"The state needs to "pay" for my son".

Seriously? What type of lawsuit and liability does the state have in regards to this situation? Yes, it is terrible that her son was murdered.

Is the Dallas PD responsible for every single action that an officer does while off duty? If an officer discharges a gun off duty, is the Dallas PD financially liable for the damages? Is the State of Texas financially responsible?

Yes, the woman who shot Shem Botham Jean is responsible, and needs to pay for this action, she is responsible for her actions.

I don't see how the Dallas PD or State of Texas is responsible.

Guyger definitely needs to pay for this (the punishment should fit the crime) and MOO I think she made a big mistake getting into the LE profession.

My condolences to Jean's family and friends.

IMO they're responsible because they're treating this like an officer involved shooting. If they weren't, she would have been arrested and in jail by now---just like anyone else.

The viral photo shows the perils of Internet sleuthing culture, where the rush to publish unverified, speculative information can lead to a phenomenon through which others assume it’s true because they saw it on social media so many times. The Internet got some things right too; other photos circulated of Guyger are in fact her, and many people on social media shared Guyger’s name as the officer who shot Jean well before traditional media and the police did. However, in the case of the viral photo, many people on social media were just completely wrong.

Jean’s death has renewed calls for policing reform and places the national spotlight back on a police department that, just two years ago, lost five of its officers in a shooting. A lone gunman who “said he wanted to kill white people, especially white officers,” opened fire in July 2016 in the middle of what had otherwise been a peaceful protest over police shootings.

Hall said she did not know whether race was a factor in Jean’s death.

The Texas Rangers have postponed seeking a warrant on manslaughter charges against an officer who shot and killed a man in Dallas, police said.

From this link. Is this the 'commotion' that has been mentioned? If so it happened after the shooting.
______________

Alyssa Kinsey, Jean's next-door neighbor, told CNN she was home on the phone Thursday night when she heard a shot. She said she then heard what sounded like "running steps" and a female voice calling the police.

Kinsey said she could see from her patio that the lights were turned on in Jean's apartment. She said she heard more footsteps outside her apartment, a woman's voice and a commotion.

Thank you so much. I’ll be watching.
I notice the use of “unlawful use of force incident” which it most certainly is.

Wow. I missed that part and now that I think about it, another poster gave us that info. My speed reading isn’t what it used to be. Thanks for noting it.

Me too, but where I live the police have to sign for their guns at the start of their shift and sign them back in at the end of the shift.

I suppose it can be different rules for different law agencies. Although I have never heard of officers having to turn their weapons in at the end of their shift. I guess a tiny police department could have that policy if they didn't have enough firearms to go around.

But in our country each officer is assigned a weapon and they are to maintain possession of that weapon at all times/24/7. Even retired officers that I know always carry their weapons when they leave their home.

Police officers can be targeted at anytime even if off duty. Off duty officers have been shot before.

Officers have been targeted by someone they sent to jail or prison or by disgruntled ex felons. Off duty armed officers have also stopped crimes from happening due to them being there or in the vicinity of the unfolding crime.

Even when our grandson comes to our home for cookouts/visits while off duty he is required to have his service firearm on his person although usually under his shirt out of sight. They are subject to be called in at any time if the need arises.

However there is no excuse for this happening to this fine young man. They are taught to be aware of their surroundings at all times..even when off duty. She should have known this wasn't her own apartment. Fgs..she had lived there for a month...not a few days.

It sounds like to me she is the kind we are seeing so often today. Like people who seem to be zoning out while walking mindlessly while so engrossed in their phone. They don't think of their surroundings or even the dangers.

She wasn't paying attention. She should have been. Now a beautiful life has been taken because of it.

I believe she will be convicted and sent to prison..rightly so. I am still very pro police but I have never supported those who should be punished.

I am actually glad to see the Texas Rangers in charge of the invesigation. Imo it would be unwise for it to be done by the Dallas police department who had 5 officers murdered and several injured. This way it will take their department out of it altogether.

Yeah, I don't understand why she isn't already arrested on manslaughter charges. It's been only a couple of days, but still....

As others point out- if it's determined later that charges should be updated, they could be. There is no doubt that she killed him for no reason and acted in a reckless manner. That is the minimum of what she did, if nothing else is found.

Peepholes are in fact required by law in Texas. It's on the door knocker.

ETA: Required on apartments.

Same rules applied to my father when he retired from LE - he kept his police revolver locked up in his closet. There was no "sign in" procedure, as he always had it with him - and locked up in the same closet when he was at home.

And to be totally honest here: Guyger is not a LE member I'd want protecting me, she was not mindful enough of her duties as a LE member. MOO

On Saturday afternoon, Dallas Mayor Mike Rawlings and state Sen. Royce West held a press conference. They asked for Dallas residents to be patient as they work to figure out what exactly happened Thursday night.

“Is this a white on black crime? Yes,” West said. “It was a white, female Dallas police officer who shot and killed a person from St. Lucia of African descent. Is this a race-related crime? Don’t know. I would hold any type of decision you make on what happened until all of the facts come in.”

He said the door was open and the officer was able to get inside the apartment.

“We need to find out whether there was a personal relationship,” West said. “There are so many facts that need to be looked at before determining what kind of homicide this is.”

All of this is very interesting.

The same Senator attended the press conference with the Mayor yesterday and said they needed to determine if there was a personal relationship. While the attorney said there wasn't one. So they seem to be in conflict, yet are holding a presser together today?

The attorney is ALSO calling this an "incident" which I find interesting. I would expect him to at least call it a homicide. Even Senator West did that during the press conference yesterday.

Now I am going to hope that I can actually watch this one. I planned on watching yesterdays and when I walked in the house I had a flood to deal with. Hopefully things stay calm today.

Local pastors, are planning an "event" on Monday afternoon for Mr. Jean.

Local pastors association voicing ‘grave concerns’ over killing of unarmed black man

I did some research on Mr. Lee Merritt, he is actually not licensed to practice law in Texas. He is a federal attorney, licensed in D.C. Apparently he has been involved in many cases, representing families of African Americans, who have had situations with the police. His background is quite interesting.

I was just going to ask someone with more time to do just this, I hope he has the best interests of the family in mind.
