Thanks Alyce.

Thanks, Alyce and Tortoise, for clarifying this odd situation as far as possible. As we did get reports of Mr Bayada's evidence, I suppose we still might get some reports later, before the final speeches.

  • #465
I hope so Moll.

I've just been over the first trial records to get some timings

Week 1 (3 days) - Mr Bayada 2 days
Week 2 - Mr Bayada 2 days, site visit 1 day, 9 other witnesses
Week 3 - 8 witnesses, toilet video watched, judge instructed jury that slinks were deliberately removed, they were not missing or did not come off accidentally.
Week 4 - text messages, gas fitting and VC on stand for 3 days giving evidence.
Week 5 - VC another 3 days (x-exam and re-exam), EC police interview 1 day. DEFENCE opens and EC gives evidence 1 day.
Week 6 - EC x-exam 2 days. Pros and Defence closing speeches 1 day each.
Week 7 - Judge's summing up 2 days. Jury deliberates 2 days (1 day juror unwell)
Week 8 - Jury deliberates all week, majority ruling 10-2 given on Tues, 2 jurors leave with stress on Thurs and majority ruling given 9-1, Jury discharged on Friday.
Yesterday was the end of week 3 in the re-trial. Just keeping tabs, since nothing is being reported.

:D

Thanks, Tortoise. So by the end of Week 3 in the first trial they had heard 18 witnesses, and VC was soon to give evidence in the next two weeks over a period of six days altogether. This time they have heard 14 witnesses.

Courtserve shows Court 2 sitting at 10am, same restrictions as before. It shows up below this time but enormous, sorry! There are no further details on the Winchester Crown Court site, except that the case is named as Emile Stolz Cilliers.

Law Pages finally have something up - but more of the same really - up to #15 witness.

editing now that I have re read Tortoise post above.

Bit more info from today - unless they have got their figures wrong, then it looks as though Witness 15 has been recalled

This is a very boring case second time round, isn't it? Worse than one of those TV dramas all in the dark with everybody mumbling.

  • #472
At least the judge only has to tweak his summing up notes from the first trial, so that might lead to an earlier conclusion.

This makes interesting reading, in the light of the continuing ban on reporting this case:
https://www.judiciary.gov.uk/wp-content/uploads/2015/07/reporting-restrictions-guide-may-2016-2.pdf

e.g. s.4
Where the court is satisfied that a reporting restriction pursues a legitimate aim and is truly necessary,it must consider carefully the terms of any order. The principle of proportionality requires that anyorder must be narrowly tailored to the specific objective the court has in mind and must go nofurther than is necessary to achieve that objective. Over-broad orders are liable to be set aside.

We may have live reporting:

Sergeant's wife wanted to 'paint him in a bad picture', court hears
The wife of an Army sergeant who is accused of twice trying to kill her today said she was not 'completely' telling the truth and wanted to 'paint him in a bad picture' during police interviews.

Victoria Cilliers, a physiotherapist and former Army officer, claimed she had 'elaborated' and was 'angry' when she was interviewed after falling 4,000ft when her parachute failed to open.

It is alleged Emile Cilliers, of the Royal Army Physical Training Corps, tangled his wife's main parachute and removed two vital links from her reserve canopy while in a toilet cubicle, causing both to fail on April 5, 2015.

Cilliers 'damaged gas fitting to cause explosion', prosecution says
Prosecutors allege just a week before, Cilliers had damaged a gas fitting at the home he shared with his wife, now 42, in Amesbury, Wilts, in a bid to cause an explosion.

South African Cilliers, who was having affairs with two women and was in contact with prostitutes, had allegedly racked up debts of around £22,000 at the time. It is claimed he thought he would receive a £120,000 life insurance payout if Mrs Cilliers had a 'fatal accident'.

In fact, prosecutor Michael Bowes QC said the insurance money would go to his wife's estate if she was to die, but Cilliers was not aware of this.

Prosecution says wife changed her story
Giving evidence today at Winchester Crown Court, Hampshire, Mrs Cilliers said she was angry when police interviewed her after the horrifying accident.

When asked today whether she was concerned about the amount of time Cilliers had spent in the toilet with the parachute, she said she was not.

But prosecutor Michael Bowes QC said that was not what she had told police during her police interviews.

13:40
Victoria Cilliers says she was 'not telling the truth' during police interview

When Mr Bowes QC asked Victoria Cilliers whether she had told the police the truth, she said: 'I was not telling the truth.

'I am not saying I lied completely. I was angry and I elaborated throughout the statement to paint Emile in a bad picture.

'I know what I said in my police statement and I had a reason and a motive for doing that.'

Army sergeant's wife left note in her will instructing estate should go to her children - not her husband
It was also heard that Mrs Cilliers had left a note with her will, saying Cilliers 'poorly manages money' and instructing that her estate go to their children in the event of her death.

Reading the letter, Mr Bowes QC said: 'Dear executors, in the event of my death I would like to leave my estate to my children.

'By his own admission, Emile poorly manages money and I am not confident [the money I leave] would be used for the benefit of the children. I do hope, Emile, that you understand my reasoning. I love you and you are an amazing father.'
