Found Deceased TX - Thomas Brown, 18, Hemphill County, 23 Nov 2016 #4

I may be overthinking things, but the helicopter ride that lead to his truck seemed a little suspicious. We have seen things like this before with overly helpful friends that were involved, like the Skyler Neese case.

Did his friend know more? Like, where to look for the truck?

I have wondered about this. But deep down, I think it was a lucky find. This area is bare and lots of nothing between towns. Finding him in town was probably pretty easy. If he had been out in the country, well that would have been a harder find.

The June 28 judgment of the 7th Court of Appeals Texas is online (Case# 7-23-00225-CV). Court ruled that there is insufficient evidence of harm to continue the suit and ordered the plaintiffs to pay court costs for the defendants.

In the box entitled "CASE EVENTS" the judgement is dated 6/28/2024. Under the box entitled "APPELLATE BRIEFS", you can read the various Appellant and Appellee briefs.

Also, Chris Samples with KDJW has a response audio available on the highplainsobserver.com site.

Well….it looks like Tom’s body can be released for burial….except his dad won’t agree to it. WTF

There is still that bullet casing and blood found in the Durango. Thomas was supposedly afraid of guns so are we to believe he tried to shoot himself in his auto and missed, just grazing himself enough to draw a little blood and then walks 15-20 miles in 4 hours to finish the job? Sorry, not buying it.

Klein shouldn’t be telling the father of a victim what the right thing is. He wouldn’t stand for someone doing that to Penny.

Im not sure I agree. I don't think anyone thinks that leaving a childs remains in a cold locker is a right thing to do, when it's been 8 years of no closure. If I were a betting person, I bet mom + dad disagree about where his remains need to be laid.

Since they are divorced, and Thomas was over 18 (and most likely did not have a will in place), it is not out of possibility that they are fighting over location.

A new twist from Klein's FB page: Klein Investigations and Consulting | Nederland TX

If you go to his page, you can see the screenshot he is sharing. Now what all does this mean? Why would someone bother faking their name and posting this? Whats to be gained? Did anyone actually seen any of the other posts? I missed them but hadn't been looking either. I also wonder if 'pieces of the puzzle' indicate pieces from Tom missing or pieces to the whole drama with MC and that lawsuit?

Public Statement:
A few weeks ago, KIC Texas began to receive comments from the general public regarding the Thomas Brown case. A subject posted on Facebook using the s/n of Lindsey Snow. She gave her bio to show she was living south of Dallas. We have attached her post.
The information she gave was turned over to the DOJ Dallas, which is also involved in the case. Within a few minutes of the post, it was taken down. However, META had been informed, and the metadata was captured from both the post and the takedown. It was the same. It has created more leads and added pieces to the puzzle of the Tom Brown case.
We want all of you who advised us of the post, and some other posts in the private chat groups, a huge thank you. We urge all of you who monitor these posts to advise us when you see these posts and when you see references to the Brown case.
We have established a new EMAIL for communicating with us when you see these posts. The case is still very fluid and we are still, along with Federal and State Investigators, continually following up on leads. If you see something - say something. Capture the post and send it to us at [email protected] as this is a fully encrypted email off-campus site that is being shared between agencies.
We have been in contact with Ms. Snow (the real one) and she has advised that she did not post this message. Furthermore, she states she believes someone used her name and images. We advised the DOJ and they have issued the proper paperwork to get the information from META to establish the IP addresses and the phone towers to which the information was uploaded and then erased. Again, the initial information is that they match. We would like to thank Ms. Snow for her cooperation and she has given a statement to investigators.

Just MO, while reading his post I had to keep in mind that it was written by the man who publicly claims to be a "Fixer"; seems to be yet just another of his efforts at drama and distraction. JMO.

@jellybean96 Thanks for the updates! When I went to the fb page it looks like Tom's dad has agreed for the release of his remains so he can be finally put to rest. My hope is that there's some measure of justice for him at some point. Maybe someone will say something or they'll come across communication that helps. I can't imagine what Tom's family has gone through and how long it's taken to bring him home. Here's the updated message from Klein's page:

Public Statement In The Matter Of Brown:
A week ago we made a post regarding Thomas Brown's remains. We are happy to announce that there has been an agreement and Tom's body will be returned to Canadian for proper burial.
Services will be private for only family members. We want to thank Mr. Kelly Brown publicly for making this possible. It is our prayer that healing may begin upon Tom's arrival home.
We are working on the case daily and are progressing.

