SO awful. And I wouldn't be surprised if they do link him to his stepmother's death.

We need to do a better job of empowering and educating our young people (girls AND boys) to not settle for being abused (physically or emotionally) in their romantic relationships. My heart goes out to her family. :(

A man accused of killing and dismembering his wife in Vermont two years ago was back in court Wednesday for a motion hearing.

The court did officially grant a motion to compel for that firearms test, but a date has not yet been picked for the test to take place.

Attorneys with the state asked the judge if the test could happen within 30 to 60 days and the judge set a deadline of September 30th.

Once it has happened there will likely be another hearing to bring this case closer to a trial.
 
So, this guy confessed to shooting and dismembering her and putting her remains in the camper's bathroom. Then he recanted his confession and pleaded not guilty? What's the theory of how her remains ended up in his bathroom, then?

He's going to use a domestic violence/abusive wife defence, just watching his interview with LE and every chance he got his stories of how abusive Emily was were added too, but occasionally he let slip things such as his throwaway comment that you mess with me stuff happens (not verbatim)
I don't know if there was abuse during the relationship, but we are sure to hear all his story of abuse, and IMO I am willing to accept the premise that everybody can be a victim of domestic abuse so I don't discount his reporting of his abuse, I will wait to see if there is other evidence that reveals this, but most abuse is behind closed doors so he may not have any evidence beyond his word, I do find that a persons phone tends to be good evidence of what a relationship is truly like, as in the privacy of our phones the abuse often is on there in text messages, voice notes etc
I don't think he lost his mind due to her alleged abuse that evening, she wasn't in his face according to him she was in bed, he then chose to get his gun and shoot her twice, not a heat of the moment event IMO then he gets rid of her phone, wallet, glasses and casually cuts her up so he can bury her in the woods, and lies to her parents face
 
And reading around the case I see he was asking for his gun to be tested, maybe his story will now pivot to they had a fight and were fighting over gun and it went off twice, I am new to the details so am off to do further reading, just one further thought, he through away her glasses, he had to pick up her glasses to dispose of them with her phone which to me says they were in clear view, I can't see him searching around for her glasses unless they were on her face, which then means the candle blowing out didn't happen, which is highly likely, I doubt he shot her in the pitch dark, I am off to see if LE found her phone and stuff
 
Having read the thread I have more of a handle on the case, he was so much older than her, I am going to go back to rewatch his interview with LE as they did ask him when he and Emily met, and how old she would have been when they began dating,
One more thing from the LE interview he never told them they were married, the police officer asked him about it
And kudos to the friend who immediately rang LE once he learned of the murder,
And the other murder that remains unsolved in his family,
 
He's claiming they both had guns. Sounds pretty far fetched:

“That’s when she said, ‘That’s it, you’re dead,’” Jansch said Emily Ferlazzo told her husband.

Emily Ferlazzo then pulled out a gun from under a pillow, the defense attorney said.

“He, of course, has his gun in his hand, that’s what these two people did, they believed they needed to sleep with their guns for self-protection,” Jansch said.

“He already had his Glock in his hand, he saw her hand start to move out from under the pillow and he shot her — twice — and killed her,” Jansch said, adding, “After he shot her he really was in a state of panic and shock.”

 
I nearly fell off my chair when I went back and watched the opening statements, I was late to court so missed opening statements, only to learn he was going self defence, I thought a self defence defence was affermative defence and they went first as it was their burden to prove, Vermont must have different rules.

It is really though the only defence as it would be a very hard sell to say the shooting was in any way justified because Emily was not berserk when he shot her, she posed no threat lying in bed. Self defence was what he
landed on and I am very interested to learn which gun he shot Emily with, the one they recovered from under the pillow or the one in kitchen draw.
 
And very interesting evidence today, the red cushion with two bullet holes and the projectiles found in the pillows, ballistics are going to be interesting,
And one could see just how affected by the horror of the murder and the evidence collection LE were, to see the CSST woman tearing up when she discussed taking Emilys head out of the bin bag at the autopsy.
And looking at that saw and how many pieces he cut her into must have taken him hours,
 
I’m just now listening to this guy’s testimony — came in partway through. Why am I so irked that he keeps calling the van “Rosie” like this is all a lark? And he said this was their first trip “as a family” and he said two other names, Nikki and someone else?? They didn’t have kids, did they? Now he just mentioned Remington. Maybe they had pets.

ETA: Never mind, I’m starting to figure it out. This guy…

This guy is insufferable.
He's self pitying... victim blaming... the sister's testimony absolutely did not help the defense, his former friend hates his guts (understandably), his entire testimony is absolute total complete kaka. Self-defense. Really. After NO documented history of DV by her. After there was discussion of divorce, he went to visit Emily's parents and had a pasta dinner with them while their daughter lie in pieces in garbage bags!?!? FNaw. Lock this guy up, ASAP please.
 
i am late to this game-- i've googled and need help please. as i remember, this has taken 3 years to come to trial? and hasn't he been locked up for most of that time? this slow walk isn't typical,is it? (and i stand easily corrected on my assumptions!)

There was solid witness evidence there was abuse in the relationship. She had bruises.

New report that a precious girlfriend filed a police report and tried to get a restraining order from him. Also, he had no evidence of bruising when he was picked up. NONE. His statements in the interrogation about how he was entitled to have Emily put out when he wanted, and his constant slamming of her, were red flags for DV.

Also, per pros closing, the parking lot where they parked at a air Bnb was the same complex where Joe’s ex lived. Yep, he was planning to see his ex on the anniversary with his new wife. Also, he said he was polyamorous. The pros said Emily told him that night she was through. He killed her 5 minutes later.
