Assistant District Attorney Amber Massengill delivered her closing argument to the jury on behalf of the prosecution. She asked the jurors to turn to the portion of their booklets that covered the definition of the burden of proof that must be met.

As an example, Massengill held up a large pad of paper with the phrase “Co_ _on Sense” and likened it to Wheel of Fortune. She told jurors they did not have to have every single piece of the puzzle in front of them in order to rest easy with their decision.

Massengill also told the jury that the words Scott used were not evidence, saying he threw out ideas to plant in the jury’s mind. She said Scott used ideas like tin foil hats and SIDS to throw off the jury.

Massengill told the jurors that while defense repeatedly mentioned Hunter Wood's name throughout the trial, no witnesses testified to ever seeing Evelyn with him. She referenced text messages presented in court, showing Wood had asked Boswell where Evelyn was and that he wanted the baby home safely.

Special Agent Marla Gray of the Tennessee Bureau of Investigation testified on Tuesday that Boswell’s fingerprints were found on aluminum foil wrapped around Evelyn’s head, as well as on the inside rim of the trash can where her body was discovered.

There’s not one piece of DNA that shows someone else did this,” Massengill told the jury. "Megan tossed her (Evelyn) away, literally, with the trash.

Scott brought out a roll of aluminum foil and tore off a piece, saying Boswell’s fingerprint could have been left on it from a previous use and also handled by someone else when wrapped around Evelyn’s head.

Scott told the jury that he wagered every one of their fingerprints were on their own trash cans so that did not prove Boswell killed Evelyn.

Referring back to TBI Special Agent Marla Gray’s testimony about DNA analysis, Scott said male DNA, while not identifiable, was found inside some gloves found in the trash can.

Addressing the prosecution’s claim that Boswell wanted a life without Evelyn to be with Wood, Scott noted that she did not neglect her daughter when dating her ex-boyfriend, Caleb.

Scott also mentioned Ethan Perry, arguing there was no evidence proving Boswell knew Perry was not Evelyn’s biological father. He recalled testimony from friends and witnesses who described Boswell as acting strangely and dissociating — potential signs of grief, he suggested.

He argued that the text messages between Boswell and Wood could be interpreted as a cover-up for both of their involvement.

In regards to the fingerprints, Harper said the most likely person to have handled the foil and bag is the person whose prints were found: Megan Boswell. He reminded the jury that no other fingerprints, including Wood’s, were found on any items, nor was any DNA found that could have potentially tied Wood to Evelyn’s death.

“It was an intentional and knowing murder of a child,” Harper said. “Megan Boswell got rid of Evelyn so that Megan could be Megan. And she enjoyed it. You’ve seen the pictures.”

He vehemently reminded the jury that the foil was tightly wrapped and pressed to Evelyn’s head and the amount found proved the intent behind its use.

“All of this could have been avoided, but Megan Boswell only cares about one person, and that’s Megan Boswell,” Harper said. He added that others, including testifying witnesses, would have willingly cared for Evelyn.

To side with the defense, Harper argued, would require jurors to ignore evidence.

“She sits here in this courtroom guilty as she was back then because she never learned the lesson that we all know: you are responsible for the actions of your own life,” Harper said.

“We gave it a lot of thought and at one point were leaning toward doing it,” Boswell’s attorney, Gene Scott, told WJHL. “But after the medical examiners testified yesterday, I don’t feel the state’s proved their case at least as the cause of death, and we don’t feel it was necessary.”

“The boyfriend, Hunter Wood, is unavailable. He is in a mental hospital in Virginia,” Scott told “Banfield.” “Both the state and I have tried to obtain his presence,” to no avail.

At any rate, Scott added, “He wasn’t there when the child died. He couldn’t say, one way or the other, what happened to the child.”
 
If we don't get a verdict tomorrow, I think we will be in trouble.
I have Casey Anthony stress disorder. The fact that they can't say for sure how she died concerns me. That was one of the main reasons Casey Anthony was found not guilty.
I loved that the prosecutor told the jurors to use their common sense and look at all the other evidence that points to her guilt. Her constant lying and so on.

