Monday's court filing also stated that police had told Kaine that Terri's "sexual overtures to Mr. Cook resemble those made to the man Respondent (Terri Horman) attempted to hire to murder Petitioner (Kaine)."

In the original restraining order filing, Kaine stated that police had told him Terri had tried to hire a landscaper to kill Kaine.

Ok, well at this point, Terri was served with divorce papers right? So why did she lie to DDS using her daughter as a reason to get out of the house? Why lie at all? And really, what a drama queen, her whole life was discombobulated because that Kaine didnt know what her childs favorite blanket was, I mean that big jerk! What could he possible have on his mind? These texts were offered as proof of Terri's fitness as a parent and as far as I can see, only prove she's a lousy seductress.

I disagree.... it was in a court document as well... just because we don't *see* these similar sexts does not mean they do not exist. And at one point KH and his atty asked the judge to show them to him in camera.

Terri doesn't want all of this to "come out" just now. That is why in my opinion, she has dropped her current motions.

We also do not know what all the judge has seen in camera... and what has been shared that we are not aware of. There is simply not enough information shared with the general public to argue either way.

My stand, and my opinion, is that I am waiting for the other shoe to drop. It may be a while. But I will wait. I have seen enough at this point to tend to believe Kaine and what protection he is trying to afford his daughter.

Most all testimony entered into court is hearsay of one form or another. There is acceptable *hearsay* and unacceptable *hearsay*. Information received from LE about a petitioner's STB ex-spouse would probably be an example of *acceptable* hearsay.

These texts were between MC and Terri, which LE provided to both Kaine and Terri(through their lawyers). I'm guessing that the other texts actually are a part of an ongoing investigation(since we all agree that its not illegal to sext, lie to your friends or lawyers, or fake concern for your child when you want to go see a man, etc.) and thus not available for either Kaine or Terri's lawyer to use in civil court proceedings at the moment.

I have no idea what you are talking about, I am just trying to discuss the case, if the mods want to modify my post where I was responding to you I guess thats fine. I dont want to compare anyone with Terri, and actually I dont think there is anyone in known history that anyone can compare Terri to because I think she is going to be exposed for one of the most diabolical criminals the world has ever saw. I think we got a nice glimpse into who and what Terri really is with those texts, and I think even her lawyers saw that as well.

If these texts were meant to demonstrate that she is unfit for parenting time with her daughter, I do not see it, not at all. To suggest that there are other texts which WOULD prove that begs the question of why those texts weren't offered instead of these.

No, the text messages were only part of Kaine's logical argument. Kaine said that these text messages were the same types of messages that were sent to the man Terri tried to hire to kill Kaine. He does not want his daughter around someone who tries to hire people to kill other people by sexually manipulating them. He also thinks that the sexts show she is not responding the way most people would to the disappearance of her stepson.

He thinks all this shows that Terri may be mentally ill, which is why he wants his lawyer and the judge to look at Terri's medical records. And ask her to submit to a psych evaluation.

That's what he said in his motion that is related to the sexts. He outlines even more reasons in the motion, but I won't mention them because that is for another thread.

When Terri's lawyers see all these reasons Kaine has supplied to keep the status quo (no visitation), what is their response? "Never mind. Sorry we bothered you, judge. We'll go back to banging our heads against the wall. Maybe that will be more productive."

Well, thats your interpretation, but It also shows she lied about her daughter as a reason to go engage in whatever actions with a guy she had sent a picture of her naked body parts to. So the texts showed that, and it is wrong.
