Well you are thinking about this like a lawyer. I am thinking about it as an average person (juror) who will not think about this in the same way as you are. They will wonder what he is hiding.

Understood. I do look at this through the lens of strategy, and planning, and I don't see anything that has happened so far that turns the case upside down. On the 5th amendment stuff, keep in mind, the jury didn't even know that HF refused to testify, so there's that. The judge wisely kept them out of the courtroom during that exchange and they'll never hear about it in court.

If the jury is allowed to go home, even though they will be instructed not to watch news or discuss the case with anyone, there is a real possibility they will find out HF was supposed to testify but invoked his 5th Amendment right not to do so. How would that be addressed, especially if several of them find out? Will the judge simply ask if they can put that information aside and listen only to the evidence presented in court?

Are the jury sequestered, if not it's going to be pretty heard for them not to hear or read anything about the trial, HF not testifying will be a key point from today.

He is almost certain to instruct them daily not to watch news reports of the case, talk about it, listen to radio news, or read about it until after the trial is done. That tends to have some results, but who knows. The better solution for the state is to keep the jury focused on the fact she was put IN HIS TRUNK and she's never been seen or heard from again. They really don't have to disprove anything at all about HF, only about EA, because even if HF was oddly the mastermind or had bad guys after him, it was still with EA right smack dab in the middle of it all.

Jurors are instructed to not speak to anyone about the case, read anything, on internet. tv, print. Or speak to other jurors until they go to jury room to do verdict. Can cause a mistrial (alt would have to be put in that juror spot) if any do and either side attorneys or judge/baliff, can be held in contempt of court, Huge No NO

Good point. However they would not be able to discuss with others jurors when making their decision. Hopefully if they do read about it they see that's he's just covering his own for the drug chargers

I don't post much, but have been following this case from the beginning. This is my understanding, as well. IMO, that's why the defense was fighting hard to have HF plead the 5th in front of the jury. Would have helped their reasonable doubt case. Even though it's not supposed to be considered, IMO it would have been. (Case in point, Mark Fuhrman)
