trial day 42: the defense continues its case in chief #128

In what defense expert witness textbook does it say you should be snarky & combative toward the prosecutor? If you did your job, the facts should stand for themselves & withstand attempts to discredit by the DA. Unless you fudged a few things on your CV to start with...

I so agree with you, Holly:rocker:

Just heard the Jodi--Einstein IQ thing for the first time.

To whom did she say that and when?

There was another time today when JM was asking ALV a question and she looks at JM. JM shakes her head 'no' and ALV immediatley answers the question 'no'. That to me was much more noticeable than the hair thing.

I agree, but you mean jW, not JM...

JM either received some great advice about "toning down" or he took some kind of "chill out pill" today, was somewhat refreshing....Guess we'll see tomorrow if it's still the same, didn't seem to work for to many days in the past....Ready for this trial to be done, jmo

When I was a juror on a felony assault trial, I felt like the defence attorney was constantly in my face in the front row. I hated it, it made me crazy.

We acquited the defendant. Which just goes to show that the attorney's style may not be an issue in the end.

They did not make it real specific, but I think it was in the notes that were given to ALV by the previous people who assessed JA and then bailed. :giggle:

You are so right - The jurors know what she is up to with her condescending "Mr. Martinez" every-other dam word out of her mouth (as she rolls her teeth around in her mouth each time - just a visual moderators - I think that is one her nervous twitches if you may). Makes me sick.

And this affects the jury how?

"Guideline 2.1(C) which mandates that counsel be able to operate in an environment that allows them to provide zealous advocacy, Guideline 4.1 B(1) and B (2) which mandates that Ms. Arias receive the effective assistance of experts. As the facts above indicate, counsel for Ms. Arias cannot meet the dictates of these guidelines when defense experts are being harassed inside the courtroom by the prosecutor and outside the courtroom by those who chose to mimic his behavior in other public forums."

MOTION FOR MISTRIAL;
INABILITY TO PROVIDE EFFECTIVE ASSISTANCE OF COUNSEL
DUE TO PROSECUTORIAL MISCONDUCT

The DT has the audacity to behave just like the thing they're being paid over one million dollars (so far) to defend...

They are BLAMING & CLAIMING
Someone else..... for their lack of expertise..
And THAT is why they supposedly can't do their job..

The reality is.. the DT knows the last view of the SS Arias is quickly disapearing from all sight.
They just don't realize...
When one finger points.. Three point back.

Heck ..NURMI wanted out a looooong time ago and so IMO, This is just one of his lame attempts to now cover his own butt and try to avoid being thrown under the bus by JA herself in her many appeals to come.... Just like Michael Skakel is doing to Sherman now.

Also...
I am shocked that there are people in this world who are in such denial and are, what seems like, literally brain washed & living in snowglobe worlds...
I was looking up the recent motions filed and clicked on one of the defendant's sites.. I am appalled and really disturbed at the vulger.. nasty sexual things they are writing about JM.. I mean really, really disgusting things. The FB site is no better. They're both making gross, rotten comments about JM in derogeratory sexual ways and comparing his private parts with food. It's downright disgusting and rude...

The motion for mistrial claims unacceptable behavior in public forums as one of the reasons the DT supposedly can't do their job... yet these pro defense sites are doing JUST THAT!!!
That to me is hypocritical.

IMO This newest motion is also an attempt to throw the judge under the bus citing her previous denials on all of the DT's motions for mistrial.

I am proud of Juan's accomplishments today. He very eloquently crushed ALV's credibility and was able to extract under scarcastic circumstances very crucial information about JA's stalking, lies, etc.

TA's cry for help was sadly loud and clear today..
Juan is TA's voice.

ALV has CONCIOUSLY CHOSEN to not hear him.
I believe in my heart the jury clearly heard TA's fear today.

Tonight's prayers will definately include a clear vision request for alot of people trapped in snowglobes...

Maybe if she'd answer a question straightforwardly, she wouldn't be feeling "the wrath".

Wow. it's 1:00 here and my eyes are getting blurry, but I have one question for everyone:
Did anyone hear JM thinking she was the judge (when JM was talking about the books that AL gave to JA). She objected about something or other and the judge said "overruled" and JM said what I thought was "sustained". I could almost see her stomping her little feet like a spoiled, petulant child. Is JM thinking she's the judge now? Did anyone else hear this or I'm going coo-coo?

I have a question, I hope it doesn't get lost in the shuffle, this thread moves so fast...

One thing that Martinez brought up was Arias' self image was within a "normal" range. Laviolette kept correcting him by saying "the test was given two years after the fact" she said this a few times, to me implying that Arias could HAVE suffered from low self esteem when with Travis, but has since recovered.

Is it just me, but if someone is a victim of DV... do they really recover that quickly??? I assume that low self esteem goes hand in hand with someone who stays in a violent relationship, but it seems like two years is a quick recovery for something so traumatic in regards to self image. I know YMMV with people, but that just struck me as odd, or am I overthinking it?

I'd like to know how a woman's self esteem improves after two years in jail on a murder charge? I would think that it would sink rather then improve.

If either of them were tied up, wouldn't they have taken a picture of it? Seems like an interesting picture if you re taking sexy photos.

She claims her wrist were tied. She claims she slipped her wrist out of the rope and then they proceeded to take pictures. There was no rope in the background of any of those pics. A big fat lie told in order to explain why there was a knife in the immediate area. She claims she threw the rope in a dumpster. Theres no way she discarded evidence all around town. I believe its all in one bag along with the 4 missing floor mats from the rental car.

Just my opinion, but I think Nurmi & Co. filing all these motions today proves that the DT knows that Juan is annihilating their "star" witness.....:great:

Thank you SyraKelly - I hope that you are able to "read" Arias' lips.

Apparently after Arias takes a sip from her white styrofoam cup - the camera is close to her mouth when she makes a statement. If anyone can read lips - they should be able to tell what Arias says around 6:57pm EST after drinking from her white styrofoam cup.

I am very curious to find out if anyone knows what Arias said - I was told that Arias says something very rude and aggressive about JM.

Arias and her defense - IMO - would understand that The State is doing their job. There is no need to be hostile - in fact Arias tells Det. Flores if she did murder Travis Alexander she would beg for the death penalty. If Arias was a victim of abuse and murdered out of self defense - then I would think that Arias would be very solemn.

LaViolette is going around in circles - she tells JM that she tested people when she was an undergraduate - then LaViolette tells JM that she is unfamiliar with testing.

LaViolette seems as genuine in finding the truth as Arias was when Arias was speaking with Det. Flores.

I explained in the passed why I thought she hid the gun ect. In Crater Lake Park. After that. I learned that MM worked at Crater Lake National Park. I wonder if she had any assistance? She drove over 2800 miles.

Oh I love this point. When LV challenged JM, saying, "Are you angry at me", JM asked, 'does the prosecutor's anger affect your evaluation'? Really first rate point!

If you are a professional, how does that change your testimony?

well u know jodi - always defying the odds - always the rarest of rare exceptions.

Is Amy the one Jodi was a bridesmaid at her wedding?

No, that was JA's friend, Patty. KCL pointed Amy out one day in court. She
has long, dark hair. Her top was showing one whole shoulder. I believe she was chewing gum. She looked like a rough character to me. JMO
