I love this witness. She just schooled the defense. No more sids, it's proper name is sudi

"I believe she died in the trash can."

  • #343
Now on cross.

2nd ME did not do the autopsy, only reviewed the feedings.
MB is done. stick a fork in her ! this pathologist is amazing

Devastating witness.

All those components imprmeded her breathing. Foil, blanket, bags, position.

Judge directs ME to answer the question:

Can you say she the child wasn't dead before?

Judge gives second instruction.

And he asked because now he's got to change the way his pathologist speaks because if they say SIDS now she's going to look stupid...

Judge will put her in contempt of court if she answers without yes or no.

  • #348
I wonder how this is going across with jury.

  • #349
She was a great witness.

  • #350
Answer is no, she could have died another way.

  • #351
Jury is recessed until tomorrow.

I do love the determination of this witness to declare murder

  • #354
A great way to end the day!

  • #355
Oh, I thought it was over

  • #356
I am physically ill

  • #357
I thought the judge was dismissing the jury

  • #358
That was rough.

But I think it stands.

There is no obvious explanation for Evelyn's death. Outside the context of tinfoil, blanket, trash bag, trash can. And one you factor for those, you have an explanation for her death.

She couldn't breathe.

Why would anyone take the time to put all that tinfoil on a dead body?

And if she was already dead before the tinfoil was applied, then how did she die? 2 independent MEs found no underlying explanation for why this healthy baby would be dead.

Not being able to breathe is what's left.

I had promised myself no more child cases and will go forth with keeping that promise once justice is served for Evelyn. This case tears at my heart as no other, for I lived in Sullivan county while it was happening. I know the investigator that found Evelyn, although at the time of discovery I did not know he was personally involved. The 2 weeks from the announcement of a missing child (2 months after she was actually seen alive) until she was found were horrendous, with all the news interviews and changing stories MB told. It was heartbreaking when she was found, but not unexpected. LWP is too good for this monster