If MB knew for sure that EP was the biological father, she would have been all over him for a paternity test and benefits. With him in the military, Evelyn would have free health care and guaranteed child support, among other things. MB knew that the paternity test would show that he wasn't the father, that's why she only asked for a few dollars here or there.

So her attorney spent most of the trial and closing statements implying that HW was involved with this, but then admits he wasn’t there when the child died? I had to read that article 3x to make sure I was getting it. WTF?
 
If the judge outed a juror, is there a mistrial risk?

DOB 11/21/18) (last seen Dec. 10 or 11, 2019 by babysitter, Blountville, Sullivan County, reported missing Feb. 18, 2020 by State of Tenn. Dept. Child Services; Evelyn’s remains were found on Mar. 6, 2020 at a family member’s property at the 500 block of Muddy Creek Road in Sullivan County; officially id’d Mar. 11, 2020). *Megan “Maggie” Boswell (18/now 23) aka Maggie Wood aka Megan Nicole Kys “mother” arrested & originally charged (2/25/20) with 1 count of false reporting. 2/12/25 Wednesday, Trial Day 7: *Deputy DA William Harper said the state sought to introduce an involuntary order from a court in Virginia that ordered a mental health evaluation of Hunter Wood. Harper also entered a letter from the Southwest Virginia Mental Health Institute stating that Wood had been involuntarily committed & the State rests their case.
*Boswell’s attorney, Gene Scott, moved for a judgement of acquittal of charges & went through the counts for Judge Jim Goodwin.
Scott maintained there was no proof of pre-meditation in Evelyn’s death & said the medical examiners were unable to give specific causes as to how the child died. No evidence of child abuse, witnesses testified the opposite - that there were never any signs of abuse. Prosecution state that premeditation is shown through the physical evidence, ie: Evelyn being wrapped & stuffed in a trash can, along with the aluminum foil around her head.
Judge denies the motion with regard to all counts. Defense says the defendant will not testify. Defense rests their case.
*Judge Goodwin informed the jurors that Dr. Darinka Mileusnic-Polschan’s “parting shot” at the end of her testimony, in which she said Evelyn “could have been murdered a different way” was not to be considered. He told them that murder is a legal term outside of her expertise. Scott then informed the jury that the defense rested its case. Judge read jury instructions (81 pages).

*After Harper’s closing argument, Judge Goodwin called both sides to speak with him. He then continued to deliver the last of his instructions for the jury as they prepared to deliberate. Alternate jurors were informed of their status & Goodwin sent them from the room. Once the alternates were dismissed, the jury was comprised of seven men and five women. The court then entered a recess until the jury reached a verdict. Shortly after 6 p.m., Goodwin called the jury back into the courtroom & sent them back to their hotel for the evening. Total 3 hours of deliberations.
Trial continues on Thursday, 2/13/25 with jury deliberations.

I'm sorry, he said Hunter wasn't there?! Didn't he try to give credence to Hunter rolling on Evelyn?!

I've been following this case since just before the trial, but am a long term lurker here (hello!).

It seems a no-brainer that Megan is going to be found guilty, but after seeing some of the comments about Casey Anthony, and Collin whatshisface, I'm super anxious she's going to walk. State did a fantastic job in closing arguments, though - the evocative comparison of the hiking photo compared to playhouse isn't something the jurors will be able to forget anytime soon. The Defence on the other hand... he really didn't have much to work with; everything was either farfetched or offensive. Calling Hunter crazy will hopefully backfire with the jurors, and no doubt they're just as sick about tin foil hats as we are!

His comment about knowing the Boswells made me look them up; I hadn't realised they were such a felonious family. Between Angela being on meth and stabbing Tommy snr in the neck with a pen, and both Tommys getting probation for attempted murder of one of Angela's lovers, yes, Megan would have been privy to some things growing up. But then, where was the psychologist explaining she was a product of her environment, or that 'having fun' was actually a reasonable response to loss of a child? It's all super wishy washy, and I hope the jury see it for the joke that it is.

Speaking of Angela, does anyone know where Megan's mum is at this point? Is she still in prison? I kind of figured she'd be called up to tell the jury she hadn't been babysitting Evelyn at all, indicating she was left alone when Megan worked (bolstering the child abuse claim).

