GUILTY VA - Codi Bigsby, 4, last seen at dad's home, Hampton, 31 Jan 2022 *dad charged* #2

Thank you for trying! Water Team, Inc. is still searching and taking volunteers AFAIK.

Codi Bigsby's story spreads through social media | 13newsnow.com
The group is also considering expanding its search efforts to Norfolk, parts of Newport News, and Yorktown once the group covers all of Hampton. Hampton Police said last week they are focusing their search efforts in Hampton.
Norfolk, NNews and Yorktown??? I wonder where the logic is there. Large area to cover, too.

This will be interesting if we get to learn why all 3 judges have recused themselves. In googling, I learned that judges "may not recuse themselves for insubstantial reasons". In other words, they've all 3 got a reason.

I wondered if it might be a competency and authority situation because of the neglect + police error + missing child but looks like the circuit court has the authority to try “all types of civil and criminal cases”.

Circuit Court
Serving the Commonwealth through 31 judicial circuits, the circuit court is the general jurisdiction trial court with authority to try all types of civil and criminal cases.

Virginia's Court System

Now that I think of it we had a case in Virginia Beach where the offender was a relative of the clerk of court and the case was moved to nearby Chesapeake court system. And it was for series of minor crimes, not felonies.

I thought the realtor had said she'd seen him on January 11? Can anyone confirm?
This article says November

  • According to the real estate agent, Cory was a 'strange' client that did not want to meet up in person and wanted to communicate over text message. She said the one time she did meet up with him for a brief period, there was a little boy with him. She said she believes the child was Codi after seeing his pictures related to the disappearance. She said he was the only child with him at the time of the meeting this past November.

Regardless of why, I think it's a smart move on the Chief Judge's part. Now the case will be decided by a Judge of the Highest State Court in Virginia. They are making it more difficult to potentially appeal the ruling.

I thought Cory's case was being heard in the Hampton Juvenile Domestic Relations Court. ?

‘I am praying for the safe return of my baby boy’: Codi Bigsby’s mother releases public statement | WAVY.com
Bigsby remains in custody on the child neglect charges after a Hampton Juvenile Domestic Relations Court judge denied him bond on Tuesday. Bigsby was transferred to the Hampton Roads Regional Jail in Portsmouth on Thursday morning where he has been placed in quarantine, according to jail spokesperson Sharon Scott.

ETA: Nevermind - I get it. The bond appeal was scheduled in Circuit Court...

Bigsby was denied bond on the felony child neglect charges on Feb. 8 in Hampton Juvenile and Domestic Relations Court. Ambrose filed a bond appeal, which is scheduled to be heard in Hampton Circuit Court on Feb. 25. Ambrose said the judges’ recusal could impact that hearing.

I don't think a judge can recuse him/herself just as a chess move. I think there has to be a legit reason - i.e., they know the parties involved, or there's another reason they have a conflict of interest in judging the case.

I wonder if the judges were aware of the details of Cory's confession. MOO

“Judges have a duty to ensure that when they oversee a matter that they can do so fairly and impartially,” Ambrose said. “If there is any concern about that, it is the judge’s duty to step back and allow a judge that does not have any potential disqualifying interactions with the case to allow them to step in and be that neutral party that needs to be present for our justice system to work.”

‘He was telling the truth’: Attorney speaks with Cory Bigsby about police ‘mishandling’ interrogation | WAVY.com
[...]

“Cory, when I spoke with him following the chief’s disclosure, was happy that people understand now that he was telling the truth — that he was trying to have his rights and that, unfortunately, they were not honored,” Ambrose said.

Ambrose is still waiting on copies of the interrogation videos, as well as documents and reports, that should be provided to him by the Hampton Commonwealth’s Attorney’s office.

“Certainly at any time there is a violation of a citizen’s rights, there will be legal consequences for that,” Ambrose said. “As we understand the full scope of what happened at Hampton Police Division headquarters during that investigation, we’ll understand better what the definitions of those consequences might be. Certainly, I expect that they’re going to be large ones, as this was a substantial breach of civil rights.”

My thought was they may have signed some of the search warrants? To Pommy's point, the probable cause could have included the confession.
