I don't like her. That's stating it politely. She is as evil or almost as evil as he. Who attends your lovers wife's funeral. Who wears clothing of your lovers deceased wife. The fact that she attended the Funeral leads me to believe she knows full well where that jacket came from :banghead: Just bouncing off your post.

On the plus side she was smiley, energetic and perky.....not to mention young!:floorlaugh:

Guys, also do not forget where they are. Provo Utah does not have a massive crime problem. A murder trial? Highly unusual. A high profile murder trial? A nightmare. Not excusing anything but eh, there is nothing very typical about this situation. JMO

Evidence and hearsay is something I pay a lot of attention to, as well as rules of trial procedure -- I am in trial every week, and it is a huge advantage to have a very good working knowledge of the rules, particularly because most attorneys do not take such care in using the rules of evidence and procedure.

I have heard the judges say exactly what you are stating and that you have a big advantage with that working knowledge.

Maybe I just watch more trials than most lawyers. You have to watch the game tapes.

Going back to Rachel's cross, I don't understand how the defense could bring up her 2012 ER visit for delusions and psychosis. Isn't that information protected under HIPAA? I found that very disturbing. And I don't understand how the defense could bring that up? Statements by the ER physician would have been hearsay? I am very confused by that. Any explanation you all have would help. TIA

Nothing is covered via any privacy laws in a murder trial. Not even Hippa, for anyone close to the victim or defendant. Nothing! Not even applications for food stamps, not phone calls or emails, literally nothing that is on record anywhere in that person's name or SS# (or now video taped in the Big Brother world we have.) No privacy for anyone in a murder case period. No law trumps.

Bringing it up was to try to make the witness appear unstable, unreliable, to make the jurors disbelieve.

If this has already been answered, I apologize, but you will not believe the records I have seen for innocent family or friends.

Yes. I don't want to engage or open a can of worms but there may be a few Mormons on the Jury. I am not in any way saying a Mormon could not be objective.

Plus I bet the electricity in that courtroom shot up when Gypsy walked into the room. The prosecutor was not cool calm and collected, but he will have 3 days to pull it together. I liked the way the camera person followed Gypsy even after she stepped down from the witness stand. All of us have been waiting for this day and the camera person accomodated us.

Nice catch! Pity Gypsy didn't mention that, ya know, to help her jog her own memory.

( reminds me of Punkin Pie from the Phil Spector trial).

Although she has every right to wear what she chooses,the jury will see her as what she speaks, is, and dresses. Her choices. I don't have to type them, she wears it.

Thanks for your response. Yes I do believe it was brought up to discredit her. I brought it up here on the board just to explain why she appeared a bit "off" in her responses. I being here watching from a distance and if I was there as a Juror would have been pleased it was brought up. As a Juror I would have thought Oh Ok that explains how she presents and would then focus on what she had to say. She was real and raw IMO. I think the intent backfired. I wish her well in life.

Yes, if I recall Provo is 98% Mormon. Home of BYU and the largest missionary training facility in the world.... It's not out of the rhelm to say that most of the people in that courtroom are Mormon as well as the jurors. Not saying anything "bad" or "negative" either. There are just a lot of highly religious and "proper" people involved in this. So, from their odd smiles and manners toward one another to their cool calm dispositions realize that LDS is in the room too.

Ha ha no he was not cool at all. I heard his voice crack to a high pitch like Peter Brady a few times.

I wish they had a woman to handle this witness. Not that men aren't' capable but we have a certain Je ne sais quoi that does not allow another woman to out manipulate us and duck the tough questions. Even better when it can be done in a "nice" non confrontational female way. Gypsy's testimony should HANG Dr. M. It's like gold. Has to be properly mined.

To clarify on the pain meds: The drug name is OXYCODONE. It is an opioid based pain reliever.

"Oxycontin" = Oxycodone + Acetaminophen in a timed release form
(The name comes from "oxycodone continuous")

Available in various strengths. The strength number is the milligrams of oxycodone. So an "Oxycontin 40" has 40 mg. of oxycodone in it. Also, since one Percocet has 5 mg. of oxycodone, an "Oxy 40" is equal to 8 Percocets.

The delivery of the medication into the bloodstream is for 12 hours. This delivery system for pain medication was a breakthrough in chronic pain management because it offers a continuous level of pain relief to chronic pain patients.


Percocet = oxycodone + acetaminophen (not in a timed release form)
Percodan = oxycodone + aspirin (not in a timed release form)
Usually 5 mg. oxycodone per tablet (but also available with 7.5 mg oxycodone per tablet)

This is the same drug, but in this form the duration is usually 4-6 hours. Plus during that 4-6 hours there will be an onset of action, then a "peak" blood level, then a tapering off. Not the greatest for a chronic pain situation because the patient has "peaks and valleys" of pain relief.

Because of drug laws in the U.S. prescriptions for any of the above may not be "refilled" or "called in" to a pharmacy. A new prescription must be obtained.

HYDROCONE - A weaker opioid pain reliever. (Vicodin)

Still a controlled, scheduled drug in the U.S. but it CAN be refilled and prescription can be "called in" to a pharmacy. Many doctors and dentists prefer to prescribe this as opposed to the stronger oxycodone.

FENTANYL - A synthetic opiate, a "designer drug". Stronger than morphine.

HIPAA LAWS - People, including health care workers, have a lot of misconceptions about what is and isn't covered, who may or may not have access to medical records. Never designed to shield or hide medical records from law enforcement agencies or court orders.