I have never been so invested in a trial before, or feel my usually placid personality dissolve. I literally feel like (sorry if this causes problems, admin) part of Megan's prison sentence should be spending time upside down in a bin every day, preferably wearing soiled nappies, so she knows what her beautiful daughter went through. No sentence is really going to make me feel satisfied that justice is served, but I cannot bear the thought of her getting away with this. The wait is unbearable.

Maybe it wasn't possible, but I really would have liked to see one day lined up, first week of December, before the lunch with her friend, where they could put MB at work, E at work, MB's mom, sitters all accounted for, to show that no one had Evelyn. IMO she was babysitting herself. In her baby swing. (Some parents resort to this, leaving children unattended. It's always illegal, but it's so especially egregious in MB's case because she had options.) At first, she probably left her alone for her shift. But then she started hanging with HW, and Evelyn was alone for longer and longer amounts of time. Then overnights with HW. When did those start? How long did Evelyn survive those conditions? Days? Weeks?

A diaper rash isn't criminal. In fact, it's not uncommon. But IMO Evelyn's diaper rash is the turning point and it coincided roughly with MB being hired. So sad to me that no one dialed MB into community services. Surely there would have been resources available to her as a teen mom, no? And a search for the dad for child support. In any case, where was the Desitin? Did MB even try to heal the diaper rash, offer Evelyn any relief? Seems like MB made two really bad decisions at once -- she stopped taking Evelyn to sitters/pediatrician so she wouldn't be reported, and she started leaving Evelyn in one diaper for 8+ hours. I can imagine how quickly that would ignite a diaper rash. Ouch ouch ouch ouch ouch. That poor baby.

Meanwhile, MB got a taste of freedom. Not a mom anymore, in practice. Easy to tell stories about where MB was, the exciting storytelling of a custody battle, drawing sympathy to herself, neverminding that none of it was true.

We can't even be sure now whether she manually murdered Evelyn or just left her to die, upside down in a trash can. Tinfoil, blanket, trash bag, trash can. WHO DOES THAT?

AND WHO piles half her garbage -- including her own baby -- in a playhouse 50 feet away????? Thank God she was too lazy to hit a dumpster, but my God, how does her brain compute? She didn't think anybody would look there EVER?????

One might have launched a diminished capacity defense here. She's just not that bright, she's ill-equipped for responsibility, with decision-making skills of a feral seven year old. If I draw all over my dolly with a black sharpie and hide her under my bed, no one will ever know what I did.

I wouldn't put her in charge of a plastic goldfish.

And who thought it would be a good idea to leave her unsupervised? With no check ins? Yikes.

Poor Evelyn. That poor child. Neglected to death, and worse.

The jury will do a favor to convict her. Nice, controlled environment for her in prison. She can make a life for herself there. Schooling if she wants it, privileges if she can manage not to lose them, food service, trash service, full time babysitting (staff babysitting her), limited decisioning, and most importantly, zero access to children.

Keep her removed from society.

Make her keep her cell clean for once.

And if she's cold, give her Evelyn's nasty blanket so she can smell that every single day, as a reminder of the two lives she threw away.

I'm hoping that they reached their verdicts last night, intend to fill out the verdict forms this morning and will debate whether or not to have a last lunch.

I don't know that I've ever seen a singular car with so many charges before so IMO the jury would have to work really hard to acquit her on all of them.

If a parent leaves a helpless child unattended, and baby dies of general neglect, that parent IMO is guilty of murder. Premeditated because a reasonable person would know that could prove deadly, a baby can't save itself. Parent could be charged with that death even though they weren't even there when the death occurred.

It's the tinfoil.

The tinfoil takes away reasonable doubt for me.

MB was closely associated with the event that found Evelyn upside down in a trash can, in a house/playhouse no one else was visiting. And why? Why tinfoil? Tinfoil on a dead baby? Make that make sense. Tinfoil on a living baby? If it's there to impede breathing...

The MEs ruled out virtually every other thing, every natural and unnatural cause of death. So what caused this otherwise healthy baby to stop breathing?

How she was found answers that.

Now for the jury to get there.