Press Release - In The Matter of Thomas Brown
This afternoon at 3 p.m., Chris and Penny Meek, along with Tucker Brown, filed a lawsuit and request for Declaratory Judgement against Boxwell Brothers Funeral Home and Kelly Brown.
A month ago the remains of Thomas Brown were released to Penny and Chris Meek by the Office of the Attorney General in Austin, Texas. The Meeks, along with Tom's brother Tucker went to the funeral home to make arraignments for Tom's private burial. During the meeting, Tom's mother who had care and custody of the remains informed the funeral home that before he was to be buried they were requesting an examination of the remains and a DNA sample be taken by an independent forensics examiner. The funeral home and Tom's father refused to allow the examination and DNA test to be undertaken.
This entire matter has once again upset his mother and family as the father, Kelly Brown, has through counsel, blocked a separate examination from a team of specialized forensics examiners. The family has been told that the Office of the Attorney General has taken no position as they have released the body to the family and hold no control over the body.
The case has been filed in Potter County Texas and if granted the family will have the team of examiners conduct the examination of the remains as well as the photography as soon as possible so that Thomas Brown can be laid to rest.
John S. Morgan of Dallas Texas represents the Meek Family in this cause of action.

What in the ever lovin' hell!?!?! So sad for the family. I really don't feel like what Penny, Chris & Tucker are asking for is out of line based upon the lack of understanding as to what caused Tom's death. While I understand Kelly's thinking that nothing will bring Tom back and perhaps his desire for whatever measure of "closure" they can get, it's unfathomable to me that he's in effect delaying Tom being put to rest. As a parent I've thankfully not been in their shoes, but it's hard for me to understand. It makes me wonder if Tom was caught in the middle while he was alive despite the words of cooperation put forth publicly (like in Tom Brown's Body for example). Thanks @jellybean96 for the update as I've been wondering when they laid Tom to rest..

UBLIC STATEMENT BY PHILIP R. KLEIN, PRESIDENT
This morning on the radio show broadcasted on KXDJ radio in Perryton, Texas, host and DJ Chris Samples once again went on the attack of Penny and Chris Meek, Tucker Brown and this firm regarding the homicide of Thomas Brown of Canadian, Texas. He uses a co-host in his attack, a man named Michael Crain.

When we first met Chris Samples, we believed he cared about finding Thomas Brown, so I interviewed with him several times. I wanted to make sure the area's citizens did not fear the unknown and gave information that could help the case. During the interviews, we continually informed the public that our focus was Lake Marvin Road. We made the statement because that is where the evidence led us. We were right – Tom’s remains were found on Lake Marvin Road.
Samples became upset with me one morning and off-air asked me if I thought Law Enforcement was involved. I retorted that all avenues of this case were on the table. Sensing that Samples was not going to be objective any longer I advised staff that we were not going to do the Samples show. We received 12 requests to do the show and did not appear.
Post that decision, a man named Michael Crain began to appear on the KXDJ show. We were given recordings of the show and listened closely to what Mr. Crain said. In just listening to Mr. Crain, we offered to fly, let him stay in a hotel room, pay him a per Diem for his meals, and host him (Crain) in our offices to read the entire case file along with all of the evidence. Mr. Crain never accepted the invitation which made us concerned. He was sold ON AIR as a “former state investigator” but in being a law enforcement officer as those that were involved – all accepted our invitation to review the investigation in our offices. Crain refused.

Post Crain’s refusal to come down and take a look at our investigation, the state investigation, and the USDOJ’s investigation that we had (and have) in our possession, it concerned our team. We launched a side investigation into who was Michael Crain, “the former state investigator.”

We discovered that Crain was a used car salesman who had a long history in North Texas of jumping from one car dealership to another. From Dallas to Dalhart, Crain had a long-sorted history. As such, we discovered that Crain had portrayed himself as a former Navy Seal. So, we made a request to the Department of Defense for his service records. During this time, we found advertisements in papers from his employers stating his credentials as a former Navy Seal. We found that Michael Crain had never been a Navy Seal. Even worse, he had been kicked out of the Navy after being involved in a serious fight that injured an innocent Navy seaman, and he was diagnosed with “A Personality Disorder.” We further learned that the only job he had was as an electrician’s apprentice which he never completed. He was “discharged” according to the records. He was NOT “honorably discharged.” To say the least, we were shocked. Crain had stolen valor issues that the DOD (Department of Defense) was previously aware of, however, began a secondary investigation. We cooperated fully with the investigation.

