See, here's a problem. Beth says if the Judge allows it, expert will explain the difference between instrumental homicide and reactive homicide, which Beth says is the difference between first and second degree murder. Beth says this is for the Jury to determine, not an expert. But, if the Judge allows it, he will say the PTSD only shows up in reactive homicide and she has that, therefore this was not premedititated.
Earlier in the day when JM was objecting to the new things this expert brought to court, I heard discussion of how the messy crime scene shows it is reactionary homicide because you wouldn't expect that in premeditated murder.
I keep saying, imo, this messy crime scene was because the gun jammed and the plan went wrong--but now you can see some of the implications of a knife first homicide. Prosecution has to address this, imo.
