She's lying and hedging, but she's doing it in such a pleasant manner that it's not going to be obvious to the jury - since they don't know the whole back story.

One thing I do know..Macneil could never make it as a soap actor. He is very bad at it.

I just graduated and will never be confused about hearsay. We were grilled in Evidence, (a seated judge was our professor) and in Trial class and in all preparations for Evidence hearsay is the big subject that takes the most time to study. I guess I don't get the confusion. You have a list of hearsay objections, pick one.

The defense is allowing these compound questions because they add to the confusion. Objection....compound question!!!

Approach and refresh her recollection. Point it out. This is stupid.

I have found that both the prosecution and defense repeatedly ask confusing and compound questions. It seems like none of them are as prepared as they should be.

There might be slight variances from state to state but they are pretty consistent and usually based on the federal rules of evidence.

And don't worry because most attorneys get confused about hearsay too

I read where this judge is like an expert on Rules of Evidence, so I bet these attorneys are a little intimidated. When the judge asked for the Prosecutors reasoning for an exception to the hearsay rule, the Prosecutor's voice went up as if his reason was a question.

I really admire you for being able to know all these rules and cases etc. It is a lot of info and details.

Wait til you've been practicing a while. You'll see that attorneys often are not well versed on hearsay and objections. You'll also see that judges are not always informed as they should be.

I hope they wrap it up so the state can re-group and get it together.

This would be the most fun witness in the world to get on the stand, my gosh! Go for it.

And don't let her wiggle out of those questions. You must channel Juan on that subject.

I don't like her. That's stating it politely. She is as evil or almost as evil as he. Who attends your lovers wife's funeral. Who wears clothing of your lovers deceased wife. The fact that she attended the Funeral leads me to believe she knows full well where that jacket came from :banghead: Just bouncing off your post.

Evidence and hearsay is something I pay a lot of attention to, as well as rules of trial procedure -- I am in trial every week, and it is a huge advantage to have a very good working knowledge of the rules, particularly because most attorneys do not take such care in using the rules of evidence and procedure.