We proceeded to file a §552 request with the State of Texas for his law enforcement background. During one of the shows with Chris Samples, he touted his training and background in all sorts of investigations. His records showed that he was never involved in any investigations other than being a “bottle” reader for liquor stamps and inspections of liquor stores. He was employed for only 18 months, according to the records, and left for the US Navy where he again was discharged. During our interviews with his former employers, they stated clearly that they had concerns about Mr. Crain, and thus his termination. They too stated that he claimed and told stories about his Navy Seal training and operations “overseas” which they doubted after listening to him.

We also checked his credentials with the Texas Department of Public Safety Private Security Board, which he had none. He was acting in the course and scope of an “investigator” but did not have a license to do so. And he did not have a client. He, along with Michelle Gomez of Central Texas began to attempt to insert themselves into the Brown case without a client. In the end, Crain did get licensed, and Gomez settled with the DPSPSB for a fine and reprimand. As well Gomez was voted out of the Texas Association of Licensed Investigators for deception.

The question that not only we had, but the DOJ had was whether Chris Samples knew of Michael Crain’s background before he put them on air. Viciously and with anger both Samples and Crain attacked the Meeks and Tucker Brown with false, misstated evidence and most of all flat-out lies – which continued on this morning's broadcast.

When Samples and Crain suggested that Meeks and Tucker Brown found Toms's body at their home, and then packaged the body and dumped it “somewhere” to hide the embarrassment of suicide – they had enough. They sued Samples, his radio station, and Michael Crain for liable and slander. The case was heard (preliminary) in Lubbock, Texas. Samples and Crain’s lawyers filed under the TCPA (Texas Citizens Participation Act) that Samples and Crain had the right to have an opinion. The Appeals Court upheld their opinion. It was then appealed by attorneys for the Meeks and Brown to the Texas Supreme Court and they too upheld the TCPA ruling. Meaning that even if statements made by Samples and Crain are false, they are entitled to their “opinions.” Crain also set up a GO FUND ME page which he collected over $2,100. He has never shown or proven that he paid his lawyers any money – as they are insurance lawyers we are told. Meaning? What happened to the money? We are more than sure that he gave the money to his lawyers – right? That will be followed very closely.

Further, as an “entertainer” Samples is entitled to put anyone on his airwaves and has no responsibility whatsoever to research and check their backgrounds. We believe that Samples knew of Crain’s
background and psychological background and problems – which is a disservice to his listeners and the public. As you can see, both chirp about the Meeks, Tucker Brown, and our firm, as they are living the lies and making their show (s) sound like there is a conspiracy when in fact there is none. The Meeks and Tucker Brown have done nothing but suffer the loss of their son and brother. There is ZERO evidence that Samples and Crain’s theory are even viable. The entire group of shows are based upon what they had read in the paper, some police reports that were falsified (remember that Pyne Gregory was served a Brady Act – meaning no prosecutor was going to take any cases from him and he had to quit being a cop), and of course, there was a huge discovery at the Sheriff's Office when TCOLE came in and found false records and stolen items from case files – including from the Thomas Brown Case. This firm was DIRECTLY involved in those investigations after bringing it to the attention of the OAG and the USDOJ to which they acted and the Sherriff resigned post agreement with the state.

Thomas Brown’s remains are now subject to a second lawsuit after Thomas’s father, Kelly Brown, refused to allow a forensics examination of his remains by an independent team of agents and officers. His excuse: “I don’t want Philip Klein in the room.” Not only is that sick, but it is highly unusual – unless you go up the trail of evidence that will be heard by a Federal Grand Jury one day we believe. Kelly Brown’s relationship with a police chief and hired a police officer named Pyne Gregory even after he had a Brady Notice placed on him and did not disclose it to his city council or the District Attorney of Lubbock County. The Police Chief employs Michael Crain as a private investigator, yet, portrays to the public that his boss (the Police Chief) who owns a private security company was “dragged” into the case to the public knowing that every single liar and corrupt police officer has something to do with him. That police chief is friends with Kelly Brown. Thus why every single honest investigator, police officer, and federal agent now has their investigations looking into the relationships between all of the parties.

