's little sister in his friends list. He has a photo posted of a view off the deck of Ventana- (I think thats the name)- a restaurant that I think JA used to work at.
Give me a minute to cut and paste two very interesting comments from his page- one from a "Jodi" with her tell tale smiley face at the end.
Be right back...
Obviously she lied during voir dire so it would have been appropriate to send a note to the judge and I would think she would have been replaced by an alternate. I had a friend who was on a jury and one of the jurors admitted he lied and she sent a note to the judge. The judge asked to speak with her in his chambers without the other jurors being aware and the juror who lied was immediately replaced. This person was in the legal field so she knew it was wrong. I guess some people feel uncomfortable reporting other's but if jurors know it's wrong the court appreciates them reporting it. jmo
The stab to the heart? I happened to just hear the ME being questioned by the DT about the angle, and he said if it was upward, it was very slight.
MOO
You sure do get a feel for how much TIME she was operating with. That minute seems like forever! Yes he does look surprised in that one pic. I still think by the time he was sittingon the shower floor, she had some kind of weapon on him, threatening and ordering him.
The angle of the stab wound was upward though
yes she was not truthful during voire dire or she didn't take the question seriously enough and really think about it like the rest of us did. or she was so dumb she did not have enough intellect to understand the question at the time it was asked. i was upset with the foreman because yes he should have notified the judge. i should have insisted on it. could i have sent a note to the judge myself i wonder now? or can only the foreman send notes? i think as you do--the judge would want to know and i know the judge would have replaced her - we had 3 alternates standing by. this is one reason why juries scare me. there are some real limited people on them sometimes.
I am not sure what time, if any is on this photo, but I believe this is the moment when he became aware that she was THERE. I tend to think that he actually saw her to the door, and she left, but then she snuck back in.
Have you guys seen that this Matt McCartney has supposedly posted comments on the 'jodiariasisinnocent' site about how she didn't do it, she's so gentle she wouldn't even kill spiders?
I don't know if I should copy it here or let u guys find it via googling...
Interesting...could be how Travis ended up on the shower floor.I had something happen to me one time that was beyond terrifying
Before I knew it my legs gave out & I went down. It was caused by fear.
