Cory Bigsby attorneys want judge to suppress his statements to police about his children.
An evidence suppression hearing was scheduled in Hampton Circuit Court Tuesday to address the matter, but the hearing was postponed because of procedural hiccups.

An attorney for the U.S. Attorney’s Office, Kent Porter, asserted that Bigsby’s lawyers didn’t follow federal law in how to go about requesting testimony from the FBI agents who interrogated Bigsby along with the Hampton police detectives. As such, Porter asked a judge to throw out the defense’s subpoenas for agents to testify on Tuesday.

I really don’t understand why the judge is putting up with the delays from the defence side they wanted this court date asked for it and weren’t prepared . The defense is really grasping at straws trying to find something that may help them . If Cory is ever charged with Codi being missing his lawyers are going to be in way over their heads. Jmoo I love how Nancy and the people in codi’s voice are keeping Codi in the news and are at every court hearing ,

Appropriate ruling IMO. In general, continuance motions are quite common and not usually opposed. Here, there’s a lot of discovery and there are some major Constitutional issues. Judges tend to be good at discerning dilatory tactics.

So since the subpeonas for the FBI agents were quashed the only outstanding thing to rule on at tomorrow's hearing is whether or not to allow in the video of Corey's interrogation? There were issues with the subpoenas but I haven'y heard if defense had revised/corrected ones issued or . . Because her statements below indicate the motion for suppression was reliant upon those FBI agents.

The court was supposed to hear from the ten witnesses called by the defense, however, procedural errors prevented the court from hearing the defense’s argument.


A U.S. Attorney told the judge defense attorneys did not follow proper federal guidelines in their attempt to get the four FBI agents to take the stand.

“We need those FBI agents to be there […] in the case,” said Brown outside the courtroom. “So it’s why we have to have them. They were there the whole time. We wouldn’t be able to get that motion suppressed unless we had all of them along with all the Hampton Police officers.”

The judge ruled to quash the four subpoenas for the federal agents and issued a continuance in the defense’s original motion to suppress the interrogation video.

The ladies that went today said Cory was denied everything they asked . The statements are allowed nothings being tossed out. Aparently Cory looks like guilts eating away at him he should just confess jmoo . Tick tock Cory #WheresCodi

Those lawyers be a crying will post links as soon as wavy or someone posts . It really wasn’t a good day for Cory. He better buckle up court next month he’s going to go for a long time . I just wish he’d say where Codi is .

It’s so sad that little guy either looked sad or angry in every picture. Not one family member advocating for Codi that is freaking awful. I am glad there’s a group being codi’s voice they go to every court , they keep Codi’s name out there. Jmoo

Judge rules against suppressing interrogation of Cory Bigsby

A Hampton judge ruled he didn’t hear enough evidence in the courtroom to suppress what Cory Bigsby told detectives on the night his son Codi was reported missing.

The specific timeline in question is between 9:33 p.m. on January 31 to 4:13 a.m. on February 1 when Cory asked for a lawyer.

That means whatever was revealed to detectives during this time can be used during the trial.

As part of the motion to suppress the questioning that took place, Cory Bigsby’s attorneys filed 10 subpoenas: six for Hampton Police officers and four for FBI agents. All 10 people are believed to have been involved in the interrogation of Bigsby.

The judge ruled to quash three of the four subpoenas for the federal agents.

Yeah, I agree it's sad. I had made a comment perhaps in the 1st thread about how sad his eyes were. They have dark circles underneath. :( I feel for the little guy and what he went through to cause them.

Trial for abuse charges is November 7th.
But Codi still hasn't been found. So what's the next step there? If hes never found will there never be an indictment? I'm a little confused.

It just doesn't make any sense to me, how nobody in that family seems to be asking where Codi is. Why are they so "loyal" to a father that hasn't reported his child missing and refuses to disclose where his 4-year-old son is? This makes zero sense.
