a real estate license here in Texas is outrageuos like 25 years ago it was 500 a year and you might need some sort of insurance too I just know unless your seeling I wouldnt want to pay it year after year for nothing.

As for nursing, at one time here in Texas they were so hard up for nurses I had a kook client who had all kinds of drug charges etc and she still got a job wherever she wanted even got to pick her schedule. I dont think it is like that now but in the 90's early 2000 they would take any nurse they could get. Now with all the public criminal records hospitals are being more picky i guess due to liability.

As an attorney you know that cross follows. Assuming you have no crystal ball I would wait for cross so as not to acquire foot in mouth virus.

I agree with that 100%.I think it's better for them to stay put and slam his sorry azz on cross, rather than be seen as a constant objectionobjectionobjection team. So far the prosecution has done quite a good job, or so I think.

Right, he's trying to make it seem that Tammi was so nice and concerned and approached this gal for that reason alone.



As an attorney, I disagree. I find this guy to be sleazy, but in my experience, many would not. Juries are gonna' love him. He can control his emotions much better than Tammi and he is doing a great job (or rather, the defense is doing a great job, through him) of normalizing what is actually bizarre behavior on the part of Tammi and what appears to me to be nefarious and desperate motivations to get a baby and keep Gabriel from his father.

He's painting a rosy, normal, loving picture and a lot of this could be avoided via hearsay objections, calls for speculation objections, etc.

I understand what your saying I just hope the jurors are NOT falling for it. I am hoping the prosecutors will show his true colors in their cross. Although if the jurors fall in love with him then the prosecutors will look mean. They will need to be very careful.

Good Lord ive lost count how many kids underage kids do they have? A brood LOL and they want gabriel too..geesh,,the one thing that crossed my mind was a tax write off!

Why would they let it go through otherwise? What's your take on this, as a lawyer?

Too busy writing down notes for cross, not that good, not that worried because they aren't that good, I don't know.

I think the defense is doing some real damage with this salesman, to the prosecution's case.

I just hope they have great rebuttal witnesses. People who can completely refute the picture of what he is saying.

Problem is, it has been established that EJ is a nut and a criminal. The jury can choose to blame everything on her and find this hapless couple simply were duped. Logan's criminal background has come out so the jury may view this couple as really seeing Logan as the bad guy (poor EJ was so scared of him!).

But, has anything come out about Tammi's bizarre criminal and other history? Past forgery? Theft? Bigamy? Operating without a license? Etc.? Because normally, evidence of a defendant's past character can't come in.

Granted, they may have opened that door when talking about the foster-adopt agencies they went to. Let's see if the state walks through that door and if the judge will let them.

Interesting why would he say "personally no we did not go by the trailer"? Then who did he send to the trailer?

Why would he want Gabriel to stay the night before Logan's visitation, with the mother who admitted she had not bonded with Gabriel and who wanted to give him away to strangers? Why would they not jump at the opportunity to meet Logan and conduct the exchange with him? Let's see if the state explores this.

What did he say about Tammi's other kids?

I think it's more about what he didn't say. He made it appear that they were one big happy family, with one of the kids staying at their house several times during the last few months. No mention that Tammi abandoned them, instead he rattled off names and ages and said something to the effect that they interact with them.

Sleazy is the right word. The more he talks I do think he's giving the prosecution a lot of opportunity to grill him like a cheese sandwich. He's too vague about some things, and then way too detailed about inconsequential stuff.

I think EJ is just something I can't say here - but TS and JS aren't much better.

Logan would pick up Gabriel to EJ to exchange child for Logan's visit on Sat morning. . . . JS said no he would not get the children up @ 5:30 am to have the children @ 8 am in Tempe. JS wanted EJ to sleep with Gabriel that night (weird sounding statement to me?!)

They had already planned on deliver product . . . met at the Glass and Grass Church on McDonald . . . assume EJ picked church with a big parking lot. Logan was his Father he is supposed to be with his father!

Last time dropped Gabe off was with EJ . . . didn't know EJ was going to leave the State, during the 8-9 days they had started bonding with child, he was whining and whimpering and wanting to be back with Smiths when handing child over to EJ. EJ had no cell phone - landline - called her home and left msg on answering machine . . . left another message a little later on Friday evening - within a few hours. Tammi might have called EJ twice and left messages and didn't hear from EJ that night. EJ was not home she was out somewhere . . . concerned for what going on for the child. Smiths called again that Sat. morning - didn't reach EJ - left 3-4 messages on Sat. More messages on Sunday . . . increasing aggressive messages - if you have gotten back with Logan just tell us and we want to know Gabriel is okay. Did not go by the trailer . . . it was way out of the way . . . they had no means of contactng Logan. Didn't have a phone . . .no idea how to get ahold of him . . . went to Logan's place of work on Monday. TS came downstairs completely dressed . . . we gave our word we will meet him @ 8 am to meet Logan - went immediately to the trailer - no one came to the door.

Smiths went next door to neighbor - no answer there - no other trailers across or on other side of her. Went to Denny's and had breakfast. Back to trailer to no avail. Only other option was to see if find the Father. They remembered EJ's filing response to Logans allegations (a PO Box). . . look up 99 cent store in Tempe where he worked part time. (ETA . . . What? didn't LE call them to tell them first night that EJ was @ Logan's employment? How did he get a 99 cent store from a PO Box?)

I believe this is a CYA moment. In reality, they sent EJ on her way to pack and get going on the trip they all planned. That would be hard to do if Gabriel was at the Smith's house and needed to be passed off to Logan the next morning.

IMHO - Jack and Tammi knew exactly where EJ was going. It just didn't make sense to keep Gabriel at their house for the plan to work.

Having experienced enough trials, I'm not worried about foot and mouth disease! LOL. I was taught, and experience has proven to me, that it is much more effective, in certain situations, to forestall or interrupt the rhythm the other side wants to create, than to try to make a now likeable witness look like an a$$.

They really allowed this guy to paint a positive picture of Tammi's motivations and actions. I hope they can undo some of that damage on cross but letting that happen to begin with, when it can be prevented, is very risky.

How can he demonize Logan when he never met him? Yet, he mentioned earlier that the reason they kept Gabriel after LE saw he was safe due to a domestic violence call due to EJ's behavior???

That would have sent off alarm bells that she might not be telling all the facts about Logan. Fact is, his own wife is no better and I wish the jury could know about HER record!
