You asked me what I thought I told you. As far as I am concerned a pregnant murder victim always counts as 2 people.

Depends on the STATE ... see Carly Scott case here on WS. Hawaii doesn't agree with that per their law.

I have to tell you that I would not vote for death for her. Not because I believe anything she says or agree with any of the mitigators. But because I think the DP is for people who murder more than one person. I think it is for people who kill kids or serial killers or people who target officers. But in this case, I don't see it. If it was me, I would be voting against DP here. I know people want her to pay. So do I. I would have given OJ death because he killed two people. I think Scott Peterson deserved death because he killed 2 people.
But as horrible as this killing was, I just would not vote for the DP for her. I think it is for the worst of the worst and I don't see that here. It could be that someone else feels the same way.

If you think about it she did kill more than just Travis. She killed his future children. You know he would have had children one he found his wife. By taking his life, she took all the generations of his progeny.

Near the end Cathy said she watched the jurors as they left the courtroom and 3 jurors #1 and 2 males looked at the Alexander family. She was very sure and clear about it. Then Jeff said well that tells him there is a 9-3 split, 3 for death and 9 for life.

I thought last evening it was split 9-3 (due to number in break together) but my thinking it was 9 for death and 3 life. hmmmm

No matter who is for death, I hope they stay strong even if it does cause them to hang. I want her to know at least some of the jurors wanted death for her.

I don't think anyone that believes in the death penalty will vote every time for death. But this is not about death penalty cases in general but JAs just punishment instead.

There is no way in hell that the foolish mitigating factors substantially outweigh the aggravating factors in this case.

Based on this case, this murder, this victim, this defendant, and with all the evidence entered the only fair, and just punishment is death for JAA. Remove the gender of the defendant and she would already be on death row since last year.

She is one of the worst. Most do not do gruesome overkills like she did. Most don't drive 1000 miles to slaughter someone. Most don't continue to twist the 'knife' into the hearts of the victim's loved ones years and years after the slaughter. Most don't create the most outlandish lies against the victim two years after they are arrested for murder.

Oh yeah, indeed she is one of the worst, and bad to the bone.IMO She is a very dangerous person. Even when she was arrested she had already replaced the small caliber.25 with a 9mm pistol and of course more knives.

I think you are touching on something that I believe becomes part of the problem for juries and even us.

Its when we start to use our own personal feelings and morais (sp?) instead of following the jury instructions to a "T".

I dont know enough about the DP jury instructions to really comment much about it, but the point I am trying to make is based on my understanding that the jury was instructed that
IF the evidence shows that she is "worthy" of the DP, then we as a jury should vote for that. Like the Mitigators, etc.

And I think what throws people in a loop is instead of doing that, we begin to think about our own perception of who we think "deserves" the DP instead.
Things like if they were a cop killer, or a baby killer, or a serial killer.

Those types of things are not in the jury instructions as far as I know.

It all comes back to the "vetting" process in the beginning. And I firmly believe that not near enough is done to properly vett out the jury pool in a DP case. A hung jury just happens way too often due to jurors essentially getting cold feet OR using one of their own morals to decide.

I don't think She is mentally ill enough to escape death. I wish I could put my finger on it.
One thing that I do find appealing about no DP, is that the Anti Death crowd will not be working on this. No one is going to make her a cause except the 9 people she has now. She will fade as the years go by and then she will cease to exist. She will just rot in that cell and be in the nothingness that is prison. Maybe that is it for me. Maybe because of who she is, I feel like for her rotting in that jail being nothing special is better than DP that sadly comes with notoriety, its own set of people that will come out of the woodwork to support any nut on DR.

Does that make sense? I think that in this case I just feel like LWOP is worse for her in the long run?

I personally would vote DP. I don't care how she will "feel" once at Perryville. I just want her to get the sentence she deserves, and I don't care if she is a white-ish female. This case needs to set an example as to why there is DP in the great State of AZ - violent women murderers, in this case. If she doesn't get DP, they might as well toss that option out for any case.

Not that same thing. Sorry. I know that is horrible and she took so much. I think she is a monster. But not the same thing FOR ME as a pregnant woman with an already growing child.

There are people on death row and they didn't actually DO THE KILLING of their victim. I don't get shocked by much, but I am shocked that this isn't heinous enough for some to assign death. And a humane one at that.

I have never been in a courtroom when I didn't see the victim's family members present when we walked out for a break/lunch or for the day when we were in deliberations. We all were aware they were waiting inside as we deliberated. It was common to see the defendant's family there as well. I only remember one case I served on where no family members showed up for the defendant the entire length of the trial.

I don't think the jury holds it against either family. They know they are waiting as they deliberate. IMO

If I were on the jury and was seeing family from both sides, I would feel under pressure like i'm a surgeon performing life saving surgery.

I don't think it's a good idea for the jury to see an "audience".

OK, lets say they are a hung jury. If she gets life WITH Parole. That would be 25 yrs -the 8 she already did, then prison over crowding, good behavior, she could be out in 12, all the time making friends in jail, laughing that she got away with it, living life. That would make her around 45 when let go free and clear. This Monster could be out on the streets again. I guess if you want to rage kill your lover, do it in Arizona, the jury will let you go, not like Texas where murders get the justice they deserve quick.

I think this is a big problem with the DP and why a lot of people have a hard time with it.

I have no problems with the death penalty but it does not mean that I would absolutely vote for a death sentence for a murderer. I do not think JA is the worst of the worst, not by a long shot. And when people say that if she was in Texas we would surely give her the DP and execute her, I would say Texas has had a lot of problems with putting people on death row, only to exonerate them later.

1) Arizona is a law & order state. I'd expect a better jury here than in Florida. 2) JSS does NOT have positive feelings for Jodi. She sees her for what she is. I've said this over and over- she had to bend over backwards for the DT because it is a Death Penalty Phase, and would have done the same for any other defendant, not just Jodi!!!

Just read somewhere that, if this jury deadlocks, the decision goes to JJS. BUT the DT gets to put on witnesses (no cross examination) to try to persuade the judge that she should get LWP? So Mrs. Arias could still speak for her daughter and even Jodi could speak. Is this true?

In my opinion and only my opinion.
Judge SS told the jury that JA had already been convicted of 1st degree premeditated with cruelty murder and "you must accept that".
If I were one of the jurors trying to convince the others that JA deserved the DP, I'd 1st tell them to apply the law and then I'd pull out all of the autopsy photos and ask if these trump JA's poor me mitigating factors.
