Defense can keep trying, but it will likely be an uphill battle with the Judge.Sounds very much like defense is desperate to find something overlooked or technically incorrect in the processing of the scene, as if to try to get a mistrial or KA released on a technicality.
It's early, but I'm not seeing how defense is going to argue that KA wasn't there or couldn't have done it. We haven't even received the autopsy information, and that is going to show 3 wounds, probably all 3 of which could have been fatal, and thus, overkill, not just defensive shots or those trying to cover up a robbery of a bicycle.