We believe there is a major cover-up in the Thomas Brown case. We believe either Chris Samples and his radio station are being used or they are involved. We believe that Michael Crain is not only a liar and makes things up as he goes – but he is a mentally ill person as has been previously diagnosed by the US Navy and the man cannot hold down a job. We believe that Chris Samples continues to put him up on the radio as some type of legitimate professional “former state investigator” when he was just a bottle reader and stolen valor punk. We believe Chris Samples is a good entertainer who doesn’t care about the truth – just his chance to be a big dog in a little pond. And lastly, we will say this – many of us want to know the relationship between Kelly Brown and this cast of characters. It was Kelly Brown who first suggested to Law Enforcement the “suicide theory” that again there is ZERO evidence of such according to documents.
We are not done. We are going to continue and as we promised the citizens of Hemphill County we will figure it out. In our opinion, good, honest, and hard-working people have been scared by these clowns and liars who get on the radio, and corrupt police officers in small towns that are hiding what they know. As some, like Kelly Brown, run around and point the finger at us, the Meeks, Tucker Brown try to manipulate this case from behind the curtain all the while acting like some Pope that has no (ZERO) evidence of his ex-wife hiding their son’s body and blaming investigators that were involved from DAY ONE – it is sick. And it needs to stop.

Chris Samples needs to be better. Stop being an Entertainer and be a community leader. Michael Crain needs (as a commander who did the research said) to apologize to the US Navy, the US Navy Seal Team Members, and the public in general for lying about his service. And Kelly Brown needs to take a hard look in the mirror and figure out if he is helping the case, hurting the case, or maybe even deflecting the case.

We are going to find out. And we are going to fix it. That is what we do.

Our prayers and thoughts go out tonight to the Meeks and Tucker Brown who once again had to suffer the tongue of the devils that surround us all.

Ok, I have been disecting Kleins post.

My main question is why MC would not take Klein up on his offer to read all the files and see all the evidence. Klein was willing to foot the bill but he never took him up on it. Now why is that? Lord knows, any of us would jump at the chance to see the official files and be able to see first hand what evidence is really there vs. not. He is being used as a commentator on Samples radio show. Seeing the evidence first hand would be exciting to someone who has inserted themselves so much into this case.

My second question is why Kelly Brown didn't want an autopsy done. Now, I've lost a child and am quite aware how hard it is to think about your child having an autopsy done. And I get it -- he doesn't like Klein. But as long as the autopsy was being recorded --- and it would be most certainly --- why not let it be done? Whats the harm? I am getting major big red flags about this. By refusing, Kelly is only dragging this out even more than it's already been. And I get it --- I have an Ex that I don't want to agree with on anything as well. But at the end of the day, if you're so confident in the suicide theory, why not give a little on this? Prove Tom's mom wrong once and for all.

My third question is all about Kellys, Pyne, and the police chiefs relationship. Something is fishy. Remember before Thomas died, Pyne Gregory pulled him over and before it was all said and done, Pyne went to Thomas' dad about it? I cant recall the specific details but I thought it was curious at the time. To put it bluntly, it all stinks from where I am sitting.

All of this is just my opinion and thoughts.

My thoughts to your questions from someone that has followed this from the beginning:
Main question - MC maybe felt this offer was a power play and nothing else; As much info as has been put out by Klein over the years though the radio, fb, and "town hall" meetings, does anyone really think he has this huge hidden trove of evidence? We have to remember that the Texas AG has ALL the evidence and it would be prudent to assume that no one outside of the investigators has access to it. The release of the AG's report as well as the access by Texas Monthly to the lead investigator gave a lot of insight by what was released and by what was said - but also insight into what was NOT released and what was NOT said.
Second question - Klein publicly posted about Kelly Brown not authorizing the release of the remains in order to put pressure on Kelly. Several times Klein posted about a "proper burial". He even posted this:
"There are no other answers that can come from the Remains. FBI, USDOJ, OAG and other agencies have done their work. If we felt there was something that should be done and to hold the remains - then we would be screaming from the top of the hills. It is personal." Now, after KB signed off to have the remains released (maybe under the belief there would actually be a proper burial?), Klein is now insisting on "further examination and DNA testing". Did the Texas AG and other agencies not do that? May be just another tactic to keep the pot stirred up and the deflection game going?
Third question - you are mixed up about the deputy and the interaction with Tom. It wasn't PG; it was with NL prior to NL being elected sheriff; he worked in law enforcement in another jurisdiction; the interaction did seem to be inappropriate and uncalled for.
