Roux seems very rattled today.

Roux wants to ask about photograph NOT taken by witness. Argument being heard.

Judge: You are not suggesting this witness should know about it?

Nel is fighting this one. 'Evidential value is not good'

Judge overules. 'Witness may know something about them....let's hear what Mr Roux has to say'

now these photos are NOT in the album, objects Nel...

this witness didn't take these photos.. . they must be photos produced by the defence.. have nothing to do with the states case..

now roux says they are photos produced by the police..

ahah.. this will be hereinafter referred to as the cranky part..

the judge says.. you are not suggesting this witness should know about it??

Nel up.. now. . will you test this witness as to whether he took this particular picture you question him about??

the judge says. wel either this witness knows about it, or doesn't. .

the judge says..lets hear what Mr Roux says..

roux says these photos will become relevant..

ok, says the judge.. proceed and show relevancy.

WTH? VS is now being questioned by Roux on photos he did not take and has never seen and the judge allowed it!

VS wants to know what album it is from. Roux says it's not from any and asks witness to 'assume' it was taken at 6 something time.

Craaaazy.

Travesty.

It's a photo of gun on towel. R says it is quite different from VS' photos of the gun.

R: Are you sure you were alone up there?

VS: I am sure of it.

R asks if VS' commander was at the scene. VS says he was, but adds he was not 'with me at the top as far as I can remember'

I think Roux picked that up in Afrikaans. Don't think translator translated the 'As far as I can remember' comment.

Roux looks and sounds very smug......as if he knows something no one else does.

Witness not looking worried.

Now R onto pics taken by Col M from 5.56 in the morning. 'Do you want to say anything about?'

VS: Milady I cannot comment on that.

Van Stad cant see either of them.


roux.. the mat is in a different position.

ok. Roux wants to be sure , was van Stad REALLY alone up there taking photos??

I am quite sure I was alone taking the pics..

another colonel flits across the testimony. a colonel mutafeeka..

was THIS colonel up stairs?? when you said you were alone??

this colonel was at the scene, but was not upstairs when I was taking pics..

I was alone, when I was taking photos.. as far as I can remember, this colonel was at the scene, but not upstairs..

this is rather diff to follow... whats coming across is, Roux wants someone upstairs.. a great overlap between Van Stad and Colonel Mutha.. that you said you were alone, but there were times when Colonel Mutha was upstairs, overlapping with you taking pics..

Van Stad says.. the time clearly says when photos were taken.. this is incorrect..

VS: Okay then Milady, we have to look at all the photos, to see when that was taken, when this was taken...

Roux kinda brushing that prospect aside.....

Roux wants someone moving that cricket bat and coating it with blood on both sides, I reckon....

R trying to pin down VS to saying pic 83 at 6.05 was the very first photo in the bathroom.

VS once again counters that they will have to go through time of every single pic in order for him to answer that. Roux agrees, asks when he would like to do it, but then glides over the point. He has 'a document' with a timeline summing up the photos, he says. But can't find it at the moment. Later....

I am curious as to how Roux will put it to the ballistics expert.....ha

I have never seen anything like this kind of dispute over forensic photos, taken by state witness.

VS will not, cannot be rushed. He refuses to be backed into a corner.

Roux is sounding so angry and accusatory and aggressive towards this p[hotographer, while he goes over the timeline. I think he is bluffing though. I don't think this guy did anything wrong.

Makes you wonder if the blood spatter expert has some pretty stunning evidence re: the bat that Roux is trying to discredit in advance.
