Amber Guyger Botham Shem Jean Police Shooting: Tragedy Shows Need for Cops to Face Impartial Justice | National Review

[...]

Aside from the horrific details of the shooting itself, there are already troubling indications that Guyger’s identity as a police officer is providing her with actual, undeserved advantages in the prosecution of this case.

First, police sources are reportedly indicating that Guyger may actually try to raise the fact that Jean didn’t obey her commands as a defense. It’s not a defense. The moment she opened the door to an apartment that wasn’t her own, she wasn’t operating as a police officer clothed with the authority of the law. She was instead a criminal. She was breaking into another person’s home. She was an armed home invader, and the person clothed with the authority of law to defend himself was Botham Shem Jean.

Which brings us to the second troubling element of the story. So far, Guyger is only charged with manslaughter. But all the available evidence indicates that she intentionally shot Jean. This wasn’t a warning shot gone awry. The pistol didn’t discharge during a struggle. She committed a crime by forcing open Jean’s door, deliberately took aim, and killed him.

Snip:
Texas law defines murder quite simply as “intentionally or knowingly caus[ing] the death of an individual.” Manslaughter, by contrast, occurs when a person “recklessly” causes death. Guyger’s warning and her deliberate aim scream intent. She may have “recklessly” gone to the wrong apartment, but she very intentionally killed Jean. There is a chance that the grand jury will increase the charge to murder, so the early manslaughter charge is tentative. But I ask you: If Jean had mistakenly gone to Guyger’s apartment and then gunned her down in cold blood after demanding that she follow his commands, would he face a manslaughter charge? End Snip.

He would be facing murder charges. No one would have believed his story about walking into the wrong apartment. It would be assumed that he was stalking her. IMO

And, if it is true that she knocked and called out to be let in the apartment, who was in the apartment that would have let her in? So many unanswered questions.
Well she had a dog

Snip:
"This could have been very different if Botham Jean had been, say he was a law abiding gun owner and he saw somebody coming into his apartment," Loesch said on NRATV's Relentless on Monday. "I don't think there’s any context that the actions would have been justified. If I see somebody coming into my house and I’m not expecting them and they’re walking in like they own the place, I would -- I would act to defend myself." End Snip.
NRA's Dana Loesch says being "a law-abiding gun owner" could have saved Botham Jean

I would guess there should be a window in this living room, and probably on the side behind the photographer.

So if there was ample street light outside that window, it might be possible to see a silhouette in front of it.

Exactly, if a person's silhouette was visible, so should silhouettes of furniture, indoor lights, decorations etc.

The affidavit seems to paint a picture of the victim as if he was setting a trap for her in the dark. Unbelievable. Then there was suggestion that he might be waiting for someone to arrive. That's why LE has taken his iPhone for examination. Looks like they are working very hard to find those mitigating factors, and they are not defence attorneys!

And this attempt to fault the innocent decedent for his own murder by LE is what will condemm this case

I am outraged that LE searched HIS phone and HIS apartment without probable cause when it was the killer”s phone, person, and apartment that should be searched

Snip:
The Dallas police chief is questioning whether pepper balls should have been used to control the crowd at Monday night's protest against police brutality.
"I am concerned to learn of reports that one of our officers deployed potentially several pepper balls during a demonstration last night," Chief U. Renee Hall said in a written statement Tuesday. "They are only to be utilized if instructed to do so by the on scene commander or if there is an immediate threat to the public. End Snip.

I've been wondering if we'd hear more about this use of force.

I am concerned to learn of reports that one of our officers deployed potentially several pepper balls during a demonstration last night. I have asked our investigative unit to conduct a full review. The use of pepper balls is governed by our General Orders, and they are only to be utilized if instructed to do so by the on scene commander or if there is an immediate threat to the public. I plan to meet directly with the leadership of the demonstration to address their concerns," Hall said in a prepared statement Tuesday afternoon. End Snip.

They keep going on about this being political, but it is not the death of this young man which is political, it is the way that they have handled it and the length of time that it took them to charge her and that was only done after political pressure.

That is right. But if she saw a silhouette of him as stated, he had to be backlit, not lit from the front.
This would mean she lied about this, too. I’ll bet there was no silhouette. IMO there would have been enough light from several directions to where there weren’t silhouettes of anything.

Yeah, why not a WARNING shot?

This woman should never be allowed to use a gun again, even if she’s released from prison at age 70

THAT'S WHO SHE LOOKS LIKE. Thank you. I legit lost sleep over this.
You are not nuts. I could not figure out why I disliked the woman when I saw her mugshot. That's not a normal reaction for me. Mystery solved!
